Mayor Michael called the Meeting to order at 7:30 P.M. The Invocation was given by Rev. Nelson Moyer and the Flag Salute was led by Councilman. ThomasA.Summers. RecoGnition of Civic Organizations and Guests: Mayor Michael introduced Mr. Cess Farrar of the Greater Boynton Beach Chamber Of Commerce, and Mr. and Mrs. Joseph Cook. B~,Robert Bowen, V.F.W Post $5438 was also recog- nized in the audience. MINUTES: Far. Nylund moved that the Minutes of the Regular Meeting of February 5, 1968 be accepted as presented. Seconded by Mr. Galto. Unanimously carried. OLD BUSINESS: Consider Request to Extend Closing Hours for Bars: (On the Table~ Considerable discussion was held, at which time Mayor Michael reminded the City Council that this issue had not been removed from the table. Mt. Summers made the motion that this be removed from the table. ~. Collins seconded. Unanimously carried. Mayor Michael read letter of petition signed by twelve (12) restaurant and bar owners in the City who indicated they were in favor of extending bar hours. Paul Johnson explained that there were only 2 or 3 bars in the City who were interested in extending the bar hours, and -the signatures of the other restaurant owners was merely in "support" of this request. Discussion followed. Page No. 1 MINUTES Mayor Michael read a letter from the Boynton Beach Woman's Club which indicated they were opposed to extending the bar hours in the City. Mayor Michael asked if'there was anyone in the audience who wished to come forward in opposition of this issue. Norman Brayley, 2815 $. W'. 9th Street indicated he was opposed to the extension of bar hours. Discussion followed. Fir. Summers made the motion that we extend the bar hours from 3 A.M. to 5 A.M. ~Ir. Collins seconded. Unanimously carried. The City Attorney wondered if he should prepare an emer- gency Ordinance or go through regular channels. Mr. Surmuers did not feel an emergency Ordinance would be necessary. Mayor Michael agreed. Mr. Collins made the motion that an emergency Ordinance be drawn up on the extending of bar hours from 3 A. M. to 5 A.M. Mt.Gallo seconded. Motion failed 3-2. Mayor Michael, Fir. Summers and Mr. Nylund dissenting. Consider Retirement Plans, Inc. Proposal Re: Actuarial Service for Pension Plan: Ma~or Michael read a letter received from Mr. Gabel, Vice President of Retirement Plans, Inc. in which he outlined the services he had to offer to the City. Mr. Eylund made a motion the City accept this service as it was certainly needed an order to set up the Pension Plan for City employees. At this point Mr. Joe Cook, President of C & J Life, Inc. came forward and offered actuarial services to the City at no cost. Much discussion f611owed. Mayor Michael reminded the Council that a mo~ion was made to accept this service. Mr. Summers seconded. Motion passed 3-2, Mr. Collins and Mr. Gallo opposed. Page No. 2 MINUTEs REGULAR CITY COUNCIL MEETING PEBRUARY iS, 1968 [Amended - - ~eeting $-19-68 ,Approval Requested to Have Enq.ineering Report Prepared: CityManager stated we had a proposal from Russell and Axon, Consulting Engineers, under date of Pebruary 15, 1~68 to make a study of our water system as provided by the bonding company, and submitted the services offered by Russell & Axon, Inc., with amount of monies involved. Considerable discussion followed regarding the costs in- volved. Mr. Summers made a motion to table this and asked Mr. Courtney to get in touch with Russell and Axon, for fur- ther study. Mr. Nylund requested that another firm also be contacted. Mr. Gallo seconded. Unanimously carried. OPENING OF BIDS - 7:45 P. Mr. Gallo made a motion we acknowledge receipt of the bids and turn them over to the Tabulating Committee without reading the entire bid, and any Bidders present will be entitled to examinetheir competitors' bids. City Clerk opened the only bid received: General Electric Co., Miami Mr. Nylund moved that the bid be turned over the the Tabu- lating Committee. Mr. Summers seconded. Unanimously carried. Street Resurfacinq: City Clerk opened and read bids received from the following: Rubin Construction Co., West Palm Beach Hardrives Co., Delray Beach Dixie Asphalt Co.,West Palm Beach Mr. Gallo moved the bids be turned over to the Tabulating committee. Mr. summers seconded. Unanimously carried. Gallo seconded. ~ix (6) Pick Up Trucks: Mayor Michael advised that bids were received from seven (7) companies and the Tabulating Committee recommended the City