PUBLIC AUDIENCE
Jim Patterson from Recreation Dept. and Christine Gain~ord requested per-
mission to hold a kids fun day: May 8th. City Manager recommended this

Robert Beyrer expressed his thanks to Mayor Gallo and Mr. Coumtney for
their efforts in making this a progressive city and doing a terrific
job.
Julian PatTick: 327 S .W. 3rd Avenue requested that the lights at S.W. 15
and S.W. 23rd intersection be checked because they are not functioning
p~operly, and he feels it is very important to have these lights in
working omder as soon as possible.

Mr. Nylund advised that the Planning and Zoning Board recommended appro-
val, therefore, he moved to accept their reco~nendation. Motion sec-
onded by ~. Summers and motion carried 3-1; Mr. Michael voted No and
Mr. Collins abstained.

On request of Caldos for release of belance of bend for Sec. I, the
City Manager advised there are small items which need to be taken care
of. Mr. Michael moved the request be denied until these items have
been cleared up. Motion seconded by Mr. Summers and motion carried
4-0; N~. Collins ahstained. ~. Courtney was requested to give Ca!dos
a letter advising what has to be done to get funds released.

City Manager requested replacement of resusitator at beach and about
$200. lacking for traffic light needed from contingency fund,
[ir. Michael moved that the amendment to budget as outlined above by
Mr. Courtney be granted. Motion seconded by Mr. Summers and motion
carried 5-0.
Conside. r request for abatement of ~ax~s
Mr. Michael moved that the request to abate taxes for Chester Anderson,
Deceased for 1968 in the amount of $8.80; and Guy Earle, Inc. for 1968
in the amoo/%t of $10.56 be granted as outlined. Motion seconded by
Mr. Summers and motion carried 5-0.

~/~. Michael moved that the list of payments made in November be accepted
as presented. Motion seconded by Mr. Summers and motion carried 5-0.
Approval of Biltg.
Mr. Summers moved that bills be paid as presented to Meter Supply Co.
Mr. Michael seconded the motion which carried 5~0.
In regard to Chamber of Commerce bill dated Dec. 12 in amount of $1049.18
Mr. Nylund moved the bill be paid~ motion seconded by Mr. Summers and
motion carried 5-0.
City Attorney, Gene Moore commented briefly on 8800:000 bond issue, 30
day appeal period, and stated Mr. Shepard formulated a formal proposal
to city~ also General Dynamics have presented a formal request. He
read letter from them. He then read proposed Ordinance 70-1 as ordinance
of intent to annex, Motion by Mr. Michael that Ordinance 70-1 be passed
on first reading. Seconded by Mr. Summers and motion carried 5-0.
Mr. Court-ney advised that city is in a bind on force main coming from
Golf View Harbor. City needs easement to get along E-4 canal. He re-
quested permission to negotiate with Drainage District to put a line
down abng E-4 canal. Mr. Michael moved that P~. Courtney be allowed,
if he sees it is in the best interest of City to reroute the force main
for Golf View Harbor. Motion seconded by Mr. Summers and motion carried
5-0.
Reference to bill of Executone. Mm. Gallo asked if the audience could
hear everyone and it w~s revealed they could not; therefore~ the bill
will not be paid till the system works efficiently.
Mr. Michael moved that resignation of Bill Allan, Purchasing Agent be
accepted effective January 9: t970. Motion seconded by Mm. Nylund and
motion carried 5-0.

Mayor Gallo presented plaques to Vice ~yom Thomas A. Surmne~s, Gilbemt H.
Collins: Michael V. Michael and Leonard E. Nylund, Mayor Gallo was given
plaque by Vice Mayor Summers.
Mayor Gallo said he ended up with two plaques ~ one being an ulcer. He
stated it had been a pleasure and an education. He regretted that he
did not get an additional two years to accomplish the goals he had set
and he hopes the future council ~rill proceed for the betterment and
progress of Boynton Beach.
M~. Collins said he had been privileged to serve on council and expressed
appreciation to people for the confidence they have sho~a~ in him. He
thanked co-council that worked with him and extended best wishes ~o new
council.

~.i~s. Jackson thanked the people for the g~eat honor of being elected to
City Council. She said she was a servant of the voters and you people
are the bosses. Because she has been on the other side of the mike she
said she ~uld understand the people's views: and if she did not know
the answers she would attempt to find the answers. She said she vaDuld
not evade questions: will be polite and honest with the people. She
quoted 3 guides used by Hon. B~uce Alger and added two of her o~ as
follows: (1) Is it constitutional? (2) is it necessary? (~) Can
we afford i~? (4) Does it abide by state tavm? (5) Does it abide
by City Charter and City Ordinance? With this as her guide and with
God's help she promised to try - very~ very ha~d to be a good servant of
the people.

