The Invocation was given by Rev. Nelson P. Moyer, First Methodist
Church and the Flag Salute was led by Councilman Gilbert Collins.

APPROVAL OF MINUTES
Regular Meeting - August 4: 196~.
~. Nylund made the motion that the Minutes of the RegulaT Meeting of
August 4~ 1969 be accepted as presented, b~. Summers seconded the
motion. Motion carried 4-0 due tD the absence of Councilman Michael
at this meeting.
AWARDING OF. BIDS
City Clerk stated only one bid was received that being from Joseph
Tomberg and it was below the minimum bid required in accordance with
the advertisement~ but further stated that he had verbally agreed to
pay the exact amount due plus interest.
b~. Michael made the motion the City Clerk dispose of the tax certifi-
cates for the exact amount due plus interest. Mr. Summers seconded
with the stipulation that the tax certificates be examined to learn
whether or not there are properties involved that the City can use.

Mr. Summers made the motion that Ordinance 69-23 be adopted using the
figures that had-been presented to Council at the August ~th~ 1969
meeting. Motion died for a lack of a second.
OPENING OF BIDS 7:45 P.M.
Mayor Gallo explained that it was now time for the Bid Opening~ and v~e
would return to ~Legsl~ after the receiving of bids.
Mm. Michael made the motion that the receiving of bids be closed.

LEGAL - Continued
Mr. Courtney explained that the total budget was the same amountas
presented at the August 4th meeting. However~ in order to make three
additional changes which the City Council had requested~ it was nec-
essary to change figures from one depamtment to another.
Mr. Michael made the motion that Ordinance No. 69-25 be passed to sec-
ond reading. Mr. Collins seconded and motion carried 4-0~ ~. Summers
dissenting.

Resolution No. 69-T - Supporting To%~n of Manatapan Re: Bridge across
Intmacoastal, Waterway
City Attorney read subject Resolution in its entirety.
Mr. Summers made the motion Resolution No. 69-T be passed, M~.Cotlins
se conded.
}~r. Michael stated that he thought it was a move in the right direction
to have a fixed span bridge.
Motion carried 4 -1 ~ ~4r. Michael dissenting.
Resolution No. 69-H - Continuance of safe~ free and unimpeded public
and private vehicular services
City Attorney read subject Resolution in its entirety.
~. Michael made the motion that Resolution No. 69-~ be passed. Mr.
Summers seconded and motion unanimously carried.
Fees - Re: City's Consulting Engineers
Mr. Moore stated he was in receipt of a fee schedule from Russell g
Axon which covers the various ex~ra charges such as~ surveys~ right-of-
ways~ topography~ maps~ etc.: and it does appear that these services
are specifically covered under the fee schedule plus a fifty (50%)
percent overhead charge.
Comneilman Michael asked if the extra fees involved were connected with
the work they were requested to perform.
City Attorney stated he was not certain but we would assume it %-~uid
be in connection with authorized work and we %,a~uld be obligated to pay
for areas which were germane to the specific job.
Mayor Gallo stated that the payment of bills being withheld are those
connected with other miscellaneous charges and apparently the City
Attorney is o~ the opinion they should be paid plus the 50% overhead
as requested.
Mr. Michael made the motion that the Finance Department be instructed
to pay the balance of the Russell & Axon bills which were previously
brought before Council. t,~. Summers seconded. Motion carried 4-1,
Councilman Nylund dissenting.

Mr. hichaeimade the motion that on future projects, ~. Courtney should
be given some idea as to amount of extra work involved and the costs
thereof.
F~. Gallo suggested a meeting be called with representatives of R & g
and the City Council to determine whether or not the City v~nts to con-
tinue with them o~ retain another engineering firm.

City Clerk opened and acknowledged the following bids:

~esolution Re.: Tax Assessing
Mr. Michael made the motion that the City Council have the City ~ttorney
draw up a Resolution to go on record opposing the present system of tax
assessing: said Resolution to be sent to the State Legislature and
neighboring Cities asking for their support in this regard. Mr. Nytund
seconded.
City Manager stated that it was suggested at a meeting he attended in
West Palm Beach that our City Attorney should join with other City
~ttorneys to form a legal opinion to present to the Florida League of
Municipalities at the meeting of City Offic~ in Daytona Beach in
October.
City Attorney stated it is generally agreed that a request should be
made to repeal the present law and there is a strong lobbying power
going on at the present time.
Motion unanimously carried.
OLD BUSINESS
Request of James A. Cabler, Jr. - Village of Golf
Mayor Gallo read correspondence from Mr. Cabler in which they indicated

their desire to enter into a contract for water with the City for the
Village of Golf similar to that entered into between the City and
Delray Dunes.
Mr. Summers made the motion that the City Attorney be authorized to
draw up a contract with the Vil!aqe of Golf according to the rate sched-
ule we now have with Delray Dunes ~ and with the undsrstanding that the
12~ water main would be deeded to the City.. Mr. Michael seconded and
motion unanimously carried.

