O76-32ORDINANCE NO. 76-32 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, SEPTEM- BER 7, 1976. FOR SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY THE DETERMINATION OF WHETHER: (1) SECTION 138 AND SEC- TION 139 OF THE CHARTER OF SAID CITY SHOULD BE AMENDED TO SECTION 15 AND TUESDAY IN' MAi{CH C!!kRTER OF ~ ON ~_ ~ 53 OF ~ OF 2ON- A~PRO- FION; PREAMBLE This Ordinanceis bein~g enacted in order to meet necessary publication and other administrative requirements which are prerequisite to submission of the aforementioned propositions to the qualified electors of the City on Tuesday, Septem- ber 7, 1976, and to enable the City of Boynton Beach, Florida, ~o improve the eco- nomy and efficiency of its municipal electoral system, to provide for increased conti- nuity and expertise in its elected ofzices, and to effectively plan for organized growttz and development within its boundaries, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: Call of Election. A special election is hereby called, to be held on the 7th day oi September, A. D. 1976, to determine whether or not any or all of the propositions set forth below shall be approved by the quali~ed electors of the City in the manner provided in the Constitution and the Statutes of the State of ] and the Charter of the City of Boynton Beach, Florida. Said Special Election shall be called by proclamation of the Mayor, and notice thereof shall be given by publica- tion of the eonten~s of this Ordinance in the Boynton Beach News Journal once a week for four (4) consecutive weeks, with the first publication to be at least thirty (30) days prior to said election. SECTION 2: Ballot. The City Council of the City of Boynton Beach. Florida~ does hereby certify to the Board of County Commissioners of Palm Beach County, Florida, and to the Honorable Jackie Winchester, Supervisor ef Elections of said County, that the propositions set forth below should be placed upon the ballot on the appropriate voting machines in the precincts of the City for said Special Election September 7, t976. The form of bailer to be used at said Special Election shall be in substantially the following form. PROPOSITION NO. 1: Should an Ordinance be adopted, effective ~mmediately, amending Section 138 md Section 139 of the Charter of the City of Boynton Beach, Florida, to eliminate municipal primary elections? FOR Proposition No. 1 PROPOSITION NO. 2: Should an Ordinance be adopted, to become effective immediately, amending Section 15 and Section 141 of the Charter of the City of Boyn~on Beach, Florida, chart ing the regular municipal election date from the first Tuesday in December each year to the second Tuesday in March of each year and altering the commencement date of terms of Councilmen from the first Monday in January following their election or on the first working day following the first Monday in January ~o the first Monday in 2 April following their election or on the first working day following the first Monday in April, with terms of Council Members who are presently serving being extended until their successors are elected and qualified under the pro¥isions of the Charter.? (If this Proposition is approved and Proposition No 1 is rejected, nominations for the offices of Mayor and/or Council Members shall be by primary election held two weeks prior to the second Tuesday in March each year and as otherwise provided in the existing Charier.) AGAINST Proposition No. 2 PROPOSITION NO. 3: Should an Ordinance be adopted amending Section 53 of the Charter of the City of Boynton Beach, Florida, establishin~ an independent election for the office of Mayor to serve for a three (3) year term, limiting the number of successive terms which a person may serve as Mayor to two (2) such terms, and providing that the Councilman receiving the highest number of votes in each general election shall be designated as Vice Mayor, to serve in such capacity £or one year, all beginning with the municipal election of 19787 FOR Proposition No. 3 I ! ! AGAINST Proposition No. 4 I PROPOSITION NO. 5: Should an Ordinance be adopted, effective immediately, amending Section 72.4 (a) of the Charter of the City of Boynton Beach, Florida, establishing staggered ;eras of three (3) years for each of the two members of th~ Civil Service Board who ~re appointed by the City Council, two (2) years for each of the two members of said Board who are elected at large by the City employees, and one (1) year for ~the mem- ber of said Board who ~s named by the other members thereof? I ' ' I _ O Proposition No. 5 [ AGAINST Proposition No. 5 PROPOSITION NO. 6: question: This is an expression of public opinion only on the following MUNICIPAL AUDITORIUM CONSTRUCTION Shall the City of Boynton Beach. Florida, immediately proceed to obtain cost estimates for the construction of a municipal auditorium with an approximate seating capacity of 2,500 on City-owned property located On S~uth Congress Avenue near West Winds Golf and Racquet Club, formerly known as Charter World, subject to final approval or rejection of such construction bY ~he voters at a subsequent City-wide .~eferendum. FOR Proposition No. 6 AGAINST Proposition No. 6 SECTION 3: Absentee voters. Computer election systems punch-card )allots shall be used in said election for absentee voters. FurV~her, the Palm Beach County Supervisor of Elections shall be requested to include the Propositions set forth in SECTION 2 above on all absentee ballots sent to electors in the several pre- ~.ncts of the City of Boynton Beach, Florida, which ballots shall include appropriate nstructions to each elector advising as to the procedure to be followed in voting "FOR'~ or "AGAINST'~ any or all of the aforesaid Propositions. SECTION 4: List of electors. All qualified electors of the City of Boynton Beach, Florida · shall be entitled to vote in said Special Election%. The Palm Beach County Supervisor of Elections shall furnish to the Inspectors and Clerks at each voting place the voter registration books containing the registration certificates of ali qualified electors, as provided in the general elections laws of the State of Florida. SECTION 5: Inspectors and Clerk of Election. The City Council,hereby re- quests the Board of County Commissioners of Palm Beach County, Florida· and the Honorable Jackie W~nchester, Supervisor of Elections of said County, to appoint for each election district of the City an appropriate number of Insl~ectors and a Clerk of Election to hold the Special Election in the several precincts of the City; and, further as soon as practical after tabulation of the election returns, to notify the City Clerk of the City of Boynton Beach, Florida, of the result of said Special Election on the approval or disapproval of the propositions outlined in Section 2 above, whereupon the City Council shall make and enter in their minutes a findin~ as to the total number of votes cast in said Special Election in favor of each of said Propositions and the ~otal number of votes cast against each of the Propositions. The polls shall be opened ~t 7:00 A .M t and close at ?: 00 P .M., and shall be located~ at, ~r as near as possibles used in the:last general municipal election. Said Special Elec- tion shall in all other respects be held in accordance with the General Election Laws of the State of Florida. SECTION 6: Separability. Each of the provisions of this Ordinance is separ- sble~ including word, clause, phrase or sentence, and if any portion hereof shall be declared invalid, the remaining portion shall not be affected, but shall remain in force and effect. SECTION 7: Repealing Provisions. All ordinances or parts of ordinances in herewith are hereby repealed. SECTION 8: Effective Date. This Ordinance shall become effective at the time and in the manner provided by law. First reading this 20th day of July , 1976.
