AN ORDINANCE OF TILE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 5-2.1 OF CHAPTER 5 OF'THE CODIFIED ORDI-
NANCES OF SAID CITY (ALSO DESIGNATED AS SECTION 1 OF
ORDINANCE NO. 76-14) TO PROHIBIT THE LEAVING OF BUILDING
MATERIALS ON PROJECT SITES IN AN UNSAFE CONDITION OR FOR
A PERIOD LONGER THAN - 3 MONTHS FOLLO%VING COMPLETION OF
CONSTRUCTION AND FINAL INSPECTION OF WORK.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACIt,
'LORIDA:
Section 1: That Section 5-2.1 of Chapter 5 of the Codified Ordinances of the
City of Boynton Beach, Florida, (also designated as Section 1 of Ordinance No. 76-14
is hereby amended to add a subparagraph "(e)" to such section reading as follows:
"Sec. 5-2.1 Construction site maintenance; clean-up bond.
(e) It shall be unlawful for any person to leave materials on the project site,
during or upon completion of building construction or the making of additions,
alterations, or repairs thereto, in an unsecured, dangerous or unsafe condi-
tion, and ~inder no circumstances shall such materials be permitted to remain
on the project site for a period longer than ~ee months following completion
of construotion and final inspection of the work to be performed under the
building permit."
Section 2: .Authority to Codify: Specific authority is hereby granted to codi-
fy and incorporate this Ordinance in the City's existing Code.
Section 3: Separability: Each of the provisions of this Ordinance is separable
including word, Olause, phrase or sentence, and if any portion thereof shall be de-
clared invalid, the remaining portion shall not be affected but shall remain in full
force and effect.
Section 4: Repealing Provision: All ordinances or parts of ordinances ~n
~onflict herewith are hereby repealed.
Section 5: An Effective Date: This Ordinance shall become effective in the
manner and at the time provided by law.
