15-003 1 ORDINANCE NO. 15- 2 3 4 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA 5 APPROVING AMENDMENTS TO THE MOBILE VENDING UNIT 6 REGULATIONS OF THE LAND DEVELOPMENT REGULATIONS, 7 CHAPTER 1, ARTICLE II ENTITLED "DEFINITIONS "; CHAPTER 8 2, ARTICLE II, SECTION 7C, ENTITLED "MOBILE VENDOR 9 APPROVAL "; CHAPTER 3, ARTICLE V, SECTION 10, ENTITLED 10 "MOBILE VENDOR REGULATIONS "; TABLE 2 -1 11 "APPLICATIONS BY CITY DEPARTMENTS "; AND, CHAPTER 3, 12 ARTICLE IV, SECTION 3, TABLE 3 -28 "USE MATRIX "; 13 PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN 14 EFFECTIVE DATE. 15 16 17 WHEREAS, at the August 29, 2014 Commission Strategic Planning meeting staff 18 was directed to modify the existing mobile vending unit regulations and return to the 19 Commission with recommended changes; and 20 WHEREAS, staff is recommending that Mobile Vending Assembly be moved to the 21 Special Event permit process to facilitate a more business friendly procedure for allowing 22 Food Truck Rallies and other similar events to take place in the City; and 23 WHEREAS, the City Commission finds it to be . in the best interest of the citizens and 24 residents of the City to approve the recommendations of staff and amend the Land 25 Development Regulations as reflected herein. 26 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 27 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 28 Section 1. The foregoing whereas clauses are true and correct and are now ratified 29 and confirmed by the City Commission. 30 Section 2. Chapter 1, Article II of the Land Development Regulations entitled 31 "Definitions" is hereby amended as follows: 32 1 2 Mobile Vendor Code Citations 3 4 Part III (LDR), Chapter 1, Article II 5 6 MOBILE VENDING UNIT (MVU) - Any movable cart, trailer, or other vehicle 7 that is operated from an established location, from which food, flowers, and other 8 merchandise and services, as well as non - alcoholic beverages are provided to the 9 public with or without charge; except, however, that the provisions of this ordinance 10 shall not apply to mobile caterers, or service providers, generally defined as a 11 person engaged in the business of transporting, in motor vehicles, food, beverages, 12 or service equipment to residential, business, and industrial establishments pursuant 13 to prearranged schedules, and dispensing from the vehicles the items or services at 14 retail, for the convenience of the personnel of such establishments. For the purposes 15 of implementing and interpreting the mobile vendor ordinance, the following 16 definitions shall apply: 17 18 ADULTERATED - The condition of a food that bears or contains any 19 poisonous or deleterious substance or has been processed, prepared, packed 20 or held under unsanitary conditions, whereby it may have become 21 contaminated with filth, in a quantity which may render it injurious to health. 22 23 APPROVED MANNER - Method of dealing with waste, solid or liquid, 24 which comports with adequate sanitation methods as established by the 25 Division of Hotels and Restaurants of the Florida Department of Business and 26 Professional Regulation. 27 28 APPROVED SOURCE — A licensed food processing establishment 29 considered satisfactory by the health director and serving food products 30 which are clean, wholesome, free from adulteration or misbranding and safe 31 for human consumption. 32 33 ASSEMBLY — A concentration of three (3) or more MVU's coordinated by 34 a single applicant intended to contribute to the vitality of publicly - accessible 35 spaces and community activities. Events of this type are subject to City 36 s. _ 37 over a fixed period of time required to obtain a Special Event Permit. 38 39 COMMISSARY - A food processing establishment or food service 40 establishment approved by the Division of Hotels and Restaurants of the 41 Florida Department of Business and Professional Regulation in which food, 42 containers or supplies are kept, handled, prepared, packaged or stored for 43 transportation by mobile vendors. 44 45 CORROSION RESISTANT MATERIAL - A material which maintains its 46 original surface characteristics under prolonged influence of food, cleaning 47 compounds, bactericidal solutions and other conditions -of -use environment. 