BE IT ORDAINED BY THE CITY OF BOYNTON BEACH, FLORIDA: Section l: That Section 30E-32(H) (5) of Chapter 30B of the Codified Ordinances Of the City of Boynton Beach, Florida, be and is hereby amended to read as follows: '(5) O~nership. Ail portions of a sewerage or water system extension project located in a public right-of-way, city-owned proper~Lv, or a pubtic easement shall, upon installation, become the p~operty of the city, and the fili~, g of an application for approval of construction of such a project by~a property owner shall be ,deemed to be consent to such transfer of ownership. The property owner shall execute and deliver to the city such deeds or i)ther evidences of ownership as the city may require; provided, however, that no consideration shall be authorized to be giyer_ bY the City to such property owner for the execution and delivery to the ~ity of such deeds or other evidences of of ownership unless such consideration is first approved by the City Coumcil." Section 2: That Section 30B-32(I) (1) (b) 2c of Chapter 30B of the codified ordinances of the City of Boynton Beach, Florida, be and is hereby amended as follows: 'c. Wilh respect to property having existing septic tanks whose owners have granted and conveyed easements to the · tC~i~y ffor.;ihe~p.ny~: pose;~of, th,~a~41~d~ent;se~r-e~pansion project which is numbered 6858- Sm, HUD ~WS- FLA2 S1; provided however, that no additional consideration shall be althorized to be given by the City to such property owner for the grant and conveyance of easements to the City unless such, addifional consideration is first approved by the City Council. Section 3. Authority to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 4.. Separability: ~ach of the provisions of ibis Ordinance are separable, including word, clause, phrase or sentence, and if any portion ihereof shall be declared invalid, the remaining portion shall not be affected and shall remain in full force and effect. SectiQn 5. Repealing Provisions: All ordinances or parts of ordinances in c0nfhet~herewith are hereby repealed. Section 6. An Effective Date: This Ordinance shall become effective in the manner and at the time as provided by law. 1976. First reading this ~ day of February, 1976.
