O76-49 ORDINANCE NO. 76-49 AN ORDINANCE OF TIlE CITY OF BOYNTON BEACH, FLORIDA. AMEND- ING CHAPTER 29 (TRAFFIC) OF THE CODIFIED ORDINANCES OF SAID CITY TO ADD A NEW- SECTION 29.10, "SOLICITATION OF RIDES OR BUSINESS" TO PROIqIBIT HITCHHIKLNG WITHIN THE CITY AND PROVIDE A PENALTY FOR VIOLATION OF SAID SECTION; PROVIDING FURTHER FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVI- SION, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEI{EAS, Chapter 76-72, Laws of Florida, provides that a local governing authority may enact ordinances and erect signs which control, regulate or prohibif hitchhiking on any street or highway within its boundaries; and WHEREAS, the City of Boynton Beach, Florida, desires to prohibit hitchhiking on streets and highways within its mumcipal limits; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Chapter 29 (Traffic) of the Codified Ordinances of the City of Boynton Beach, Florida, is hereby amended to add a new section, which shall read as follows: "Sec. 29.10. Solicitation of rides or business. (a) It shall be unlawful for any person or persons to stand upon any sidewalk, street, avenue, alley or public highway or grounds within the limits of the City for the purpose of hitchhiking, "thumbing", re- questing, asking, or soliciting a ride from the operator of any vehicle. The provisions hereof shall not be construed to prevent a person from soliciting upon a public highway, or a driver of a vehicle from giving a ride where an emergency actually exists, nor to prevent s person from signaling or requesting transportation from a passenger carrier for the purpose of becoming a passenger thereon for hire. (b) No person shall stand in a roadway for the purpose of solicit- ing employment or business from the occupant of any vehicle. (c) Any person, firm or corporation convicted of violating the pro- wsions of this Section shall be punished by a fine not eXceeding Five Hundred Dollars ($500.00) or by ~mprisonment for a pemiod not exceeding six (6) months or both such fine and imprisonment, '~ Section 2: Authority to Codify: Specific authority is hereby granted to codi- fy and incorporate this Ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this Ordinance is separabl~ including word, clause, phrase or sentence, and if any portion thereof shall be de- clared invalid, the remaimng portion shall not be affected but shall remain in full force and effect. Section 4: Repealing Provision: All ordinances of parts Of ordinances in conflict herewith are hereby repealed. Section 5: An Effective Date: This Ordinance shall become effective in the manner and at the time provided by law. First reading this ~ day of , A. D. 1976.