48 1 EASILY CLEANABLE - Surfaces are readily accessible and made of such 2 material and finish and so fabricated that residue may be effectively removed 3 by normal cleaning methods. 4 5 FOOD - Any raw, cooked or processed edible substance, ice, beverage or 6 ingredient used or intended for use or for sale in whole or in part for human 7 consumption. 8 9 FOOD HANDLER - A person, certified by the Division of Hotels and 10 Restaurants of the Florida Department of Business and Professional 11 Regulation, engaged in the preparation, handling or vending of food. 12 13 FOOD VENDOR - Any person, group of persons, firm or corporation who 14 individually or by or through an agent or employer, offers for sale, sells, 15 attempts to sell, exposes for sale or gives away any food intended for human 16 consumption from any vehicle or by a person afoot. 17 18 LABEL — A display of any written, printed, or graphic matter upon the 19 immediate container, not including package liner, of any prepackaged article in 20 accordance with state law. 21 22 LIQUID WASTE - Fluid, resulting from wastes produced from food 23 vending operations, composed of solids, whether dissolved or in suspension; 24 liquids, whether in solution, in emulsion or in separate phases; and gases. The 25 term shall also include melted ice. 26 27 MERCHANDISE - Items of clothing, jewelry (including timepieces), 28 photos, artwork, housewares, flowers, plants, landscape materials, carpets, 29 phones and accessories, small appliances, medicines, personal care items, 30 books and /or magazines as well as audio or video recordings, tapes, discs or 31 other media. 32 33 MISLABELED AND MISBRANDED - The presence of any written, 34 printed or graphic matter upon or accompanying any food or container of food 35 which is false or misleading and which is not presented in the English 36 language as stipulated by the Food and Drug Act, Title 21, Chapter 1- 101.15 37 or which violates any applicable federal, state or local labeling requirements. 38 39 PERISHABLE FOOD - Food, including shelled eggs, of a type or in such 40 condition that it will become adulterated unless kept at a temperature which 41 will maintain product quality and wholesomeness. 42 43 PERMIT — A site specific license to operate a mobile vending unit which 44 shall be issued by the Planning and Zoning Division of the City's Department 45 of Development for a stated fee and shall be carried by a vendor or food 46 handler at all times while vending. 47 48 POTENTIALLY HAZARDOUS FOOD - Any food that consists in whole 49 or in part of milk or milk products, eggs, meat, poultry, fish, shellfish, edible 50 crustacea or other ingredients including synthetic ingredients, in a form 1 capable of supporting rapid and progressive growth of infectious or toxigenic 2 microorganisms. The term does not include clean, whole, uncracked, odor -free 3 shell eggs or foods which have a pH level of 4.5 or below or a water activity 4 (AW) value of 0.85 or less. 5 6 PUBLIC WAYS - Include all portions of public streets, alleys, sidewalks, 7 trails and parking lots of the City of Boynton Beach and, in addition, shall 8 include privately owned streets, roads, alleys, sidewalks, trails, and parking 9 lots that are provided for public use or access. 10 11 SAFE TEMPERATURES - As applied to potentially hazardous food, shall 12 mean temperatures of forty -five (45) degrees Fahrenheit (seven (7) degrees 13 Celsius) or below, or one hundred forty (140) degrees Fahrenheit (sixty (60) 14 degrees Celsius) or 15 above and zero degrees Fahrenheit (minus seventeen (17) degrees Celsius) or 16 below for frozen food storage. 17 18 SANITIZE - Effective bactericidal treatment of cleaned surfaces of 19 equipment and utensils by a process which has been approved by the 20 Division of Hotels and Restaurants of the Florida Department of Business 21 and Professional Regulation as being effective in destroying microorganisms 22 including pathogens. 23 24 SERVICES - Personal services to include portraits, body art, and hair 25 braiding; the cleaning and detailing of vehicles including automobiles, trucks, 26 vans, and motorcycles; and repairing household goods, tools, and equipment. 