AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 6 (C) (1) (k) OF APPENDIX A OF T~IE
CODIFIED ORDINANCES OF SAID CITY TO ESTABLISH BUILD-
ING AND SITE REGULATIONS APPLICABLE TO MULTI-FAMILY
RESIDENTIAL DWELLINGS LOCATED IN TI~E C-3 COMMUNITY
COMMERCIAL DISTRICT; PROVIDING FOR AUTHORITY TO
CODIFY, SAVINGS CLAUSE ~ REFEALING PROMISIONS, AN
EFFECTIVE DATE AND FOR OTHER PUl{POSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTONBEACH,
FLORIDA:
Section 1: That Section 6 (C) (1) (k) of Appendix A of the Codified Ordinances
)f the City of Boynton, Beach, Florida, which presently reads as follows:
'~C. C-3 Community commercial district.
1. Uses permitted. Within any C-3 community commercial district, no
building, structure, land or water shall be used except for one or more of the
following uses:
k. r~ulti-family residential (upon recommendation of Planning and ZoninE
Board and approval of City Council) ."
os, and the same is hereby amended to read as follows:
"C. C-3 Community commercial district.
1 Uses permitted. Within any C-3 community commercial district, no
building, structure, land or water shall be used except for one or more of the
following uses:
k. Multi-family residential dwellings are authorized as a special use in
said district, subject to the building and site regulations set forth in Section
5 (G) (2) (a) of Appendix A of this Code."
Section 2: Authority to Codify: Specific authority is hereby granted to codi-
fy and incorporate this Ordinance in the City's existing Code.
Section 3: Separability: Each of the provisions of this Ordinance is separable
.ncluding word, clause, phrase or sentence, and if any portion thereof shall be de-
ciared invalid, tI%e remaining portion shall not be affected but shall remain in full
force and effect.
Section 4: Repealing Provision: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5: An Effective Date: This Ordinance shall become effective in the
manner and at the time provided by law.
