O76-43 ORDINANCE NO. 76-43 AN ORDINANCE OF THE CITY OF BOY~TON BEACH, FLORIDA, A1VIEI'~DING SECTION 49 OF Ttt~ lki~O~NICIPAL CHARTER OF SAID CITY PROVIDING GE~RAL PRO- VISIONS REGARDING T~ ADMINISTRATION OF T~ CITY'S DEPART~NTS~ OFFICES qND AGEN~S, PURSUANT TO C~pTER 166 OF T~ F~RIDA STAT- ACT': PROVIDING FURT~R FOR AUT~0RI~ T© COD- BOYNTON ]~E~CH, ~LORIDA: section 1: Thkt Sec. 49 of Article I¥ of the Municipal Charter of the City of Boynton Beach, Florida, be and %he same is hereby amended to read as follows: "Sec. 49. General Provisions.. (a) Adminisi~ative officers, departments and agencies, The governmeni of %he city shall be carried on by the MIaypr and ciiy council, who shall appoint a city manager, city attorney, municipal judge, and such other officers, departments and agencies as may be established from time to iime by ordinance so perform ~uch duties and re- ceive such compensation as may be prescribed by reso- [uliQns adopted by the city council. All other officers of the city shall be appointed by the city manager, subject %o confirmation by the city council. (b~ Supervision by city manager, Each department, office and agency under the direction and supervision of the city manager shall be administered by an officer appointed by and subject to the direction and supervision of the ciiy man- ager. Wlih the consent of council, the city manager may serve at the head of one or more such departments, offices or agencies or may appoint one person as the head of two or mare of them or may combine %he functions of any officers specified in this charter which may be appointed by him. (c) Interference with administ~aiion. Except [or %he purpose of making formal investigations into [~le affairs of the city and the conduct of any city department, office or agency, the city council or its members shall deal with city officers and em- plSyees who are subject ~o the direction and supervision of the city manager sokely through the manager, and neither the · - ! i . such officer (d~ Penalty for vib[ation. Section 3: Separabikity.; Each of the provisions of this Ordinance is separable, including word, clause, phrase or sentence, and if any porlion thereof shall be declared invalid, the remaining portion shall not be affecled but shall remain in-full force and effecl. Section4: Repealing Provision: All ordinances or paris of ordinances in conflict herewith are hereby repealed.