27 28 SINGLE SERVICE ARTICLES - Cups, containers, lids, closures, plates, 29 knives, forks, spoons, stirrers, paddles, straws, napkins, wrapping materials, 30 toothpicks and similar articles intended for one -time, one - person use and then 31 discarded. 32 33 STICKER A decal issued by the Planning and Zoning Division of the 34 . �. _ . _ • _ . .. • 35 unit. 36 37 UTENSIL - Any implement used in the storage, preparation, transportation 38 or serving of food. 39 40 VEHICLE - Every device in, upon, or by which any persons, food or other 41 commodity is or may be transported, pushed or drawn. 42 43 WHOLESOME - In sound condition, clean, free from adulteration and 44 otherwise suitable for use as human food. ig 1 3 Part III (LDR), Chapter 2, Article II, Section7.C. 4 5 C. Mobile Vendor Approval. 6 7 1. 8 General. 9 10 a. Purpose and Intent. The purpose and intent of this subsection 11 is to set forth well- defined application processes, review criteria, and 12 information to guide in the processing and review of mobile vending 13 units (MVU) submittals. 14 15 b. Applicability. This subsection is applicable to any MVU 16 proposed within the City in accordance with Chapter 3, Article V, 17 Section 10. It shall be unlawful for anyone to operate an MVU in the 18 City without first obtaining the necessary approvals as contained 19 herein. 20 21 Portable or mobile kitchens necessary to provide temporary food 22 services in connection with permitted construction work are not 23 subject to the removal requirement or size restrictions. Such temporary 24 units must be removed immediately upon completion of work. 25 26 2. Submittal Requirements. See Section 1.D above for the submittal 27 requirements of this application. Because of minimum separation 28 requirements between each MVU, in those instances when more than one (1) 29 application has been submitted for the same location, the earliest application 30 shall be processed and forwarded to either the Planning and Development 31 Board or the Community Redevelopment Agency, whichever is applicable. 32 33 3. Review Criteria. The MVU shall comply with the regulations and 34 requirements of Chapter 3, Article V, Section 10. Site constraints and site 35 plan functionality shall be satisfactorily addressed to justify the request. 36 37 4. Approval Process. Staff shall review the proposed location and 38 dimensions of each MVU to ensure compliance with the review criteria 39 contained herein, and provide a recommendation. 1 f the a p p l i c at i on 40 - A R - , e application is forwarded to the City 41 Commission. who shall take the following action: 1) approve; 2) approve with 42 eon- • - or defer their decision to a subsequw- -- - , . • 43 - -- - - - - • 44 request-for an asser t { 4V- Once an individual or assembly MVU 45 application is approved, a permit fee shall be paid by the applicant, and 46 Business Tax Receipt or Certificate of Use received, prior to the operation of 47 the MVU. 48 49 5. Expiration. Each approval for an MVU shall be effective for one (1) 50 year, from October 1 until September 30, subject to annual renewal. 1 Assembly permits are is&ied on a quarterly basis, subject to City 2 Commission conditions subject to the Special Event Permit regulations. 3 4 6. Fees. The annual renewal fees for an MVU shall be paid to the 5 Business Tax Division in accordance with the fee schedule as adopted by the 6 City. Assembly permits arc paid per quarter, subject to City Commission 7 conditions. 8 9 7. Suspension. Approval of an MVU or Assembly permit may be 10 temporarily suspended by the City under the following circumstances: 1) when 11 necessary to clear sidewalk areas for a "community or special event" 12 authorized by the City; 2) when street, sidewalk, or utility repairs necessitate 13 such action; or 3) when the City may cause the immediate removal or 14 relocation of all or parts of the MVU or assembly in emergency situations. 