4 A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA
5 APPOINTING THE CITY COMMISSION AS THE GOVERNING
6 BODY OF THE BOYNTON BEACH COMMUNITY
7 REDEVELOPMENT AGENCY (CRA) AND THE MAYOR AND VICE
8 MAYOR THE CRA CHAIRPERSON AND VICE- CHAIRPERSON;
9 PROVIDING FOR AN EFFECTIVE DATE.

11 WHEREAS, On September 15, 2015, the City Commission of the City of
12 Boynton Beach, Florida, voted to designate itself to be the community redevelopment
13 agency of the City of Boynton Beach; and
14 WHEREAS, pursuant to Florida Statute 163.357, the governing body as an
15 alternative to the appointment of not fewer than five or more than seven members of the
16 agency, the governing body may, at the time of the adoption of a resolution under s.
17 163.355, or at any time thereafter by adoption of a resolution, declare itself to be an
18 agency, in which case all the rights, powers, duties, privileges, and immunities vested by
19 this part in an agency will be vested in the governing body of the county or municipality,
2 subject to all responsibilities and liabilities imposed or incurred; and
21 WHEREAS, the members of the governing body shall be the members of the
22 agency, but such members constitute the head of a legal entity, separate, distinct, and
23 independent from the governing body of the county or municipality; and
24 WHEREAS, if the governing body declares itself to be an agency which already
25 exists, the new agency is subject to all of the responsibilities and liabilities imposed or
26 incurred by the existing agency.
27 WHEREAS, the City Commission desires to conform the City's Code of
28 Ordinances to properly reflect that the City Commission constitutes the community

1 redevelopment agency.
2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
3 THE CITY OF BOYNTON BEACH, FLORIDA:
4 Section 1. That the foregoing "WHEREAS" clause is true and correct and hereby
5 ratified and confirmed by the City Commission.
6 Section 2. That the governing body of the community redevelopment agency shall
7 be the members of the City Commission and the Mayor shall be the Chairperson and the
8 Vice -Mayor the Vice Chairperson of the Board of the Community Redevelopment
9 Agency.
10 Section 3. This Resolution shall be effective immediately after adoption by the
11 City Commission.
12 PASSED AND ADOPTED this 6TH day of OCTOBER, 2015.
