O76-62 ORDINANCE NO. 76- I~_b, AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMEND- ING ORDINANCE NO. 75~19 OF SAID CITY BY REZONING A CERTAIN PARCEL OF LAND LOCATED IN SECTION 3t, TOWNSHIP 45 SOUTH, RANGE 43 EAST, PALM BEACH COUNTY, FLORIDA, MORE-PARTICU- LARLY DESCRIBED HEREINAFTER, FROM AGRICULTURAL~ TO PLANNED UNIT DEVELOPMENT (PUD) DISTRICT WITH LAND USE INTENSITY (LUI) OF 3.5; PROVIDINC~ FOR SAVINGS CLAUSE, REPEALING PROVISION, AN EFFECTIVE DATE AND FOR OTHEI{ PURPOSES. WHEREAS, the City Council of the City of Boynton Beach, Florida, has hereto- fore adopted Ordinance No. 75-19 in which a Revised Zoning Map was adopted for said City; and WHEREAS · JOSEPH COGEN, individua~Iy and as _Breaident of Cranbrook Estates nc., a Florida corporation, has heretofore filed an application with the City of Boynt¢ Beach, Florida, pursuant to Sec. 31-1 of Chapter 31 of the Codified Ordinances of sate City, for the purpose of obtaining the rezoning of certain propert~y consisting of approximately 83.36 acres located within the municipal limits on the Southwest corner of Congress Avenue and Golf Road, said property being more particularly described hereinafter, from an agricultural to a Planned Unit Development (PUD) District, as more particularly set forth in said application and plans and specifications relafive thereto, including the proposed development plan of CRANBROOK ESTATES, all of which items are now on file in the office of the City l~ann~; and WHEREAS, The Planning and Zoning Board of the City of Boynton Beach, Florid has heretofore approved said development plan and specifications and has recommen- ded approval thereof by the City Council subject to certain conditions; and WHEREAS, the City Council has thoroughly examined the aforesaid developmen plan and specifications relative thereto, and has received favorable recommendations and approval of said project from the City Manager and..~ity~Pla, n~er~ and WHEREAS. the City Council deems it to be in the best interests of the inhabi- Section 1: Thatithe following described land located in Section 31, Township i45 South.