15 16 8. Denial or Revocation. The Building Board of Adjustment and 17 Appeal City Magistrate, for Business Tax Receipt and Certificate of Use, erhe 18 City Commission, for Assembly permits, shall have the power and authority to 19 deny or revoke the issuance or renewal of any application for MVU or 20 Assembly under the provisions of these regulations. In such instances, the 21 applicant shall be notified in writing of the denial of an application or the 22 suspension or revocation of an existing approval, and the grounds thereof 23 Upon such notification, the operation shall cease and desist until final action 24 I or outcome of the Board or City Comm issionMagistrate. An application 25 approved under these regulations may be recommended for suspension or 26 revocation by staff, based on one (1) or more of the following: 27 28 a. Florida Department of Business and Professional 29 Regulation. 30 Cancellation of the Vendor's permit issued by the Division of 31 Hotels and Restaurants of the Florida Department of Business and 32 Professional Regulation. 33 34 b. Expiration. Expiration, suspension, revocation or 35 cancellation of any other business tax receipt, Certificate of Use or 36 permit required by the vendor. 37 38 c. Fraud. The permit was procured by fraud or false 39 representation of fact. 40 41 d. Consent. The abutting property owner or tenant 42 withdraws consent, in writing, for the mobile vending unit. 43 44 e. Violations. Violations of this or any other ordinance, the 45 City's municipal code, conditions of permit, or when conditions exist 46 that present a threat to the public health, safety, or welfare. 47 48 f. Miscellaneous. If determined to be noncompliant 49 with the review criteria contained herein or otherwise inconsistent 50 with the original approval, or changing conditions warrant the 1 I removal of the unit from the public right of way site 2 3 9. Appeal. Applicants who have been denied a request for an 4 MVU or assembly permit or who have had their approval revoked may 5 formally appeal such denial or revocation to the City Commission in accordance with Chapter 1, Article VIII. 8 9 Part III (LDR), Chapter 3, Article V, Section 10. 12 13 Section 10. Mobile Vendor 14 Regulations. 15 16 A. Purpose and Intent. The purpose of this section is to provide 17 for the regulation of mobile vending activities, including Assembly, on 18 public and private property, in certain commercial and mixed -use zoning 19 districts of the City in order to promote the public interest by contributing to an 20 active and attractive pedestrian environment. In recognition thereof, 21 reasonable regulation of mobile vending is necessary to protect the public 22 health, safety, and welfare and the interests of the City in the primary use of 23 public streets, sidewalks, and parking areas, for use by vehicular and 24 pedestrian traffic. 25 26 B. Definitions. See Chapter 1, Article II for specific definitions 27 applicable to 28 Mobile Vending Units 29 (MVU). 30 31 C. Approval Required. It shall be unlawful for any 32 establishment or organization to engage in or carry on the business of 33 vending food, goods, or services, upon public or private property or the 34 public ways of in the City without first having secured a permit or permits as 35 required by this section. See Chapter 2, Article II, Section 7.0 for the 36 process and procedure to obtain approval for an MVU. 37 38 It is not the intent of these regulations to be applied to mobile vendors 39 temporarily approved in conjunction with a special sales event or Special 40 Event Permit. See Section 6 above for additional regulations regarding 41 Special Sales Events. 42 43 D. Districts. The operating area of an MVU shall be entirely located 44 in the following zoning districts: C -1, C -2, C -3, C -4, CBD, PCD, SMU, 45 MU -L1, MU -L2, MU- L3, MU -H, M -1, PU, REC, PUD, and PID 46 47 E. Compatibility. The use of an MVU shall be compatible with the 48 public interest. In making such a determination, staff shall consider the 49 type and intensity of use, the width of thet, ik pedestrian walkways, the 50 width and type of right of way drive isles; location of fire lanes; fire 51 hydrants; distance from intersections and major driveways; the proximity 1 and location of existing street furniture, including but not limited to traffic 2 control devices, signposts, lampposts, parking meters, benches, phone kiosks, 3 mailboxes, fire hydrants, landscaping, trees, buffer yards, public art and 4 refuse containers, as well as the presence of truck loading zones. Staff shall 5 also consider established and emerging pedestrian and vehicular traffic 6 patterns, as well as other factors it deems relevant in determining whether or 7 not the proposed use would diminish required parking or result in congestion 8 of the public and private ways, on -site traffic circulation patterns, or the creation 9 of a safety hazard. 