O76-60ORDINANCE NO. 76-60 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, REPEAL- ING IN ITS ENTIRETY CHAPTER 7 (CIVIL SERVICE) OF THE CODIFIED ORDINANCES OF SAID CITY TO ELIMINATE CONFLICT BETWEEN THE PROVISIONS THEREOF AND THE CIVIL SERVICE RULES AND REGULA- TIONS PROMULGATED UNDER RESOLUTION 72-Q IN COMPLIANCE WITH SEc. 72.9 OF THE MUNICIP~ CHARTER; PROVIDING FOR AUTHORITY TO-CODIFY, SAVI~S CLAUSE, REPEALING PROVISION, AN EFFECTIVE DATE AND FOR OTHER PURPoSEs. WHEREAS, the City Council of the City of Boynton Beach, Florida, heretofore, in 1954, enacted various rules and regulations of the Board of Civil Service codified as Chapter 7 (Civil Service) of the Co,lifted Ordinances of said City; and WHEREAS, Section 2 (10) of Chapter 61-1889, Special Acts of 1961, amended the Municipal Charter of the City of Boynton Beach, Florida, to add Sec. 72.9, which, among other things, required the City Personnel Officer to prepare personnel rules to govern the municipal merit system, which rules, when approved by the City I ~ouncil, would automatically repeal and supersede the above-referenced rules codi- 5ed as Chapter 7 of the City Code; and WHEREAS, the City Council of the City of Boynton Beach, Florida, by Resolu- ;ion No. ?2-Q, has approved and adopted personnel rules to govern the municipal merit system as provided for in Sec. 72.9 of the Municipal Charter; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Sections 7-1 through 7-18, inclusive, constituting Chapter (Civil Service) of the Codified Ordinances of the City of Boynton Beach, Florida, are ~ereby repealed in their entirety, and the following reference will be substituted lieu thereof: "CHAPTER ? CIVIL SERVICE See Sec ?2 through Sec. 72.13 of Article IV-A: Merit SyStem for Personnel, of City Charter," Section 2: Authorit~f to Codify: Specific authority is hereby granted to codi- and incorporate this Ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this Ordinance is separable, ncluding word, clause, phrase or sentence, and if any portion thereof shall be de- clared invalid, the remaining portion shall not be affected but shall remain in full -~orce and effect. Section 4: Repealing Provialon~ All ordinances of parts of ordinances in .~onflict herewith are hereby repealed. Section 5: An Effective Date: This Ordinance shall become effective in the manner and at the time provided by law.
