Minutes 11-17-69MINUTES OF REGULAR I~ETING OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, HELD AT CITY H~LL, ~iONDAY, NOVEMBER 17, 1969. PRESENT: Vincent J. Gallo., Sr.:, Mayor Thomas A. Summers, Vice Mayor Gilbert H. Collins, Councilman Michael V. Michael, Councilman Leonard E. Nylund, Councilman Gene Moore, City Attorney Grady W. Courtney, City MgT. Tereesa Padgett, City Clerk The m~eting was called to order by Mayor Gallo at 7:50 P.M. Invocation was given by City Mammger and Flag Salute was led by City Attorney Gene Moore. Janet Hall ~ms recognized as representing the Soroptimist Club. Ymyor Gallo recognized council candidates who were present: Emily Jackson, Formest Wallace and Velma Earley. ~yor Gallo announced that the City Pr/mary will be held November 18th. Polls open 7:00 A.M. to 7:00 P.M. MINUTES - REGULAR ~ETING NOVEMBER 3~ 1969 Mm. Michael moved that Minutes oC November 3rd meeting be approved as presented~ seconded by Mr. Summers and motion ca,tied 5-0. PUBLIC AUDIENCE Albert Wehmetl, Boynton Isles - retaliated in ~esponse to previous comments that he was a '~flag waver." He said it is the curmen~ fashion to criticize the military with slu~s and smears. He felt it is about time someone does a little flag waving. He said he began his military career at $30. a month as a p=ivate and worked up to Colonel some 30 years later. During those years he said he had indeed ~ved the flag and is p~oud of it. Harry LeForte~ Coquina Cove~ asked for a copy of the new sign 'ordinance. He was advised that there was no new ordinance, as yet.., Ezell Hester: 1106 N.W. 1st St. - inquimed of Mr. Summers why he had been reported as saying meetings v~uld be held at 9:00 A.M. after Jan. 1st. ~. Summers replied that they would be closer TO the public records during workLng houTs and many items would not have to be tabled and held over. Mr. Hester replied that the city is not totally filled with retired people as yet, and he hoped that the working class of people would be given more consideration, that he and many others have to work ~or a living. He said he would appre- ciate it if the young ladies were not treated in th/s mannem, Courtney said he was present and he Pdlew this did not occur. BIDS - AWARDIN~ One.'.Passenge~ Elevator - Reference to elevator bid indicated that the tabulating commit~cee recommended the bid be thrown out. Mr. Summers moved the bid for elevator be denied. Motion seconded by Mr. Michael and motion carried. 5-0. LEGAL - ORDIh~NCES - 2nd READING Ordinance No. 69-34 - Anti Noise - Mr. Moore was requested to read the Anti-Noise O~dinance in its entirety since they could not hear it when it was read last time. Mr. Summers moved that Ord/nanee No. 69-34 be passed on second reading. Motion seconded by ~. Collins and motion carried 5-2. M~. Nylund and }~ir. Michael voted Ordinanee No. 69-58 - Bus Service - M=. ~ore read Ordinance No. 69-38 re bus service, Mr. Summers moved that O~dinance No. 69-38 be passed on second reading. Motion seconded by ~. Collins and motion carried 5-0. ORDINANCES - ist READING .O~dinance No. 69-39 - ContTol of Cats - ance No. 69-39 regarding control of cats M~. Collins and motion carried 5-0. H~. Nylund moved that Ordin- be tabled.. Motion seconded by _OTHER Mr. P~oore made reference to a request by Mr. %'~rrell regarding dedica- tion of road. He suggested that copies be made of plat and acceptance be in the form of a deed at the next regular meeting. ~ontract for garbage & Trash - deferred till next regular meeting. Motion by Mr. Nylund; seconded by P~. Summers and motion carried 5-0. OLD B~SINESS ~equest for change in zoning - Caldos Mr. Nytund moved that the requests for Caldos for zoning be removed -2- REGULAR CITY COUNCIL ['~fEETLNG NOVEMBER 17 ~ 1969 f~om table. Seconded by [~r, Summers and motion carried 5-0. Mr. Nylund moved that Planning & Zoning Board's recommendation be accepted to approve the request for Parcel 1 from R-iAA to R-3A. Motion seconded by ~.fr. Summers and motion carried 3-1. Mr. Michael voted No and ~. Collins abstained. City Attorney read Ordinance 69-40 rezoning Parcel i. Mr. Nylund