Bock,CLERK R COMPTROLLER E'ss 1167 - 1169°s (3rssl 2 1,. .tA-P J .. .i `_ `--�..' �, tESOLUTION OF THE CITY OF BOYNTON CFI' aEgitiC / y:s; , FLORIDAASSESSING BEACH, FLORIDA ASSESSING THC COSTS OF 5 ABATEMENT OF CERTAIN NUISANCES 6 AGAINST THE OWNERS OF THE PROPERTIES 7 INVOLVED; AND PROVIDING AN EFFECTIVE 8 DATE. 9 10 11 12 WHEREAS, a contract vendor was requested by Code Compliance to mow the lots, 13 i remove vegetation and board up structures on the properties, described in Exhibit"A"; and 14 15 WHEREAS, the owners of the parcel(s) of property hereinafter described were 16 invoiced by the Finance Department in an effort to recoup these costs with no response; and 1 17 18 WHEREAS, said nuisance was not abated as required; and, 19 20 1 I WHEREAS, all of the property owners listed in the attached Exhibit "A" were sent 21 letters offering them an opportunity to remit within 30 days in order to avoid incurring a lien 22 on their property; and 23 24 WHEREAS, the City Manager or her authorized representative has made a report of 25 costs actually incurred by the City and abatement of said nuisance as to the property(s) 26 involved, which is described in Exhibit"A" attached to this Resolution; and 27 28 WHEREAS, upon passage of this Resolution, the property owners will be furnished 29 with a copy of this Resolution, and given one more opportunity to remit all costs associated 30 with the abatement in full within 30 days of the passage of the Resolution, before transmittal 1 31 to the County for recordation of Liens; and 32 33 34 , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 35 THE.CITY OF BOYNTON BEACH,FLORIDA AS FOLLOWS: 36 37 Section 1: Each Whereas clause set forth above is true and correct and 38 incorporated herein by this reference. 39 40 Section 2: The amount of costs incurred by the City and the abatement of the, 41 above-described nuisance as to the parcels of land, owned and indicated to wit: ^�_,, 42 (_,l 43 .� r- 44 SEE ATTACHED EXHIBIT "A" pi 45Zps;' cri- 46 ` -n CO a` tri cc." If any clause, section, or other part or application of this Resolution shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such I unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the validity of the remaining portions or applications remaining in full force and effect. Section 4. The City shall indemnify and hold harmless the members of the canvassing board in the event either or both are the subject of litigation arising from their duties as canvassing board members. Section 5. This Resolution shall become effective on passage.