F~yor Gallo read correspondence from ~r. Langbein which stated he was
willing to undertake an appeal on this mattem on a contingent basis.
Mr. Michael made ths motion that we instruct Mr. Langbein to continue
with the appeal in that if the City wins this case, it could mean a
substantial savings in refunding the taxes involved.
Motion secmnded by Mr. Summers; carried unanimously.
NEW BUSINESS
Correspondence from Community. Systems Corporation
Mr. Courtney stated that subject corporation has offered to acquire
federal funds for such projects as open space programs: and further
stated they appear to be qualified in this field as they are aware of
all federal progTams, and they could possibly be helpful to the City
in this regard.
It was agreed the City Manager should arrange for a meeting with the
City Council and representatives of Come, unity Systems Corporation.

Discuss possibility of Extension of Se%,er - Golf View Marbour
City Manager stated he had once again discussed the possibility of

allowing tempQramy septic ~nks in Golf View Harbour- with the Palm
Beach County Health Department, and they have indicated they would
possibly go along with septic tanks if they had a positive statement
from the City Council as to when sewers would be available in this area.
l,~r. Courtney further stated he would recommend very strongly getting
sewers in this area as it is the potential growth of large homes in the
City~ therefore, he would appreciate an expression from Council in this
regard.
~IP. Michael suggested that Council begin 'negotiations with the local
financial institutions to determine if funds can be raised fora t~he ex-
pense of sewer expansion; and further~ to attempt to receive a definite
commitment so we can advertise for bids as time is of essence.
City Attorney stated he has been ~in contact with the County Attorney
who indicated they would interpose no objection to this type of agree-
ment p~oviding the City show some concrete evidence of putting a sewer
into this area. Therefore~ City Attorney recommended that the City
obtain a feasibility study of the area ~rom Russell & Axon.
Mm. Michael made the motion that Pip. Courtuey be inst-~ucted to check
into the possibility of local £inancing for a sewer plant and Golf View
Harbour; also~ to determine what the cost will be to get into Golf View
Hmrbour: and when the report is completed to see if we can get the Palm
Beach Health Department to release septic tanks to Golf View Harbour.
Mr. Collins seconded: and motion unanimously carried.
~. ~iehael asked that the complete ~eport regarding Golf View Harbour
be placed on the September 8th ~.genda.
Set Meeting Date for Second Reading of Ordinance 69-23
It was decided that a Special Meeting be set ~or Fmiday~ August 29th
at 1 P.M. for the second reading of O~dinanee No. 69-23.
Pis...cuss Existin9 Sign Ordinance.
Mayor Gallo stated he had asked this to be placed on the Agenda and
advised that he is requesting that the Sign O~dinance be referred back
to the Building Board for e!arifieation and modification.
City Manager stated if Council agrees to allow it to go back to the
Building Board~ we should ask them to expedite this request as a ~hoid~
would be placed on all permits until a recommendation is received from
the Building Board, and this situation has been resolved.
Mr. Michael aske~ i~ v~ could include this item in our Special Meeting
scheduled for Friday~ iugust 29th: and was answered in the affirmative.
Mr. Michael made the motion that the Sign Ordinance be referred back to
the Building Board for immediate action and recommendations should be
made to the City Council'at the Special Meeting on August 29th.

~i~. Michael stated that it was his considered opinion that the adver-
tising benche were being located in places where they were not usable~
and wondered if something could be done about them.
Consider proposal of Gerald Dake, Planning Consultant.
Mayor Gallo stated he had asked this be placed on the Agenda inasmuch
as he thought the City would have received an answer to their request
in which they asked ~i~. Dake to submit his proposal to the City. The
Mayor then read a letter f~om Mr. Dake in which he stated he was spend-
ing additional traveling money which was not included in his present
contract.
Mr. Summers made the motion this item be tabled until such time as
~. Dake presents his proposed contract to the City. ~r. Collins sec-
onded and motion unanimously carried.
Consider Appointment of Prosecutor.
l~yor Gallo stated that Mr. Moore has submitted a request to Council
that consideration be given to the appointment of a City Prosecutor
before the beginning of the new fiscal year~ and further stated he had
approached David McKay with regard to filling this position and he would
be willing to accept the position at the amount budgeted.
i~M. Moore stated he had an Ordinance ready which %~ould set up the posi-
tion of City Prosecutor but the appointment would not be necessary at
this t/me and asked if the Council %-~u!d like it read. It was so
agreed.
Ordinance No. 69-25 (lst Reading) - Creating non-classified position
of City Prosecutor.
City Attorney read subject Ordinance in its entirety. Mr. Summers made
the motion that Ordinance No. 69-25 be passed to Second Reading. Mr.
Michael seconded and motion unanimously carried,

full time City Attorney in City Hall~ if it would be advantageous to
the City.

Racial Committee to install a side ~lk on loth Avenue West o£ Seacrest.
Mayor Gallo requested the City Manager to make a study o~ this problem
and present it to the City Council at the next meeting~ indicating
the appmo×~aate costs involved.

City Clerk stated the Council for the Blind had requested the ~aiver
of the license fee ~or e blind peanut vendor who planned to sell peanuts
throughout the City vgith a mobile cart.
