15-018 1 ORDINANCE NO. 15 -018 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, 4 ' ABOLISHING THE CEMETERY BOARD OF GOVERNORS; 5 PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY 6 AND AN EFFECTIVE DATE. 7 8 WHEREAS, the City Commission has evaluated the futures of cemetery operations in 9 the City due to the fact that the cemetery operations are drawing to a close; and 10 WHEREAS, the City Commission has determined that the Cemetery Board of 11 Governors has fulfilled the objectives of the City Commission and has approved the 12 recommendation to abolish the Cemetery Board of Governors. 13 ' NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION 14 OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: 15 16 Sectionl. The foregoing "WHEREAS" clauses are hereby ratified and confirmed 17 as being true and correct and are hereby made a specific part of this Ordinance upon adoption 18 i hereof. 19 Section 2. The Cemetery Board of Governors is hereby abolished and all duties 20 and responsibilities heretofore delegated to or performed by the Cemetery Board of 21 I Governors will be performed by the City Manager or her designee. 22 Section 3. All references to the Cemetery Board of Governors contained in the 23 City Code or applicable non - codified ordinances or City Resolutions shall hereinafter be 24 interpreted to mean the City Manager or her designee. 25 ' Section 4. It is the intention of the City Commission of the City of Boynton Beach 26 that the provisions of this Ordinance shall become and be made a part of the Code of 27 Ordinances of the City of Boynton Beach, Florida, and that the Sections of this Ordinance 28 may be renumbered, re- lettered and the word "Ordinance" may be changed to "Section," 29 "Article ", or such other word or phrase in order to accomplish such intention. 1 1 Section 5. If any clause, section, or other part or application of this Ordinance 2 shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such 3 unconstitutional or invalid part or application shall be considered as eliminated and so not 4 affecting the remaining portions or applications remaining in full force and effect. 5 Section 6. All Ordinances or parts of Ordinances, Resolutions or parts of 6 Resolutions in conflict herewith be and the same are hereby repealed to the extent of such 7 conflict. 8 Section 7.
