Thomas Munroe, Leisurevitle Homeowners Organization Walter Madsen, former Mayor PH'~3LIC AHDIENCE Thomas F. Canavan made inquiry in regard to Plumbing and Electrical inspectors being discontinued. Mayor advised that county had only one man and the City followed this procedure. He asked ~hy four inspectors are hired now. Mr. Be~reF, representing Senior Citizens of Sterling Village and Con- cerned Citizens of ~3oynton Beach discussed Plat 5 of Leisureville. He referred to ~{r. Wallace pointing out at last meeting that Caldos was doing its part in carrying out its obligation and he hoped the ordin- ance allowing special exceptions would not be rescinded. He felt Leisureville had been harrassed and wanted to express his opinion that the variances for Leisureville should not be repealed. Col. Albert Wehrell -'{e reviewed what had occurred at last meeting when he appeared before Council and stated for a moment he thought he must be on a college campus, but later realized it was coming from -1- MINUTES REGULAR CITY COUNCIL MEETI~'~ APRIL 6~ 1970 the so-called concerned citizens of Hoynton Beach, who did not have the courtesy to listen to another opinion. He noted that one man was quickly gavelled down and ruled to be out of order. To those who were rude: he asked~ ~'Where were your manners~? Ezell Hester~ 1106 N. W. let St. - Asked Council if they can defend themr decisions made at Council, They replied that they could. He said Col. Wehrell had gotten up last meeting to defend Council on some decisions ~ more particularly on the police issue, l~e agreed that Mr. Wehrell had a pight to express his opinion but not the right to defend opinions of Council. He hoped Council ~uld see fit to in- struct the Acting Chief o~ Police tO instruct his o~ficers to read the Civil Service rules be cause they undoubtedly do not know them. He said he had read that Mrs. Jackson was going to get City Manager based on experience and administrative ability and he hoped this would be true with all Council and not base the appointment on political reasons. Bill Edell, 2 Coconut Lane, Ocean Ridge - Invited Council and all ~eople present to attend Doynton Sing into the '70's, to be held week ~rom Saturday at Civic Center at 1 P. M. Eddle.kltchel!~ 329 ~. E. 12th Ave. - Suggested.Mr. WehreI1 give his ~itten report to the papers ~ather than bring mt to Council. He felt something should be done to improve rest room facilities at Wilson Recreation Center. He noted when the pool is closed the rest rooms are closed. He felt Council had gone into their bag trying to ~ind tricks and he felt trick time is over now. He referred to Mr. Wallace his comments regarding action being taken against persons violating Civil Service rules on night of meeting with former Chief of Police. He said he expected it to be on the agenda. He said if they were not going to abide by law~ there is no use having the law. He said he wondered why certain individuals are still hanging around the Police Dept. Are they trying to get a job they said they didn't want~ Mr. Wallace said he would not discuss personalities before an open group. He said this should be within closed sessions and since Mr. Mitchell directed his statement to him he requested knowing where were other Council members at the meeting with Mr. Mitchell and 9 other individuals. He reminded Mr. Mitchell of statements made, and stated it was up to each Council member to make his own decisions. He said he had made a decision and he would stick with it. Mr. Mit- chell said he had not asked other members of Council to be present at the meeting Mr. Wallace re~erred to. Janet Hall - Sea Mist Marina - Several months ago she said she had brought up the question o~ a building permit where at least two vio- lations had been made and Council asked ~or a report and since the -2- MINUTES RE~IAR CI%Sf COUNCIL APRIL 6, 1970 report is not on the agenda she wanted to know what had happened. ;¥3ayor said he had just received the report and he handed it to her to read~ requesting that she re~urn it to him because he had not had time to read it. i~rs. She alleged she owned lots 2 and 3. She was advised that it would cost about ~5. per foot. Mr. Hopkins agreed to check into a drainage ditch on the side of her property that she referred to. !'fo one spoke in favor or against the paving issue, l,fr. Wallace quested the issue be tabled because of inquiries he had received from those interested in the Catholic school~ because he felt they did not understand what this would mean to thei~ particular property. l~P. Federal Highg~y. ~ir. Tomberg¢ attOrney, represented Mr. Carbone and explained they de- si~ed to construct a high rise condominium next re residential area. He felt the City would receive more money in taxes because the cheapest apartment would be ~22~500, and they hoped to build 200 units. ~.~r. Leyrer wanted to know why the Planning 3card had voted against the request. He was advised by Mrs. Jackson the minutes are a public re cord · Hr. Aiken spoke in favor of the request. kit. Lorry o~ Lee ~'fanor Isle spoke against the request and referred to a petition which property owners made sometime ago and reminded Council this is the 5th time ~r. Carbone has tried to get the zoning changed. He felt this zoning request would open the area to all kinds of unde- sirable activities and no longer will be desirable for a nice water- front home. a.~. 3scker stated I~r. Carbone had come into his home and said he was going to build a beautiful home~ and the residents were very pleased, and now he wants to congest the area with 300 or 400 automobiles. -3- MI?dTES REGULAR CITY COL~CIL ~.EE~I~ ~ APRIL 6, 19 70 Jim Worth spoke against the zoning. He said it appeared tO him people are just arguing back and forthXand it has gotten into personalities and he felt it should be condueted~n a more p~ocedural manner. He felt people would not want to invest in this area if he continually brings up requests for zoning this area such that it would be down- graded, lie requested that Council put a stop to this continual re- quest to downgrade thei~ property. 