AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMEND-
ING SECTION 6 (D) (1) OF APPENDIX A, ZONING REGULATIONS, OF THE
CODiFIED ORDINANCES OF SAID CITY TO ADD A NEW PARAGRAPB lA
SETTING FORTH BASIS UPON WHICH CONDITIONAL USES MAY BE CON-
SIDERED AND GRANTED IN THE C-4 GENERAL COMMERCIAL DISTRICT;
FURTHER AMENDING SECTION 6 (C) (1) OF APPENDIX ~, ZONING REGU-
LATIONS, oF THE cODIFIED ORDINANCES OF SAID CI~ Y TO ADD' A NEW
SUBPARAGRAPH ,(t) PER~MITTING NEW BOAT SALES AC ENCIES AS A
CONDITIONAL USE AND ~DDING A NEW PARAGRAPH l~, SETTING FORTH
BASIS UPON WHICH CONDITIONAL USES WILL BE CON~ [DEl{ED AND
GRANTED,IN THE C-3 COMMUNITY COMMERCLAL DIST ~ICT; PROVIDING
FURTHER FOR A SAVINGS.CLAUSE, REPEALING~ROV~ ~IONS, AN EFFEC-
TIVE DATE AND FOR OTHER PI/RPOSES.
BE IT ORDAINED BY THE,CITY COUNCIL OF THE CITY OF BOYNTON BEACH,
FLORIDA:
Section i: That Section 6 (D) (1) of Appendix A, Zoning Regulations, of the
Codified Ordinances of the City of Boynton Beach, Florida, is hereby amended to
add a new paragraph lA in place of the language appearing following subparagraph
(v) of said Section, which paragraph shall read as follows:
"D. C-4 C-~neral commercial district.
1. Uses permitted.
v. Yachtels and boatels.
'IA. Conditional uses allowed. Those uses specified above which are
followed by an asterisk (*) shall be deemed to be conditional uses, which may be
considered and granted in accordance with the procedures set forth in Section tl.2
of Appendix A of the Code of Ordinances of the City of Boynton Beach, Florida.'"
Section 2: That Section 6 (C) (1) shall be amended to add a new subparagraph
(t) and a new paragraph lA, which shaR read as follows:
"C. C-3 Community commercial district.
!. Uses permitted.
't. New boat sales agencies.*
IA. Conditional uses allowed. Those uses specified above which are
bllowed by an asterisk (*) shall be deemed to be conditional uses, which may be
considered and g~anted in accordance with the procedures set forth in Section 11.2
of Appendix A of the Code of Ordinances of the City of Boynton Beach, Florida."1
Section 3: Authority to Codify:. Speci~c authority is h~reby granted to codi-
fy and incorporate this Ordinance in the City's existing Code.
Section 4: Separability: Each of the provisions of this Ordinance is separable,
ncluding- word~ Clause, phrase or sentence, and if any portion thereof shall he de-
lared invalid · the remaining portion shall not be affected but shall remain in full
force and effect.
Section 5: .. l{epealing provision: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section -8: An Effective Date: This Ordinance shall become effective in the
manner and at the time provided by law.
