AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMEND-
ING SECTION 4 (F) OF APPENDIX A, ZONING REGULATIONS, OF THE
CODIFIED ORDINANCES OF SAID CITY TO IMPOSE A GENERAL HEIGHT
LIMITATION APPLICABLE TO ALL STRUCTURES WITHIN THE CITY AND
PROVIDING FOR EXCEPTIONS THERETO AND STANDARDS FOR EVALUA-
TING SUCH EXCEPTIONS; PROVIDING FURTHEI{ FOR AUTHORITY TO
CODIFY, SAVINGS CLAUSE; REPEALING PROVISION, AN EFFECTIVE
DATE AND FOR OTHER PUl{POSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH
'LORIDA:
Section 1: That Secfion 4 (F) of Appendix A~ Zoning Regulafions, of the Codi-
fled Ordinances of the City of Boynton Beach, Florida, is hereby amended to read as
follows:
"Section 4. General Provisions.
F. Height Limitafions and Exceptions.
No portion of any structure intended to be utilized for residential,
commercial, or industrial purposes within the municipal limits of
the City of Boynton Beach, Florida, shall exceed the height of
forty-five (45) feet above the final grade level of such structure.
Water, cooling, and fire towers, radio and television towers of
commercial nature, church spires, domes, cupolas, flagpole and
similar structures and their necessary mechanical appurtenances
may be erected above the district height limitations provided here-
in after recommendation by the Planning and Zoning Board and
approval by the City Council based on their consideration of the
standards for evaluating exceptions to district height regulations
set forth in Paragraph $ below.
In considering an application for exception to the district height
regulation, the Planning and Zoning Board and the City Council
shall make written record indicating the proposed exception has
been studied and considered in relation to the following standards
where applicable:
(a) Whether the height exception will have an adverse effect on
the existing and proposed land uses.
(b) Whether the height exception is necessary.
(c) Whether the height exception will severely reduce light and
air in adjacent areas.
(d)
Whether the height exception will be a deterrant to the improv
ment or development of adjacent property in accord with exis
lng regulations.
(e) Whether the height exception will adversely affect property
values in adjacent areas.
(f) Whether the height exception will adversely influence livin~
conditions in the neighborhood.
(g) Whether the height exception will constitute a great of a
special privilege to au individual owner as con~rasted withf
the public welfare.
(h) Whether sufficient evidence has been presented to justify
the need for a height exception.
4. In residentia& zones, freests~ding television cad citizens' band

the build/nE setback 'lines. Roof mounted or walt supported an-

line height by more than fifteen feet (15~ ).~=
Section 2: Authority tO Cod/fy: Specific authority is hereby granted to
codify and incorporate thi's Ordinance in the City's existing Code.
Section 3: Separability: E~ch of the provisions of t2~is Ordinance is sep-

Section 4: Repealing Provision: All ordinances o~ paa~ts of ordinances in
conflict herewith are hereby repealed.
