Father O'Shea of the St. Mark's Catholic Church offered the i~vocation~ and the Flag Salute was led by Mayor Gallo. No introductions v~ere made. MINUTES Mr. Nylund moved ~o accept the Minutes of the Regular Meeting of Septem- ber 8, t969. Motion seconded by M~, Summers and carried 5-0. BIDS OPENING None ~,WARDING Street Res,u~acing (On the table) Mr. Michael moved to take subject bid off the table. Motion seconded by Mr. Summers and carried 5-0. The City Manager asked for an opinion from the City Attorney as to the status of the bids awarded February t7~ 1969 on an annual basis. Mr. Moore stated he felt it was still binding. Mr. Miahaet moved to reject all bids received at the meeting of September 8th and proceed under the bid as e%,~arded earlier in the year- Motion seconded by Mr. Nylund and carried 5-0. PUBLIC AUDIENCE Mr. Har~y LeFort. 725 Ocean Inlet Drive~ questioned Mayor Gallo as to the sign problem. The Mayor advised that the subject had been referred ~o the Building Board ~or steady aD~ aduisament. ~HBLIC HEARING None. LEGAL Page No 1. MINUTES REGULAR CITY COUNCIL MEETING September 15: 1969 Ordinances - 2nd R~eadin~ None Ordinances - 1st R~adin~ None Resolutions The City ~ttorney read Resolution 69-CC endorsing the proposal that the Board of County Commissioners appoint an~advisory committee to implement s county wide ~ecreation plan. Mr. Summers made a motion to adopt Resolution 69-CC, Motion seconded by I~, Nytund and carried 4-1; Michael voted ~NOo-~ OLD BUSINESS Consider amending $oning code ~ite locations (On the table) to establish criteria for filling station Mr. Summers moved to take this item from the table for further considera- tion. Upon a second by Mr. Nylund~ the motion carried 4-1; Michael voted "No." Mayo~ Gallo reviewed the recommendations of the Planning g Zoning Board as presented at their meeting of July 9~ 1969. Mr. Nylund moved to accep~ the recommendations of the Planning & Zoning Board and to instruct the City ~,ttorney to prepare the necessary ordinance to amend our Code accordingly. Motion seconded by Mr. Summers and carried 4-1. Mr. Michael voted -No.- Mayor Gallo stated that this action would automatically remove the John kdams and the Caldos requests on the distance requirements between service s~ations from the ~,genda. Collins made a motion to amend Ordinance 69-26 and set the millage rate for the 1969 tax roll at 9.68 mills instead of 8.8 mills as read at the meeting of September 8. Motion seconded by Mr. Summers. Mr. ~lbert Wehrell~ 938 Isles Road~ questioned the Council as to the actual need for a millage mncrease and offered words of caution about making it difficult for many citizens of Boynton Beach to pay additional taxes. Mr~ Narmy LeFort~ 725 Ocean Inlet Dmive asked if the,Capital impmovements ~mu!d go to referendum. The Mayor advised that as long as they were done on a pay-as-you-go basis the Council would determine the improve- ments to be done. Mr, Michael stated that he did not:see the need to increase the millage this year and felt it was a crime to do so. The Mayor defended his change in vote on the millage rate and called for the vote. Motion carried 4-1; Mr. Michael voted ~No.- The City ~ttorney read O~dinance 69-26 setting the millage at 9.68 mills with the following breakdotm: General 8.71 I & S ,27 Refunding .32 Publicity .38 9.68 Mr. Michael questioned the legality of reading an ordinance on seca~d reading with less than ten days bet?men readings. Mr. Nylund moved Eo pass Ordinance 69-26 as amended on second reading. Motion seconded by Mr. Collins and carried 4-1~ Mr. Michael voted -Ne... ~D~I~ISTRATIVE Consider ap.po~ntment_ of Capital tmprovemen'c Committee. Mayor Gallo mecommended the appointment of a Capital Improvement Committee to steady ~ha needs of the City and recommend to Council as to priority of capital improvements. Mr. Summers moved ~o create a Capital Improvement Study Committee to serve at the pleasure o~ Council. Mr. Nylund seconded the motion and the vo~e Was 4-I~ M~. Michael voted ~No.