¥~. Michael %~uld like to wish old council members best of luck and the
same to new eounei!man and councilwoman taking office.
Mr. Wallace thanked the people for being t~uly blessed by citizens of
Boynton Beach. He said a great number he did not know voted and va3rked
for him. Me especially thanked Terry Seely who walked miles with him
reaching the people. He sincerely hoped the decisions and policies
reached will make this a better community and that the area will grow
not only for pmesent but future generations to be extremely proud.
9~. Nylund said he had been privileged to serve the past thmee years
under p~ogressive leadership of Mayor Gallo. He Stated decisions he
made ~re made fora the benefit of the majority of the Boynton Beach
residents. He stated he ~a)uld continue to vote only his convictions.
Mayor Summers we have made decisions in the past and many p~ohlmms canTt
be solved all at one time. Theme is a lot of ~a)rk to be done so l~t's
be on with the %~rk at hand.
Resignation of City Manager - Grady Courtney
I~yor Summers read a lettem of resignation from City k~nager Grady
Courntey, to be effective Januamy 31~ 19707 or as soon thereaftem as an
ordemly t~ansition can be made. He felt the newly elected individuals
have a right to surmound themselves with people they have com~idence in.
Mrs. Jackson moved the lettem of resignation be accepted and wished
~. Courtney Godspeed whereve~ he goes. Mm. Wallace seconded the motion
v~ich carmied 3-2. Mm. Nylund and Mr. Summers voted No.

Mr. Michael moved that the City adopt tha Revised Roberts ~qules of O~der
for Council; seconded by Mms. Jacl~on and motion camried 5-0.
Appointment of City Officials..

M~s. Jackson nominated Ronald Fruda for City Attorney. Mr. Michael mead
a letter on behalf of the nominee. Motion died for lack of second.
~. Nylund moved that Gene Moore be reappointed as City Attorney. Mo-

seconded the motion which carried 5-0, Judge Durkin asked that in view
of the untimely death of his wife that he be permitted time to get his
affairs arranged and that an Ad .Litem serve in his stead during this
time,
Hr. Michael moved that ~r. Simon be reappointed Judge ad Litem. Motion
seconded by ~$. JaeP~on, In the interim it %-~as suggested by Mrs.
Jackson that we have an additional Judge ad Litem appointed and suggest-
ed Richard Sorgini. ~,~. Michael accepted this amendment and the motion
carried 5-0.
Mr. Michael moved that the appointment of Prosecuting Attorney be tabled~
seconded by Mrs. Jackson and motion carried 5-0.
~yor Summers requested that the city retain all Department Heads. Mr.
Nylund moved they follow Mayor Summers recommendation; seconded by Mrs.
Jackson. ~. Wallace asked if any were on pro~ation and was advised
that one was still on probationary basis. Motion carried 5-0.
City Manager recommended that Purchasing Agent and Personnel Director
be combined to save money since %~ no longer have need for tax assessor.

Appointment of Boards & Committee members
Mr. Wallace moved that the boards be accepted and if there is a question:
that they be stricken at the time they are mead and filled in at a

Mr. Wallace stated that what has been done by Ordinance can be changed
~ ordir~nee~ therefore he submitted Ordinance 70-2 which will alle-
viate any problems and do a%~y with the Planning and Zoning Board as
such. The City will have a Planning and a Zoning Board. This is_ the
interpretation of the law as presented by the City Attorney~ Gene Moore.

l:~s. Jackson moved that Ordinance 70-2 be adopted on first reading.
Seconded by Mr. Michael.
~. Nytund felt we should wait for advice f~om Attorney General.
Mr. Wallace stated the City Attorney had advised him that according
to charter~ three members of council can make this change, He said no
decision as far as the Attorney General will be forthcomin~ because of
his inte~pre~ation~ this is the law. He reiterated - you have abided
by ~. ~,'Ioore's advice for tw~ years now why do you say his advice is
not valid now?
~,~. Nylund stated that Attorney General~s opinion was very important
several months ago but not now - why?
5~. Michael - the reason you will not get an opinion (1) the City
Attorney will have to ask for it and I don~t think he would ask for an
opinion in a matter which pertains to an ordinance and that is accord-
ing to our charter.
The motion carried 3-2 to approve Ordinance 70-2 on 1st reading. Mr.
Nylund and [~yor Summers voted No. P~. Michae!, Mr. Wallace and l~s.
Jackson Aye.
It was determined that the Planning Board ~uld serve as zoning commis-
sion until sucJ% time as O~dinance 70-2 becomes effective.
~rs. Jackson moved that the Boards be adopted as read and that council
add to them at later date where names have been ~ossed out because of
residence and voting requirements. Motion seconded by M~. Michael
and motion carried 4-1. ~r. Nylund ~oted No.
Eddie Mitchell requested a co~py of the boards be made available to his
organization - Concerned Black Citizens.
Discuss agenda format and .p~ocedure.
P~yor Summers feels that if an item is important enough to get on
agenda it should be in by Wednesday and not add a lot of items unde~