1,lrs. Jackson moved the request be rejected, seconded by Mr. Wallace and motion carried 3-1 with~..~r. '~ Nylund' voting ~no~ and Mr. l~ichael abs taining. Request of~ T. F. Flemin.q and Arthur Mills from Ri~A to M-1 (light in- dus try) The land in question is just north o~ Paddock and Reeves~ containing 55 acres. Hr. Michael inquired whether they ~uld be willing to deed 50' to City because eventually the City will have to get access to 20 acres o~ land for 8 recreational site. They called ~fr. Koch, Realtor, to podium and he felt it would be desirable to do so. It was revealed that the property is under a mortgage containing a 1000 aere tract and would be subject to release. No one objected to the zoning chan~e. Mr. Michael moved that the zoning request of Mr. Fleming and Mr. Mills be granted subject to the City receiving a deed as mentioned by our attorney of the 50~ for a bu~fe~ zone. This item left on the table. Mrs. Jackson indicated she would be unable to attend the ~sunlempat League meeting at West Palm Beach City [{all Friday. Mayor Summers said he would attend. Receipt of Annual Audit - on the table Mrs. Jackson moved that the Annual Audit be accepted, seconded by ~dr. Wallace and motion carried 5-0. Request of Mrs. Rita Zant for financial assis~a~c$ for TeenTovm This matter was referred t~ Recreational Director for the County: since the City would have no way of policing this area as it is ou~ of their jurisdiction. Mrs. Jackson said she would not be in favor o~ the City spending money to duplicate something in the Recreation Department, and moved the request be denied~ seconded by [ir. Wallace and motion carried 5-0. Mr. Michael said he would like to see recreational facilities kept open longer hours, particularly Sunday afternoons. l~r. [le~ request was that the entire depth of her property be zoned C-1 so she could utilize the building. The City Attorney was in- st~£ucted to read Ordinance 70-11. ~fr. l~[iehael moved that Ordinance 70-11 be passed on first readings seconded by ~{rs. Jackson and motion carried 5-0. Subject Ordinance also includes rezoning of the Fleming-i~fil t$ parcel. N~EW BHS II'~ESS Consider re_peal of O~dinance 68-19- providing for Planned Unit Deve topment l~r. ~iichael referred to Ordinance 68-19 providing for Planned ~nit Development. ~)asically this Ordinance allows the City Council to make exceptions. He felt some of the City's p~oblems were based on the fact the town is trying to develop a town with ho~se and buggy zoning. He said he believed ~r. ~{oore had indicated some of the problems were because of this Ordinance. He said he had spoken to developers of Leisureville and to their attorney and he felt they would agree that ~e need a different zoning ordinance allowing a develo~nent of this kind ~o come in and that many of the problems c~me about ~en Council is allowed to make special exceptions, lie felt new types of housing will be on the market to replace CBS homes. He felt that the City Planner has type of ordinances that will create proper zoning for developments to come in. ~r. i~ichaet moved that O~dinance 68-19 be repealed, seconded by ~rs. Jackson and ~r. Nylund stated he felt we should keep the ordin- ance we have. The motion carried 3-2. ~essrs. Nylund and Sun~ners voted ~r. ~,~ichael moved that the request to have Ordinances 69-16 and 68-24 repealed be stricken f~om the agenda. ~,fotion seconded by i-!%rs. Jack- son and motion carried 5-0. Jackson quoted from a 1968 memorandum from ~r. iioore to then City [~[anager which said that before anything more could be built a public hearing must be hold by 5he City Council, Mrs. Jaclcson £u~ther ~tated the Doard of Adjustment had turned down the request because there was no sprinkler system~ yet the ~uitding Dept. had ~ri~ten tm;o letters and she asked the City Attorney if it was on his advice that it was turned over to the Doard of Adjus~nent. She asked Mr. ~foore i~ he thought it was a!right that the City is going to be sued~ and she ~nted to know i~ action would be made by Duilding Department if this would be closed do%~n till they get certificate of occupancy, Unless the owner's attorney files for a hearing before the CirCUit Court a war~ant for his ammest %;ill be in order~ according to ~.fr..",.3arrett. It was felt that the owner's attorney will ask for experts to testify as to the requirements. Me said they would recommend to their client if sewage treatment and water supply could be ob- tained that they take this route. He inquired as to a date when the study will be completed regarding this area. City agreed to contact Russell ~ Axon to obtain the report. As you know, a very valuable employee has requested a transfer to an- other department because of the work load that we have had. I would like to take ~ few minutes of your time to give you some compara- tive information: : 1. Lake Worth has 9 employees and Delray Beach has 7 employees cov- ering the work in the City Clerk and tax collesting~ deparrments. 2. The postage for calendar year of 1969: City Manager $ 77.94 or average of 1S00 pieces of mail City Clerk 530.53 or average of 8842 pieces of mail Taxes and Licenses 532.46 or average of 8874 pieces of mail As you know~ increased population adds to many of the duties in this department~ such as registration~ dog licenses~ occupational licenses: etc. I will not endeavor to go into full details since I have gone over this request with Mr. Hopkins as you asked me to do, and you will note his signa- ture denoting approval on same. My ~eeommendations for s smoother operation 1. Increase the budget to allow the employment of 2 additional clerks 2. Grant Mrs. Clanton one additional step as Deputy City Clerk~ to eliminate overtime 3. Classify the position of Court Clerk as Clerk III For the balance of this fiscal year this would amount to approximately 55000. I trust you will give this request favorable consideration.
