5 (6) EXISTING FEES AND CREATING FOUR (4) NEW
6 FEES UNDER THE BUILDING DIVISION FEE
7 SCHEDULE FOR BUILDING AND CONSTRUCTION
8 RELATED ACTIVITIES, AND PROVIDING AN
9 EFFECTIVE DATE

11 ; WHEREAS, on May 6, 2014 the City Commission passed Resolution R14 -042
12 establishing the Energy Edge Energy Efficiency Rebate Program utilizing funds collected
13 through the City's Green Building Fee; and
14 WHEREAS, since the inception of the Energy Edge program the Development
15 Department has had almost one hundred inquiries into the program of which twenty -eight
16 applications have been resulting in the award of $25,000; and
17 WHEREAS, due to the tremendous success and demand from the trial program, the
18 Development Department is seeking to increase the Green Building Fee to provide for an
19 annual allocation of $25,000 to continue the program for future years; and
20 WHEREAS, the City Commission for the City of Boynton Beach finds that the
21 adoption of these amendments to the Building Division fee schedule is necessary and is in the
22 best interest of the health, safety and welfare of the citizens or residents of Boynton Beach.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
24 THE CITY OF BOYNTON BEACH, FLORIDA THAT:
25 Section 1. The above referenced whereas clauses are incorporated herein by
26 reference.
27 Section 2. The Building Division Fees attached hereto as Exhibit "A ",
28 incorporated herein by reference, are hereby adopted as the fee schedule for those related

29 activities as indicated on the Fee Schedule. A copy of the Fee Schedule shall be maintained
30 and made available for public inspection in the City Clerk's office as well as the Development
31 Department.
32 Section 3. This Resolution shall become effective immediately upon its passage
33 and adoption.

Explanation of Building Division Fee Schedule Changes
- Changes include the following:
- Per HB413 & SB466 the maximum fee the City can charge for streamlined low
voltage permitting was reduced.
- Notes outlining fees by other departments and agencies were incorporated into the
schedule and references to the code section establishing the fees were provided for
clarity and transparency.
- Relocation of penalty fee waiver to new sections to provide clarity.
- Elimination of notes incorporated into new section Other Departmental & Agency
Fees.
- Note and clarification on types or reinstatements and how fees are to be calculated.
- Green Building Fee being increased to fund Green Building Program incentives and
Energy Edge Program annually.
- Changes include the following:
- Fee increase being proposed for cost recovery purposes.
YELLOW - Changes include the following:
- New fees being proposed to cover costs of existing business functions that are not
currently on the Building Division fee schedule. New fees are being proposed for
cost recovery purposes.
- Implementation of a new streamlined residential permitting process for water
heater change outs and HVAC change outs.

BUILDING DIVISION FEES

I. PRIMARY PERMIT FEES:
(A) Plan Review Fee: The plan review fee will be credited against the actual cost of the building
permit at the time of permit issuance. If a permit is not issued for any reason subsequent to plan
review, the City will retain the plan review fee (non - refundable).
(1) Minimum fee; or $75.00
(2) Plan Review Fee Rate On Construction Value:
1.0% $0 - $1,500,000, plus
0.5% $1,500,001 - $5,000,000, plus
0.25% over $5,000,001
(B) Construction Permit Fee: (All types)
1 Minimum fee; or $75.00

2.30% $0 - $1,500,000, plus.
1.75% $1,500,001 - $5,000,000, plus.
1.00% over $5,000,001.