Mr. Michael moved that the £o~mat of agenda remain status quo with
exception that any items placed under subject of ~other~ require 4-5
vote of council before they can be acted on by council. Motion sec-

M~. Wallace stated that since December 2nd a number of things have come
up and the best way to find the ansv~r, I feel~ is to see the people

that have the problems. I have visited Leisureviile. Some are bmppy
and some are not. There are legal proceedings being brought up in the
courts. I want to see a public hearing held with tlne governin~ body
of Le/sureville and representatives of Caldos and with the residente~
and the City Counoil to see if~ the city is involved in 'any te~al en-
tanglements ·
I am bringing this up because of some problems that have been brought
up that have not been taken care of. Have they been given the ~ull
benefit of the dollar is %~hat I want to know? I~ this is cleared up
then ~ can live together harmoniously. If we have any obligation at
least it will be cleared up. These people are residents of the City
of Boynton Beach - we owe them something and i think we should try to
help them solve these problems. On other hand, it should he brought
to head one %~y or another.
I am asking for a public hearing be~en governing body of Leisureville
and City and ask that a letter be sent to all residents of Leisureville
and Caldos Developers. I'4otion seconded by Mrs. Jackson and motion
carried 4-1. }~. Nylund voted No.
Mayor Summers stated that he ~s fully aware of what was going on and
the %~rkmanship on some of these homes is not adequate.
2,~. Michael moved that meeting be held January 26, 1970 at 7:50 P.M.
in City Hall as public hearing regarding Leisurevi!le. Motion seconded
by Mr. Wallace and motion carz~ied 5-0.

Request for Department Head meeting prior to
Council Meeting. ,
Mr. Michael moved that council meet with department heads prior to
regular meetings until they decide to do otherwise - at least for first
meeting. Motion seconded by ~s. Jaekson and motion carried 5-0.
Reconsider Ordinance 69-43 (Sign Regulations)
Mr. Layton Timm, 118 S .E. 8th Avenue appeared before council request-
ing information as to what ordinance the city is under at present
time ·
Mr. Miehaet moved that the City Attorney be instructed to draw up sign
ordinance in similar fashion to one in use in Boca Raton and City
Clerk make available copies ~or those in the sign business so they can
make recommendations to council. Motion seconded by Mrs. Jackson and
motion carried 3-2. Nr. Nylund and ~yor Summers voted No.
~4rs. Jackson requested that the signs on the Little League field be
exempt, k-~. Michael seconded the motion and motion carried 5-0.

and that her recommendations be followed as outlined. Motion seconded
by l~rs, Jackson and motion carried 3-2. ~. Nytund and 1;myor Summers
voted Mo. ~,ir. Ny!und questioned why when the memo was dated Dec. 8th
he did not receive his copy untilagenda books were delivered.
Mr, Michael explained that this was held to he placed on the agenda of
January 5th at his request,
~irs. Jackson requested that hoards not hold meetings on Monday night.
Also she asked what was going to be done witch recall petition and re-
quested it be placed on agenda and ruled on.

Mr. Barry said he would have to withdraw bid on garbage equipment.
Discuss proposed purchase of beach property
(Placed on New .Busine, ss it.e, ms.- this ,,meeting)
Mayor Summers requested permission to arrange meeting with Ocean Ridge
to discuss beach property. ~ir. Wallace said he was not willing to go
through months and months of meetings with Ocean Ridge. After that first
meeting if a decision is not reached then we should go our own way.
~. Michael moved to set up meeting with Ocean Ridge to discuss beach
property within t~o weeks. Motion seconded by Mrs. Jackson and motion
carried 5-0.
OTHER
Mr. Michael moved that the City b~nager be authorized to take whatever
steps are necessary to keep sanitation department going. Motion sec-
