3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, REGARDING THE APPLICATION OF THE
5 BOYNTON BEACH COMMUNITY REDEVELOPMENT
6 AGENCY, AMENDING THE OFFICIAL ZONING MAP TO
REZONE A PARCEL OF LAND LOCATED BETWEEN NORTH
SEACREST BOULEVARD ON THE WEST, NORTHEAST 1ST
STREET ON THE EAST, NORTHEAST 7 AVENUE ON THE
1 C NORTH AND NORTHEAST 6 AVENUE ON THE SOUTH AS
11 MORE FULLY DESCRIBED HEREIN, FROM MULTI - FAMILY
12 RESIDENTIAL DISTRICT (R -3) TO MIXED USE LOW
1 S INTENSITY 2 DISTRICT (MU -L2); PROVIDING FOR
14 CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE.

16 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
1 ; adopted Ordinance No. 02 -013, in which a Revised Zoning Map was adopted for said City;
1 E and
1S WHEREAS, City staff has initiated a Petition at the request of the Boynton Beach
2 C CRA to rezoning a parcel of land more particularly described hereinafter; and
21 WHEREAS, the City Commission, following required notice, conducted a public
22 hearing to consider the rezoning and heard testimony and received evidence which the
2 Commission finds supports a rezoning for the property hereinafter described; and
2 4 WHEREAS, the City Commission finds that the proposed rezoning is consistent with
2 E the Land Use described in the City's Comprehensive Plan; and
2 E WHEREAS, the City Commission deems it in the best interests of the inhabitants of
2 said City to amend the aforesaid Revised Zoning Map as hereinafter set forth.
2 E NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
2 S THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

7 6 Section 3. That the Zoning Map of the City is amended to reflect this rezoning.
7 Section 4. All ordinances or parts of ordinances in conflict herewith are hereby
7 8 repealed.
7 9 Section 5. Should any section or provision of this Ordinance or any portion thereof be
8 0 declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
8 _ remainder of this Ordinance.
8 2 Section 6. This ordinance shall become effective immediately upon passage.