accept the low bid received from: Adams Chevrolet, Delray Beach $9,030.00 each Mr. Gallo moved we accept this bid as presented. ~lr. AWARD OF ANNUAL SUPPLY OF;_ Shellrock: The ~yor advised that two bids were received by the City for this item and the Tabulating Committee recommend- ed we accept the bid received from: Ed Clanton Trucking, $2.05 cu.yd for shellrock Boynton Beach $1.85 ton for pit lime rock F~. Gallo moved we accept this bid. Mr. Summers seconded. Unanimously carried. Cast.Iron Pipe & Fittings: Mayor Michael explained that seven (7) companies sub- mitted bids to the City and due to the length of the bids, they are indicated in block form on the tabulating sheet as recommended by the Tabulating Committee. Batteries: The Mayor stated that two bids were received for batteries and the Tabulating Committee recommended we accept the following low bid: Boynton Auto Supply Co. Boynton Beach $8.00 plant site Mr. Page No. 6 ~INUTES REGULAR CITY COUNCIL MEETING _FEBRUARY 19, 1968 PUB~IC AUDIE_N~E: Mr. Raymond Martin, 919 S. ~. 27th Way appeared to ex- press his opposition to the parking of trailers in resi- dential areas, and presented a petition to the City Clerk which consisted of 103 signatures of residents of the dity who also indicated their opposition. Mr. Kenneth ~. Adams 610 N.E, 4th Avenue, expressed his objections to an "open air spetic tank" and wondered when ~%e City%.;ould remove same. ge also requested the City to survey an "alley" in back of his home to determine the owner. Mr. Norman Brayley, 2815 $. W. 9th St. read a prepared statement in which he indicated his opposition to trailers being parked in the driveways of s~ngle family dwellings. Mr. Wallace 2830 S. W. 9th street came forward to express his opinion in favor of trailers being parked on private property, but further stated, he would abide by the final decision of the City Council. N~ BUSINESS: Correspondence from Boynton Beach Shuffleboard Clqb~ City Clerk read a tha~= you letter received from this club expressing their appreciation to the City for their assistance in the installation of new lights at the Shuffleboard Courts. LEGAL: Abatement of Nuisance - Lot 33: Lawn's Subdivision: City Attorney reported that the owner of this property has agreed to fill in the lot at his expense. Consider Appointment of Attorney to Represent the City in Palm Beach Memorial Park Litigation: City Manager explained that he had written £,~. Lan~bein but his fee seemed rather costly so the file was t~rned over to another attorney for consideration and we had not as yet heard from him. Mr. Gallo moved we table the issue until we get word from subject attorney as to whether or not he would accept. Mt. Summers seconded. Unanimously carried. Page No. 7 MINUTES REGULAR CITY COUNCIL MEETING FEBRUARY lC~ 1968 _ ADMINISTRATIVE: Consider ~unnicut's Proposal for 1968 Tax Roll: Mr. Courtney explained that this has been an annual contract for the responsibility of assessments for the City and recommended approval of same. ~.Gallo moved we accept this agreement as prepared for the i968 Tax Roll. Mr. Summers seconded. Unanimously carried. Consider Request to Grant Halpin, Inc. a 60 Day Extension o_n. Sewage Project: Mr. B. M. Woolbright, Sr., of Russell and Axon, Inc. came forward ~tated that he did not feel the extension should be granted inasmuch as ~alpin started the job 28 days late and also, ordered parts for the lift station late and was not able to obtain these in time to complete the work. He therefore, felt that ~atpin should not receive the exten- sion. Mr. Gallo moved the extension be denied due to the circum- stances involved and penalty be invoked. Mr. Summers seconded. Unanimously carried. Discuss Legal Advertisinq~ City Attorneyexplained that the Boynton Beach News Journal did not apply for second class privileges untilNovember lsta 1967, therefore they would not be qualified to run legal advertising until November 1965..