10 11 F. Location Criteria. An MVU shall be permitted to operate 12 throughout the City in approved zoning districts once a Business Tax Receipt 13 or Certificate of Use has been issued; utility service connections are only 14 permitted once an approved Building permit has been issued. In addition, an 15 MVU must comply with the following location criteria, whichever is 16 applicable: 17 18 1. Public Property and-Rights-of-Way. An MVU, 19 located on public property or within a right of way, shall comply 20 with the following requirements: 21 22 a. Maximum Area. An MVU shall not occupy an 23 I operating area of more than 34-0- four - hundred - twenty (420) square 24 feet of space, including the unit, operator, trash receptacle, 25 signage, merchandise, and covering, if applicable, per ene -half 26 (0.5) acre site. A single entity may request approval for more 27 than one (1) MVU per every one half (0.5) acre of -site. 28 29 b. Maximum Dimensions. An MVU shall not exceed 30 I ten (10) feet in width by twe forty (40) feet in 31 length 32 33 c. Maximum Height. The maximum height of an 34 MVU, including any covering, such as its canopy, umbrella, 35 and / or transparent enclosure, shall not exceed fifteen (15) 36 feet, excluding venting equipment, 37 38 d. Sidewalks. An MVU vendor located on a public 39 sidewalk shall not: 40 41 (1) Vend at any location where the sidewalk is less 42 than 43 10 feet in 44 width; 45 46 (2) Vend within 20 feet of an entrance to any 47 building, bus stop sign, driveway, stop sign, or cross 48 walk of any intersection; and 49 50 (3) Obstruct the view of any directional sign, 1 traffic control sign, or device. 2 3 2. Private Property. An MVU is allowed on private 4 property, provided that it complies with the following regulations 5 6 a.. Class "A" MVU. An MVU is considered "Class 7 `A ' if it is less than seven (7) feet in height, including its 8 canopy, umbrella, and / or transparent enclosure and if the 9 operating area is seventy -two (72) square feet or less, 10 including the unit, operator, and trash receptacle. This class 11 includes carts and small trailers. 12 13 A Class "A" MVU may be placed within off - street parking 14 spaces but shall be restricted to excess parking spaces only. It 15 shall not obstruct or impede critical vehicular use 16 movements or otherwise create a hazard. 17 18 b. Class "B" MVU. An MVU is considered "Class 19 `B "' if it is either greater than seven (7) feet in height or in 20 excess of seventy -two (72) square feet in operating area, or 21 both. This class includes carts, trailers and vehicles in excess 22 of the size limitations of a Class "A" MVU 23 24 A Class `B" MVU shall be allowed on all sites greater than 25 one -half (0.5) acre in size. No more than one (1) MVU per 26 one -half (0.5) acre shall be permitted. 27 28 Both Class "A" and `B" MVU's are allowed on improved 29 property only, and if placed within walkways or right -of- 30 ways, shall not obstruct or impede pedestrian movement or 31 cause noncompliance with ADA accessible route 32 requirements. A minimum clear passage of four (4) -feet 33 must be maintained for pedestrian travel at all times. 34 35 G. Removal. Each MVU shall be removed daily. An MVU shall not 36 remain on any public or private property, or within any rights -of -way between 37 the hours of midnight and 6:00 AM. 38 39 H. Maintenance. The mobile vending unit, including any 40 canopies, umbrellas, or transparent enclosures, must be clean, and well 41 maintained. The vending site itself must also be clean and orderly at all 42 times, and the vendor must provide a refuse container for use by his patrons. 43 The container shall be removed after the unit has departed for the day. 44 Vendor wastes of any kind shall not be deposited or permitted to be 45 deposited upon the ground, sidewalk, streets, city waste receptacles, or private 46 dumpsters. 47 48 49 50 51 1 I. 2 Separation. 