O76-31ORDINANCE NO. 76-31 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 23A-7 (c) OF CHAPTER 23A OF THECODIFtED ORDINANCES OF SAID CI%]f PERTAINl~¢G TO METHOD OF BILLING FOR SEWER SERVICE CHARGES; PROVIDING FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISIONs, AN EFFEC- TIVE DATE AND FOR OTRER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOiFNTON BEACH, FLORIDA: Section 1: That Section 23A-7 (c) of Chapter 23A of the Codified Ordinances ~f the City of Boynton Beach, Florida, which presently reads as follows: "Sec. 23A-7. Collection of service charge. (c) If any bills for-sewer service charges shall not be paid before the 30th day following the original date of billing, z charge equal to ten pen cent (10%) of the amount of such hill shall be added thereto, and if the amount of such sewer service charges shall not be paid within forty-five (45) days from the rendition of such bill, the City shall discontinue furnishing water to such premises and shall dis- connect the same from the waterworks system and shall proceed forthwith to recover the amount of such sewer service charges in such lawful manner as it may deem advisable. ,i be, and the same is hereby amended to read as follows: "Sec. 23A-7. Collection of service charge. (c) All bills for sewer service charges shall be either hand delivered to the customer monthly, or by way of the United States Postal Service, and shall be due v~hen rendered. If not paid within thirty (30) days of the original billing date, such sewer service charge shall be added to the next monthly bill and shown thereon as a delinquent item. Should the customer fail to pay said delinquent item immediately, the City may thereafter, an~d without further notice to the customer, disconnect the service, discon~ue furnishing water to such pre- mises, and, if the amount of the total bill exceeds the amount of the customer's water meter deposit, it may also disconnect such meter. Further, the City shall proceed forthwith to recover the amount due on said bill in such lawful manner as it may deem advisable." Section 2: Authority ~o Codify: Specific authority is hereby granted to codi- fy and incorporaze this Ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this Ordinance is separabl~ including word, clause, phrase or sentence, and if any portion thereof shall be deu clared invalid, the remaining portion shall not be affected but shall remain in full force and effect.
