AN ORDINANCE OF TIlE CITY OF BOYNTON BEACt{, FLORIDA,
AMENDING SEC. 25B-8 (d) OF CHAPTER 25B OF TIlE CODIFIED
ORDINANCES OF SAID CITY TO PLACE RESPONSIBILITY FOR
INSTALLATION OF SAFETY ENCLOSURES AROUND SWIMMING
POOLS UPON OWNER OF RECORD; PROVIDING FOR AUTHORITY
TO CODIFY; PROVIDING FURTHER FOR A SAVINGS CLAUSE,
REPEALING PI{OVISIONS, AN EFFECTIVE DATE AND FOR
OTHER PURPOSES.
BE IT ORDAINED.BY T~E CITY COUNCIL OF THE CITY OF BOYNTON BEACH,
FLORIDA:
Section 1: That Sec. 25B~8 (d) of Chapter 25B of the Codified Ordinances of
the City of Boynton Beach, Florida, which presently reads as follows:
"(d) It shall be the responsibility of the owner and/or occupant of the
premises upon which the sv~mming pool has been constructed or
is hereafter erected to install and maintain and keep in safe con-
dition the safety enclosure required and erected in accordance
with this section."
)e, and the same is hereby, amended to read as follows:
"(d) It shall be the responsibility of the owner of record of the premi-
ses upon which the swimming pool has been constructed or is
herea~er erected to install and maintain and keep in safe condi-
tion the safety enclosure required and erected in accordance with
this section."
Section 2: Authority to Codify: Specific authority- is hereby granted to codif~
and incorporate ~his Ordinance in the City's existing Code, ,
Section 3; Separability: EaCh of the provisions of this Ordinance is separabl~
including word, clause, phrase or Sentence, and if any portion thereof shall be de-
clared invalid, the remaining portiGn shall not be affected but shall remain in full
force and effect~
Section 4: Repealing Provision: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5: An Effective Date: This Ordinance shall become effective in the
manner and at the time provided bylaw.
