FLORIDA, A1ViENDING SECTION 2~1 OF CHAPTER
2 OF THE CODIFIED ORDINANCES OF SAID CITY TO
DESIGNATE AND ESTABLISH THE MUNICIPAL PLAN-
NING AND ZONING BOARD AS TITE "LOCAL PLANNING
AGENCY" TO ACT IN BEHALF OF TI~E CITY OF

WHEREAS, [he Florida Staie Legislature has herezofore enacted
the "Local Government Comprehensive Planning Act of 1975", being section
163. 3161et seq. (Florida Statates 1975), and
~IER~AS, said Act requires each unit of local government to
designate and establish a "local planning agency" and to officially inform the
state planning agency and appropriate regional planning agency of such
designation; and
~FIEREAS, as a prerequisite To exercise authority under said AcT,
each municipality is required to adopt an appropriate ordinance declaring its
intent to do so; and
WHEREAS, the City of Boyn~on Beach, Florida, has heretofore
created a municipal planning and zoning board under the provisions of Sec.
2-41 of C~aapter 2 of the Codified Ordinances of said city, which board is
vested with certain duties and responsibilities, among them being the authorit
lo prepare, recommend, oversee and monitor the comprehensive planning for
the physical development of the City of Boyn~on Beach and to perfect and amen.

WHEREAS, the City of Boynton Beach, Florida, has heretofore
prepared and adopted a comprehensive plan for the control and order [y growth
the total area under its jurisdiction, which plan has been accepted and
approved by the Area Planning Board of Pahn Bea2h County, Florida, pursua~
to said Board's Resolution dated August 20, 1975;
NOV~, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section '[': The City of Boynton Beach, Florida, hereby declares
its intent to exercise authority under the "Locai Government Comprehensive
Planning Act of 1975" for the total area ander its jurisdicliori in accordance
with the provisions of section 153. 3161 et seq. (Florida Statutes 1975).
Section 2: Section 2~41 of Chapter 2 of the Codified Ordinances of
the City of Boynton Beach, Florida, be and is hereby amended to the extent
that the paragraph set fo~ be[ow sha[! be added to the existing section
immediately fo[[owin~ the last pamagraph thereof:
"The municipal planning and zoning board is hereby designated
and established as the "[ocah planning agency" to act in behalf
of the City of Boynton Beach, Florida, under lJae te~ms and
provision~ of the "Locai~ Government Comprehensive P[anmsg
Act of 1975", sectio~ 163. 3161 et seq. (Florida Statutes 1975),
having ~ae genera[ responsibility for the conduct of a compre-
hensive planning program and the preparation, supervision
and amendment of the comprehensive plan mr elements or
portions thereof applicable to the areas under the jurisdiction
of the city as provided ih said Act."
Section 3: The City Manager of the City of Boynton Beach, Florida
is hereby authorized and directed to dfficia[ly inform the Division of State
Planning and the Area Planning Board of Pain Beach County of the designation
of the municipal planning and zoning board as the 'local planning agency" to
act in behalf of the City of Boynton Beach, Florida, pursuant to Florida
Statutes section 163. 3174.
Section 4: Authority to Codify: Specific authority is hereby grante~
to codify and incorporate this ordinance to the City's existing code.
Section 5: Separability: Each of ~he provisions of this ordinance
are separable and iF any section, subsection, clause, phrase or portion of
this ordinance is for any reason held invalid by any Court of competent
jurisdiction, the remaining portions shall not be affected but shall remain in
fuji force and effect.
Section 6: Repealing Provisions: Ail ordinances or parts of
ordinances in conflict herewith are hereby repealed.
