O76-55 ORDINA~NCE NO. 76-55 AN ORDINANCE OF THE CITY (DF BOYNTON BEACH FLORIDA, AMEND- ING SEC. 24-10 (h) OF CHAPTER 24 OF THE CODIFIED ORDINANCES OF SAID CITY (BEING-THE BOYNTON BEACH SIGN ORDINANCE) TO ESTAB- LISH BASIS UPON WHICH COMMERCIAL ADVERTISING MATTER MAY BE DISTRIBUTED WITHIN THE CITY; PROVIDING FOR AUTHOHITY TO CODI- FY, SAVINGS CLAUSE, REPEALING PROVISION', AN EFFECTIVE DATE AND FOi{ OTHER PURPOSES: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Sec. 24-10 (h) of Chapter 24 of the Codified Ordinances of the City of B0ynton Beach, Florida, is hereby amended in'its entirety to read as follows: "Sec. 24-10. Certain signs or sign structures prohibited. From and after the effective date of this Chapter, it shall be unlawful for any person to erect, place or use within the City: (t%) Ail commercial advertising matter, including, but not limited to, circulars, throwaways, handbills, cards and vehicular signs as described in Section 24-3 (ii); provided, ho~ever, this prohibiiion shall not be construed to prevent the use, distribution or dissemination of such matter on a regular weekly, bi-weekly or monthly basis by a person or business duty licensed or registered with the City under Sections 15-1 or 15-2 of this Code." Secti_on 2: Authority Io Codify:. Specific authority is hereby granted to codi- and incorporate this Ordinance in the City's existing Code. Section 3: Separability:_ Each of the provisions of this Ordinance is separable including word, clause, phrase or sentence, and if any portion thereof shall be de- clared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 4: Repealing Provision: All ordinances of par~s of ordinances in ~onflict herewith are hereby repealed. Section 5: An Effective Date: This Ordinance shall become effective in the ~anner and at the time provided by law. First reading this ~' day of ~'~-g~/ , A. D. 1976.
