O76-14ORDIN3~NCE NO. 76-14 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 5-2.1 OF CHAPTER 5 OF THE CODIFIED ORDINANCES OF SAiD CITY TO REQUIRE A .~ CLEAN-UP BOND PRIOR TO THE' ISSUAN~:~OF ~ BUILDING PERMIT FOR CERTAIN TYPES OF CONSTRUCTION; PROVIDING FOR AUTHORITY T¢' CODIFY, SAVINGS CLAUSE, REPEALING PROVZSIONS, AN EFFECTIVE DATE AND FOR OTHER PURP©~ES'. WHEREAS, the City Council of the City of Boynton Beach, Florida, deems it necessary and advisable for the general welfare of the inhabitants and citizens of said City to require the posting of a bond to insure that property within the City is properly cleaned up upon completion of work performed under building permits issued by said City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Section 5~2.1 of Chapter 5 of the Codified Ordinances of the City of Boynton Beach, Florida, is hereby amended to read as follows: "Sec. 5-2.1 Construction site maintenance; clean-up bond. (a) Ail construction sites shall be maintained in a clean, sanitary and litter-free condition at all times. Each construction site shall be provided with a sufficient number of approved refuse containers to accommodate the daily accumulation of trash and debris during the interval between scheduled removal of said trash and construction debris from the project site. The number and type of refuse containers shall be sub- ~e~t to the approval of the building official or deputy ~ilding official. (b) During the construction phase the building official may, at his diScretion, suspend work or '~red 5ag" a construction-project for failure to maintain the construction site in a clean, orderly, sanitary and litter-free condition. (c] To ensure that construction pro~ect sites are properly cleaned to the satisfaction of the building official upon completion of the project, applicants for a building permit for new structures and alterations to existing, structures exceeding ~J~00.00 in value, shall post a cash bond in the following amounts p~ior to being issued a building ~permit: Single and duplex-family dwellings ............. Section 3: Separability: Each of the provzslons of this Ordinance are separable, including word· clause, phrase or sen- tence~ and if ~ny portion thereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. of Section 4: Repealing Provisions: Ail Ordinances or parts Ordinances in conflict herewith are hereby repealed.