~ The Mayo~ nam'ed the following to serve on subject committee: Mr. John Howell Mr. George Wilde Hr. Robert Beyer Mr. Gil Eckert Mr. Joseph T. The date was set for Friday morning~ September 26~ 1969 at 10 The City Manager requested permission to open bids on Garbage 6 Trash pickup at ~ais same meeting and was granted approval, Mr. Michael asked 'that the specs be prepared To allow separate bids on garbage and trash pickup, The question of containerized pickup being specified in the bid was questioned and same ~,~s agreed upon. Discuss p~acing purchase of beach property .on referendum. Mr o Michael moved that the question of the purchase of beach prooerty be placed on the ballot for a straw vote in the Decembe~ election: t4otion was duly seconded by Mr. Nylund~ and carried 5-0~ ~iseuss hiring architect for Police Complex, Mayor Gallo suggested that a commi-s~ee be appointed re visit other Police Departraents in the area and work with a Council appointed architect to start preliminary plans for a complex. Motion made by Mr. Summers that the Council in't~Pview a~chitects that have experience in this ts~e o~ construction and appoint Lt. Huddleston~ (~,cting Chief)~ Lt, Waters and Lt. Hamilton on a committee to study the needs of the departm~ent. Motion seconded by Mr. Michael end carmied 5-0. List of payments made in August. Mr. Nyiund moved To accept the list as presented. Motion seconded by Mr~ Summems and carried 5-0. Approval of Bills The City Clerk presented the following bills for approval~ Both had been checked by Finance and approved by City Manager: Fitzgerald Engineering Co.~ Inc. U.S. Concrete Pipe Co. $2~024.10 1~40!.07 Mr. Michael moved that the bills as presented be paid. Motion seconded- y hr, Summers and carried 5-0 OTHER John Klinck of Russell g ~,xon presented the Council with a schedule construction o~ Sewer lines in Gol~view Harbour~ copy of same is attached hereto and made parr o~ these minutes. Page No. 4 MINUTES REGULAR CIIY COUNCIL [~ETING SEPTEMBER 15~ 1965 Mr. Courtney stated that ha had been in touch with Mm. Larry Lukin~ Palm Beach County Health Departw~]ent~ and felt~that upon receipt of this schedule duly endorsed by the City Council that temporary septic tank permits could be issued to allow construction in Gotfview Ha~bour. ~. Summers moved to endorse the attached schedule and ~orward copy of same to ldr. Lukin. Motion seconded by Mr, Michael and carried 5-0. Mayor Gallo read a letter dated September 12th fmom Mr. Thomas R,.~,lcock in regard to available funds for the sewer expansion program. A lengthy discussion followed as to availability of money at 6%. Mr, Court-ney recommended that pm reappty for a Federal Grant under Public Law 660 ~or se?mr expansion and also suggested that we go ahead with the validation of the bonds. Mm-. Michael made a motion to apply for fede~at assistance under Public Law 660~ validate the Bonds and contact banks ~n our local area for ~n=ncmng. Motion seconded by Mr. Summers and carried 5-0. The City Manager meported that the representative of Community Systems Corp. was in ~ne area and requested a meeting with the Council. It was decided to meet with him for a luncheon meeting at 12 o~clock Noon~ Tuesday at To~.m Tavern. Mr. Courtney advised Council that he had run into Right-of-Way problems on the sidewalks to be constructed on K.W. 10th _,venue g S.E, 4th Stmeet, Mayor Gallo suggested that the City advertise for bids for an elevator in City Hall, Mr. Summers moved that the City Manager be authorized to go out rom bids fo~ an elevator. Motion seconded by Mr. Nylund and ca~ied 5-0, Mayom Gallo read the letter received from Jim Watson~ Palm Beach County Zoning Commission under date of September 11~ i969 in regard to mobile homes. It is anticipated that the field work will commence this week, therefore, submission to the State Board of Health should take place in about 8 weeks, or during the first week of November. [t is anticipated that State Board of Health approval, advertising and award of contract would require approximately seven weeks, indicating star~ of construction to be the first week in January. With normal progress actual con struction will .require approximately four months ~ for completion of project approximately May I, 1970. Also. noted on attached sckedule are time requirements for the developer's portion. His consulting engineers have stated that plans and specif!cat:3ns for gravity sewers will be submitted to the State Board of Heai:[:. n ptember 15, 1969. He has further stated that construction work -wz-~l _ planned such that the _~ft station, foza main and gravity sewers would De completed well in advance of the City's portion, thus, there should be no delay between the completion of the City's sewers and their being put to into service.