3 4 1. Between Units. An MVU shall not be placed within 100 5 feet from another MVU of a different vendor for which a permit had 6 been granted unless requested as a condition of permit. 7 8 2. From Selected Land 9 Uses. 10 11 a. An MVU shall not be placed within 200 100 feet 12 from the property line of any single- family residential zoning 13 district. 14 15 b. An MVU shall not be placed within 150— 100 feet 16 from the property line of any establishment that sells or 17 provides similar foods, merchandise, or services as that of the 18 MVU without the prior written consent of the similar 19 establishment. 20 21 J. 22 Display. 23 24 1. Display of Permit and License. All vendors must 25 display the permit issued by the City in a prominent and visible 26 manner. In addition, an MVU capable of operating within public 27 rights -of -way shall display a current Florida Department of Highway 28 Safety & Motor Vehicles (DHSMV) license plate. 29 30 2. Display of Merchandise. No merchandise shall be 31 displayed using street structures (planters, trees, trash containers, 32 signposts, etc.) or placed upon the sidewalk or right -of -way. 33 Merchandise may be displayed outside the MVU on private property 34 with the written permission of the Property Owner provided that it 35 does not intrude upon the accessible area around the unit, or 36 otherwise impede parking or access to structures within the site. 37 38 K. Emergencies. Vendors shall obey any lawful order from a 39 police or fire department official during an emergency or to avoid congestion or 40 obstruction of the sidewalk. 41 42 1 L. 2 Prohibitions. 3 4 1. Solicitations. An MVU approved and located within a right - 5 of -way shall not solicit or conduct business with persons in motor 6 - vehicles. 7 8 2. Advertisements. Vendors shall not make loud noises, use 9 mechanical audio, noise - making devices, moving objects, or lighting 10 systems to advertise his or her product. 11 12 3. Unattended. No MVU shall be left 13 unattended. 14 15 4. 16 Miscellaneous. 17 18 a. Vendors shall not hinder or impede the use of any 19 phone kiosk, mailbox, parking meter, fire alarm, fire hydrant, 20 or traffic control device. 21 22 b. No tables, chairs, or umbrellas are to be set up for 23 use by customers, with the exception for those located on 24 private properties and utilized in connection with a Class "B" 25 MVU. 26 27 c. Freestanding signs, flags, banners, tents, tarpaulins, 28 canopies, or awnings shall be allowed in connection with an 29 MVU as a condition of permit. All signs, flags, banners, tents, 30 tarpaulins, canopies, or awnings shall be either attached to, 31 centered over, resting against the vending vehicle / 32 equipment, or located within a designated area from the 33 MVU based on permit condition.- in accordance with the 34 requirements of Land Development Regulations Chapter 3, 35 Article V, Section 10.M.2 b 36 37 d. Live entertainment, defined as performances, shows or 38 other forms of entertainment consisting of one (1) or more persons, 39 amplified or non - amplified music or other related sounds or noise, 40 including but not limited to entertainment provided by musicians, 41 disc jockey (DJ), master of ceremonies (MC), or karaoke shall not 42 exceed sixty (60) decibels at a distance of one - hundred (100) feet 4 43 3 1 from the source as measured by a sound level meter. 45 e. MVU's utilizing portable generators shall not exceed 46 sixty (60) decibels at a distance of one - hundred (100) feet 47 from the source as measured by a sound level meter. 48 49 M. 1. AUTO /CAR WASH (POLISHING, WAXING, 50 DETAILING). An AUTO /CAR WASH (POLISHING, WAXING, 51 DETAILING) type of MVU shall not be allowed on public property or within 1 any right -of -way. This type of MVU is only allowed on private property and 2 shall comply with the location criteria of paragraph "F" above. One (1) 3 freestanding canopy may be allowed for this type of MVU in addition to 4 another canopy that is either attached to, centered over, or resting against the 5 vending vehicle or equipment. In all instances, the size of the freestanding 6 canopy shall be the minimum necessary to accommodate one (1) parked 7 vehicle, but not to exceed 20 feet in width by 20 feet in length, and must be 8 removed daily. 9 10 11 Section 5.