moved that Ordinance 69-40 regarding zoning change from R-1AA to R-3A be passed on first reading. ~otion seconded by Mr, Summers and motion carried 3-1. ~ir, Michael voted No and Mr. Collins abstained. Mr. Nytund moved that council accept the Decommendation of the Planning and Zoning Boe~d on request of Caldos to change zoning of Parcel 2 from R-3A to C-1. Motion carried 3-1; I~. Michael voted No and ~r. Collins abs tained. City Attorney read' Ordinance No. 69-41 covering Parcel 2. M~. Nylund moved that Ordinance No. 69-41 be passed on first reading. Motion seconded by Mr. Summers and motion carried 3-1. Mr. Michael voted No and Mr. Collins abstained. Consider contractual agreemen~ with Dept. of Transportation re Traffic Light U.S. ~i~t at N,E. 2nd Rye. (On the table) Mr. Michael moved that the request for contractual agreement with Dept, of Transportation re Traffic Light at U.S.[~I and N.E. 2nd Avenue be removed from table. Motion seconded by M~. Summers. P[otion carried 5-0, Mr. Michael moved that council follow reeommendation of City Manager to approve the installation of traffic light at U.S.~i and 2nd Avenue, provided the City Attorney approved. Motion seconded by Mr. Summers and motion carried 5-0. Consider release of Bond~ Section I, Leisurevil!e Mr. Michael moved that the release of Bond for Section 1~ Leisureviile be removed from table, seconded by ~. Summers and motion carried 5-0. Mr. Michael moved that their bond be released with the exception of $10,000, until the problems outlined by Mr. Courtney a~e satisfactory. Motion seconded by ~. Summers and motion carried 4-0. Mr. Collins abstained. Reconsider Resolution 69-T re Lake Worth Bridge over the intracoastal waterway. Mr. Summers moved' that the City amend Resolution 69-T changing height -3- C MINUTES PGEGULAR CITY COLhNCIL ~ETING NOVEMBER 17~ 1969 from 30 feet to 35 feet as it pertains to Lake Worth Bridge over Intra- coastal Waterway. Motion carried 4-1. ~i~. Michael voted No. NE, W BUSIneSS k~fr. ll_~ichael read a letter from Henry J. Robinsky in regard to approval of House Bill ~/3t72 regardin~ Tax Assessment~ and advised that House Bill ~;-3t64 regarding sales tax exemption for municipalities was defeated in the Committee. 1,~yor Gallo reported on an organizational meeting of Palm Beach County Municipal League. He advised they had adopted their charter and elected office~s, AD~4INISTRBTIVE Consider request of Lion's Club to sell Christmas T~ees .December 12th thru 25th Mr. Michael moved that the Lion's Club be issued a permit (No charge) to sell Ctu~istmas trees December !2th thru Dec. 25th. Motion seconded by tvh2. Sun%mots and motion carried 5-0. Consider request for abatement of 1969 taxes. On the memorand~ ~rom City Clerk for approval to abate taxes~ Mr. Michael moved that the abatements as outlined by ~s. Padgett be allowed. Motion seconded by Mr. S%unmers and motion carried 5-0. 1. Motion seconded by Mr. Sununers and motion carried 5-0. Consider application for Beverage License - 710 N.Fed .Hwy. Mr. Michael moved that the request of Chris McGuire for a beverage license at 710 N. Fed. Hwy be granted subject to requirements being filled. Motion seconded by Mr. Nylund and motion carried 5-0. Discuss plans for annual board d/nner. Fins. Padgett and F~. Michael instructed to check into prices and loca- tion for annual beard dinner. It was felt that individual certificates should be presented to those that have served but not during the meet- ing · OTHER Mr. Michael moved that the City ~,~nager proceed with annual city employ- ees dinner. Motion seconded by Mr. Summers and motion carried 5-0. ivmyor Gallo called for a Workshop Meeting next Monday evening to come up with a workable sign ordinance. Meeting to be in Conference Room at 7:30. Public and press invited to attend, Mayor Gallo issued a P~ocla~tion declaring November 22nd as the 2nd Annual Appreciation Day for Florida Atlantic University. A letter from Emily Jack~on was read by City Clerk requesting two poll watchers at Pr/mary November !8th. ~l~. Michael moved the request be granted. Motion died for lack of second.
