A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, ACCEPTING THE OFFER OF $3,600 AS
SETTLEMENT OF THE CITY'S SECOND MORTGAGE AS
A RESULT OF A PROPOSED SHORT SALE FOR DAVID
AND ALEXIS MASSEY BASED ON THE CITY'S SHORT
SALE POLICY FOR FIRST TIME HOMEBUYER
s ASSISTANCE PROGRAM; AND PROVIDING AN

12 WHEREAS, with the assistance of the City of Boynton Beach's first time
14 homebuyer assistance program David and Alexis Massey purchased their home at 8 Via
1' De Casas Sur #103 for $215,000 in June of 2006; and
1 ( WHEREAS, the City of Boynton Beach's second mortgage in the amount of
1; $45,000 is a zero interest (0 %) lien that runs concurrent with the first mortgage; and
1 F WHEREAS, the City Commission previously approved the short sales for the
is Masseys on April 16, 2013, May 6, 2014 and May 19, 2015, but those sales fell through;
2C and
21 WHEREAS, the proposed settlement offer is in accordance with the City's Short
22 Sale Policy for the City's First Time Homebuyer Assistance Program; and
22 WHEREAS, the City Commission of the City of Boynton Beach upon
24 recommendation of staff, deems it to be in the best interest of the citizens and residents
25 of the City of Boynton Beach to accept the offer of $3,600 as settlement of the City's
2f second Mortgage as a result of the proposed short sale for David and Alexis Massey.
2'2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
2E OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
2S Section 1. The foregoing "Whereas" clauses are hereby ratified and

31 confirmed as being true and correct and are hereby made a specific part of this
3 Resolution upon adoption.
3 Section 2. The City Commission of the City of Boynton Beach, Florida
3 hereby accepts the offer of $3,600 as settlement of the City's second Mortgage as a result
3' of the proposed short sale for David and Alexis Massey.
3 Section 3. This Resolution will become effective immediately upon passage.
