Moyer~ First Methodist Church and the Flag Salute was led by City Manager G~ady W, Courtney. Int-~oduction of Special Guests Robert Beyrer, repDesenting the Senior Citizens o~ Sterling Village and Clyde Worretl~ ~ast Councilman. Report By Area Planning Board presented by Don Morgan, Director. Don Moruan presented Mayor Gallo with ten booklets which he stated were a '~year]s study= on the problems facing Palm Beach County such as air po~ution; water and sewer; shore line; housing problems; population increases etc.s and it was his hope the City would take advantage of thi~~ work and use it as re~erence material. Ny!und pointed out that on Page 6 under the item ~egarding ~'Taxi, Pranehmse , a motion made by Mr. Michael had not been secondeds nor is there any indication as to how the motion was carried. Mr. Nylund made the motion the Minutes of the Regular Meeting of July 1969 be accepted with the correction made. Mr. Collins seconded and motion unanimously carried. PUBLIC AUDIENC~ Emily Jaeksons 728 N.E. 9th ~venue asked that something be done with the microphones in the Council Chambers, Mr. and Mrs. Harry Pohlman of 2116 N.E. !st Street objected to a ~;shaek~' being built on property in their areas and questioned the release of a newspaper article pertaining to same. Lester E~pitsky~ 2135 N.E. 2nd Ct. indicated his objection to the ~shack - !- MINUTES REGULAR CITY COUNCIL MEETING JULY 21, 1969 Herman Herzog, 2141 N.E. 2nd Ct. questioned the laws on trespassing. Joseph DeCosmo, 2144 N.E. 2nd St. defended the action of the boys in- volved who are building the shack. George W~tson~ asl~d whether the City was responsible for the delay in the occupancy of his home in Leisureville. Harry LaPorte~ 725 Ocean Inlet Drive~ suggested the City Attorney read the Ordinance gover~ain9 the size of signs in the City inasmuch as he is of the opinion this Ordinance is being violated. M~, Summers made the motion that Ordinance 69-19 ~e passed to second reading. M~ Collins seconded. Col. Albert Wehrell~ Boynton Isles~ objected to this Ordinance. M~ch discussion ensued. John Adams~ ~tto~n~v representing ~,~. MeKee~ the owner of the property in question stated his client preferred the C-i zoninq. Stanley Weaver~ ~airman of the Plannf~ and Zoning Board explained the action of the Board on this reo~est for change of zoning stating the ~inutes of the Planning g Zoninq Boa~ Meeting of June 30th %~uld re- flect said ~ction. Col. Wehretl again appea~ed befome the Council in opposition to the C-1 zoning. Motion camried 3-2, Coungilmen Nytund and Michael dissenting. Ordinance 69-~ - re PeDsion Plan as per request of I.R.S. ~ity Attorney asked that this item be deferred. Mr. Mieb=~l made the motion that this item be tabled. City Manager- explained that the State Road Department asked the City to maintain the lights on Second Avenue after they had been installed by the SRD. Resolution No. 69-R - Agreement with Seaboard C,L.R.R. re Force Main No. 8: and Resolution No. 69-S - Agreement with Seaboard C.L.R.R, re Industrial area (Wg~re. ll) City Attorney read subject Resolutions in their entirety. Mr. Summers asked if one motion on beth R~sotutions v~s legal and was answered in the affirmative. Mr. Summers moved that Resolutions No. 69-R and 69~S be passed. Mr. Nyiund seconded and motion unanimously carried. OLD B~$1~,~ESS A. Consider reques~ for Change in Zoning 1. Boynton NUrseries, Inc. (On the table) Stanley Weaver stated the Planning g Zoning Board met this evening on this item and inasmuch as there are many problems involved particularly since we have no ordinance governing heights~ the Board would like the City Council, City Manager~ City Engineer~ and City Attorney to meet with the Board next Monday evening~ July 28th at 7:50P~~ It was so agreed. Consider Settlement of Halpin Account (On the table), City Attor~ney advised that he and the City ~anager had resolved the differences and Halpin was now ready to settle ~om the total amount of $4~289.16. }l~. Receipt of Plat - Leisureville~ Sec. 3 (On the table) City Attorney stated the bond in the amount of $98:900. as pre- sented is acceptable with the addenda added that this is for Section 3. Collins asked the City Attorney for a ruling on the Conflict of Interest Law before voting on this issue. City Attorney stated he could not give a ruling inasmuch as the City had not as yet received the up-dated law though it has been requested. Mr. Summers made the motion that the Plat for Section 3 of Leisureville be accepted. Mr. Nylund seconded and motion carried 4-t: Mr. Michael oppos lng · M~EdTES CiTY COUNCIL ~ETING JULY 21~ 1969 NEW -USINESS Mr. Rossi~ Engineer for Leisureville~ appeared before Council and in- quired if any additional action was necessary on the part of the Council in regard to acceptance of water and sewer facilities in Leisureville, Section t. He was advised that this could be handled administ~2atively. ADMINISTrciTIVE Consider re~_e_s_~_pf_.Pt_ap_ni_n.~ & Zoning Board re City Planner. Mayor Gallo stated the memo regarding the recommendation of Gerald Dake to continue as City Planner was before Council. City ~' ' . ~ttorne% advised -that ~.'~r. Dake should present a formal proposal in which his terms are indicated, M~. Summers made the motion that Cit%~ ~[anager contact Mr. Dake asking him to submit a proposal to the City Council for consideration. Mr. Collins seconded and motion unanimously carried. Request for Beverage License - Pic-B-Pak~ Inc.~ 206 S. Fed. Hwy_. City Clerk stated subject retail merchant has requested a bee~ g wine license for take out only; however~ since the City had a holiday today~ all inspectors had not "signed Off." M~. Court~ey also reported to Councm_ tnat the City of Boynton Beach was not eligible for financial assistance, under P.u,blic ,,,Law 660 at this time. Mayor & City Councilmen RE: Central File System We recommend that the City Clerk's Official duties be expanded to in- clude a Central File System. In addition to all legal documents such as contracts, agreements, deeds, etc. which are now required by law to be filed in the City Clerk's Office, there shall also he filed a copy of any correspondence by the City Manager or Department Heads that has any indication of an obligation on the part of the City. All documents of information such as specifications; maps, etc. shall be filed or a copy thereof, in the City Clerk:s Office. The City Clerk shall set up a Central File System, so that all docu- ments filed in the Office may readily be accessible for the purpose of information to anyone who is seeking information thereto. No one shall remove or replace any file in the Central File System so set up by the City Clerk unless they are under the direct supervision of the City Clerk's Office. In case of an emergency, when neither the Clerk or personnel assigned thereto are available, information may be removed from the files by any Official of the City but in no case shall a file be replaced by anyone other than the City Clerk or a duly authorized person, working under the Clerk's supervision.