~., Consider Request for Voter Registration at N. E. 10th Ave.: The City Clerk advised that this was a verbal request made by Rev. Lee to accommodate the residents in that area to register for the month of February. Discussion followed. Mr. Gallo moved the request be granted for the balance of the month. Mr. Summers seconded. Request denied 3-2, ~ayor Michael, bit. Nylund and ~4r. Collins dissenting. Recg~pt of List of Payments made in January- Mr. Gallo moved that the List of Payments for January be accepted as presented. Mr. Summers seconded. Unanimously carried. Page No. 8 MINUTES REGULAR CITY COUNCIL MEETING FEBRUARY 19, 1968 See Amended Paragraph Qn Pa~e 10 A~pr_oval Requested to 9o out for Bid on TV Cable Project: Mr. Gallo stated he would like the City Manager to go out for bids on this service; to inquire into the type service they would provide, what costs would be involved and what the company would have to offer the City for ~his service. Discussion followed. £~r. Nylund suggested that the City contact several repre- sentatives for this type service. Mr. Collins made a motion that one or two representatives be invited to meet with the City Council to discuss this service. Mr. Nylund seconded. Unanimously carried. ~Pproval of Bills: Far. Courtney explained the bill received from Halpin, Inc. the contractors on the sewer project. The bill is in the amount of $19,975.00 but the City Manager recommended that $1,600.00 be held back for penalty charges of 32 days at $50.00 per day. He therefore recommended we pay: Halpin, Inc. $18,375.00 Mr. Sunmuers moved we pay this bill in the amount of $18,325. deducting the $1,600.00 as recommended by the CityManager. Mr. Gallo seconded. Unanimously carried. Mr.Cour~ney presented the bill received from Russell and Axon, Inc. in the amount of $1,035.S4 which included fees for extra services. The City Attorney recommended we ' withhold the amount of money for "extra services" unti.1 the ~ob is complete. Mr. Summers made a motion that we pay Russell & Axon $443.89 and witkhold $591.75 until such time as the contract is completed. Mr. Gallo seconded. Unanimously carried. City Clerk presented a bill from Porter Paint in the amount of $799.94. City Manager requested time to check further into this bill. Mr. Summers made a motion we table this item until ~rther study was made by the City Manager. Mr. Gallo seconded. Unanimously carried. Page No.9 Amended Meeting S-18-68 MINUTES REGULAR CITY COUNCIL MEETING FEBRUARY 19~ 1968 City Clerk submitted a bill from Control Specialist, Inc. in the amount of $2,678.00. Mr.Gallo made a motion that this item be tabled for further study With the purchasing agent. Mr~ Summers seconded. Unanimously carried. The bill from Jerry Earl Pontiac for ~ Police ears ~ $2~83.78 each~ less trade in or net amount of $8~485.12 was presented for payment. Motion made to pay same by Mr. Summers: seconded by Mr. Nylund~ and uD~nimQ~s%v carried_ Cons~er ~pnamappa ~!pha Sorority's Request to Solicit Advertising: Mayor Michael read the letter in ~hich they asked for per- mission to solicit. Mr. Gallo wondered if this organization was recognized by the Chamber of Commerce and was advised they wer~ not. Mr. Summers questioned whether or no~ there were Boynton Beach residents in this organization. Discussion followed. Mr. Gallo made the motion to deny this request. Mr. Nylund seconded. Motion denied 4-1, Mr. Summers dissenting. C~9nsider Reuest by V.F.W. for Club Beverage License: City Clerk advised that this organization was located at 217 S. E, t2th Avenue. They have been checked by our Inspection Department and the County Health Department, and the sale of beverage is for club purposes only. City Attorney suggested the request be granted contingent upon the State License. Mr. Summers moved we allow this request subject to the required conditions. Mr. Gallo seconded. Unanimously carried. Transfer of Cemetery Lot: City Clerk read a letter from Mrs. Helen LeBel in which she requested transfer of Lot 178, Blk E. Boynton Beach Memorial Park. She asked that lot 177 be deeded to her- self and Lot 178 deeded to Mrs. William Ernst. Mr. Gallo moved transfer be granted. Seconded by Mr. Nylund. Unanimously carried. E.Second Avenue lying east of U. S. Highway ~1, is needed for storm drainage by the State of Florida. Mr. Gallo moved the Easement be granted. Mt. Summers seconded. Unanimously carried. OTHER: Mr. Collins asked Mr. Hopkins to explain to the City Council why he feels an increase of wages is necessary for the Sanitation Department and he did so. Mr. Collins explained his reasons for a wage increase in the Sanitation Department at this time. Considerable discussion followed. Mr. Collins requested the City ManaGer to prepare a report in conjunction with the Public Work~ Director and have it ready for next Workshop Session of Wednesday, February 28th. There being no further business, Mt. Summers moved the meet- ing be adjourned. Mr. Gallo seconded. Unanimously carried.
