O76-20ORDINANCE NO. 76-20 AN ORDINANCE OF ZHE 'CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTIONS 6(C)(2) AND 6(D)(2) OF APPENDIX A OF THE CODIFIED ORDINANCES OF SAID CITY TO PROHIBIT SALES BAZAAR - FAR1ViERS MARKETS, FLEA OR THIEVES MARtCETS, SWAP SHOPS AND TRADING [POSTS AS PERIVItSSABLE USES WITI-HN TIlE C-3 COMMUNITY COM1V~RCIAL DIS- TRICT AND C-4 GENERAL COM1VIE~CIAL DISTRICT; PROVIDING FURTttER FOR A SAVINGS CLAUSE, ~i~e~-IB~IJING PttOV%SIONS, AUTHORITY TO CODIFY, AN EFFECTIVE DA TE AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYN TON BEACH, FLORIDA: S ciion 1: Section 6(C),(2) of Appendix A of the Codified Ordinances of the City of Boynton Beach, Florida, which presently reads: '2. Uses Prohibited. Any residential use except as provided above. is hereby amended to read as follows: "2. Uses Prohibited. In adilition To those uses disqualified under the provisions of Subsection [1) above, the following uses are expressly prohibited in the C-3 Community commercial District: a. Any residential use except as provided in Subsection (1)(k) above. b. For the purpose of preventing misinterpretation and for emphasis, the terms "department store" and "shopping center" shall not be deemed to include the following operations or uses, which are specifically prohibited in this district: sales bazaar - farmers markets, flea or thieves markeis, swap shops and trading posts, which primarily involve the sa[e, exchange or marketing of produce, used goods, antiques, curios, or secondhand merchandise." Section 2: That Section 6(D)(2) of Appendix A of the Codified Ordinances of the City of Boynion Beach, Florida, which presently reads as follows: "2. Uses Prohibited: a. Any residential use. b. Exterior storage un[ess adequately screened.' is hereby amended to read as follows: "2. Uses Prohibited. [n addition to those uses disqualified under the provisions of Subsection (1) above, the following uses are expressly prohibited in a C-4 general commercial district: a. Any residential use. b. Exlerior storage unless adequately screened. c. For the purpose of preventing misinterpretation and for emphasis, the terms "department store" and "shopping center" shall not be deemed m include lke following operations or uses, which a~e specifically prohibited in this district: sales bazaar - farmers markets, fiea or-thieves markets, swap shops and trading pos~s, which primarily involve the sale, exchange or marketing 0fproduce, used goods, antiques, curios, or second- hand merchandise." Section '3: Authouity to C,0dif~: Specific authority'is hereby granted To codify and incorporate this Ordinance in the Ciiy's existing Code. Secfion 4: Separability: Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if.any p~rtion thereof s~_all be declared invalid, the remaining portion shah not be affected but shall remain in full force and effect. Section 5: Repealing Provisions: All ordinances or paris of ordinances in conflicl herewith are hereby repealed.
