AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, A1VIENDING SECTIONS 2-21, 2-22 AND 2-26
OF ARTICLE III OF CHAPTER 2 OF THE CODIFIED
ORDINANCES OF SAID CITY, REGARDING THE AP-
POINTMENT, QUALIFICATIONS, COMPENSATION,

BE IT ORDAII~ED BY THE CITY COUNCIL OF THE CITY OF
~OYNTON,BEACH, FLORIDA:
Section~ 1: That Sec. 2-21 of Article III of Chapter 2 of the Codified
Drdinances of the City of Boynton Beach, Florida, is hereby amended to read
· s follows:
"Sec. 2-21. Appointment; qualifications; compensation.
Pursuant to the prowsions of Section 49 of the City Charter,
the city council shall by resolution appoint a city manager for
an indefinite term and fix his compensation. The manager
shall be appointed solely on [he basis of his exec,utive and ad-
ministrative qualifications. He need not be a resident of the
city or state at the time of his appoinlment but may reside
outside the city while in office only with the approval of
c6'nnci[.
Section 2: That Sec. 2-22 of Article III of Chapt~er 2 of the Codified
Drdinanees of the City of Boynton Beach, Florida, is hereby amended to read
as follows:
"Sec. 2-22. Temporary absence or disability.
By letter filed with the city clerk [he manager shall designate,
subject to approval of the council, a qualified city administra-
tive officer to exercise the powers and perform the duties of
manager during his temporary absence or disability. During
such absence or disability the council may revoke such desig-
nation at any time and appoint another officer of the city to
serve until the manager shah return or his disability shall
cease.
Section 3: That Sec. 2-26 of Article III of Chapter 2 of the Codified
~rdinances of the City of Boynton I~each, Florida, is hereby amended to read
as follows:
Sec. 2-26. Powers and duties.
The cit~ manager shah be the chief administrative officer of
the city~ and be responsible to the council for the administra-
tion of all city affairs placed in his charge under the city
charter, code o~ordinances or assigned to him by the city
council I~Ie shall have the power and duzy
(a) ~ppoint and when necessary for the good of the city,
suspend or remove all employees and appointive admin-
istrative officers of the city, except the city attorney,
municipal judge, or as otherwise provided by [aw, sub-
ject to the provisions of the Municipal Civil Service Merit
System. Further, he may authorize any administrative
officer who is subject to his direction amd supervision to
exercise th~se powers with respect to subordinates in that
officer's deparinient, office or agency.
(b) Recommend in his discretion, to the council the creation
of the position o~ assistant city rnana~ger or designate ~th %he

(c) Direct and s~pervise ~j administration of all depart-
_ments, officers and agencies of the ~ty, except as other-
wise provided by this charter or by [aw.
(d) See that all ordinances, prov~sions of this charter and
aczs of the council, subject to enfo~qement by him or by
officers subject to his direction and supervision, are faith-
fully executed.
(e) Prepare and submit %he annual budget and capita[ program
zo the council and be responsible for its administration after
adoption,.
(f) Prepare and submit to the council and make a-~ai[able to
the public a complete report on ~he finances and administra-
tive acli~zities of the city as of the end of each fiscal year.
(g) Make such other reports as the council may require con-
cerning the operations of the city departments, offices and
agencies subject to his direction and!supervision.
(h) Keep the council fully advised as to the financial condition
and future needs of the city and mak~ such recommendations
to the council concerning the affairs of the city as he deems
desirable.
(i) Perform such other duties as are specified in the city
charter or may ~e required by the city council.
Section 4: Authority zo Codify: Specific authority is hereby granted to
codify and incorporate this Ordinance [n the City's existing Code.
Seciion ~: Separability: Each of the provisions of this Ordinance is
separable, including word, clause, phrase or sentence, and if any portion
thereof shall be declared invalid, the remaining portion shall not be affected
but shall remai~i in full force and effect.

Section 7: An Effective DaTe: This Ordinance shah become effective
in lhe manner and al the time provided by Law.
