INCLUSIVE, AND BY REPEALINGCERTAIN PORTIONS '~HEP~oF; FURTHER PROVIDi~G FOR S~VINGS CLAUSE, RE~EALIN~ PROVISIONS, ~U~HORITY TO CODIFY, ~N EFFECTI~ DATE ~ND FOR OTHER PURPOSES. BOYNTON BE IT ORDAINED~Y T~E CIT~ COUNCIL OF THE CITY OF BEACH, FLO~IDA~ Section t: That Section 9-61 of Chapter 9 of the Codified Ordinances of the City of Boynton Beach, Florida, be and is hereby repealed. Section 2: That Section 9-62 of Chapter 9 of the Codified Ordinances of said City be and is hereby amended by amending the section number to be re-numbered as"Section 9-61" and ho be further amended to read as follows: "Sec. 9-61. Manner of construction and installation. Antenna systems and the installations thereof shall meet the following requirements: (a) Antenna systems must be made of noncorrosive material and must be consistent with th~ standards of the Underwriters' Laboratories, Inc., in accordance with the current issue of such standards, except as f/ae same are herein specifically varied- Antenna systems installed on roof tops must be mounte~ on their own~platform or plate covering tw~ or more rafters oz the roof and securely anchored. (b) Antenna systems must be adequately grounded for protection against a direct stro~e of l~ghtning with the ~roper ground wire as specified mn the ~aterial list. No such system may be mounted so as to project over any street, sidewalk, alley or public thoroughfare or in such a manner as might,be a hazard to safety in periods of hurricane winds. (c) Towers or mast supports constructed ~f a single pipe or series of lengths of ~iDe teles~opea shall require guy wires at each joint~or at such points as are considered to be adequate for support, within the concepts om accepted, engineering practices. (d) Towers of .fabricated construction shall be erected secured and guyed as n~cessary ~o conform with the requirements of the Building Code of the City of Boynton Beach. (e) Anchor points for guy wires must be secured to withstand a strain of at least 600 pounds per guy wire, rawl plugs may not be used for anchor p6ints. Turnbuckles ~ust be protected against turning by threading and guy ~ire through the t~nbuckle or by o~her similar locking device. ( ) The antenn~ s~stem shall be so designed and erected, as to confor~ wih~ the wind preSsUre require- ments o~ the buildin~ co~e~of~ the city. (m) The current issue o.z the National Electric Code is h~reby adopted and approved as a par~~ of this chapter as a mlnmmum standard for any item not .pecifically covered hereby. (n) The antenna system must fully co ~ply with any pertinent regulations of the Civil Aero~.autics Authority or the Federal Connnun!cations Co~missmo~." Sec't~on 3. That Section 9-63 of Chapte~ 9 of the Codified Ordinances~ of said City be and is hereby! amended by being re-numbered as "Section 9-62" -2- Section 4: That Section 9-64 entitled "Permits and Inspection Fees" of Chapter 9 of the Codified Ordinances of said City be and is hereby repealed. Section 5: That Section 9-65 entitled "Television Antenna Permits; Life of" of Chapter 9 of the Codified Ordinances of said Cit~ be and is hereby repealed. ~ection 6: That Section 9=66 of Chapter 9 of the Codified Ordinances of said City be and is hereby amended by being re-numbered as "Section 9-63" and to be further amended to read as follows: ~'Sec. 9-63. Right of city to make reinspections and to require repairs or alterations. Nothing herein contained, nor the fact that any person has theretofore obtained a certificate of approval, sh~lt be construed to preven~ the city, through its duly authorized inspectors, from inspecting any antenna system in use in such City in qrder to ascertain whether or not the same continues to r~main in a safe condition and in compliance wit~ this qhapter. In case any condition is foRnd, which might result in danger to life or proper~y, or a violation~ of any pr~vision of this chapter, the.building department of such city-is authorized't~ give writ~ no%ice to the owner or operator of such antenna a~ h~s~last known address, pointing out suQh conditions ~nd requiring the correction of same within twenty-f~ve (25) days from the date of such no~ice. If s~eh conditions are not corrected within such time, the~ma~ntenance in place thereafter or any $~ch defective installation by the owner or user thereof, shall be-unlawful." Section 7: That Sections 9-67 and. 9-~68 of Chapter 9 of the Codified Ordinances of said City be and are hereby repealed. Section 8. Separability: Each of the rovisions of this Ordinance are separable, including word, lause, phrase or sentence, and if any portion thereof shall e declared invalid, the remaining portion shall not beTaf ected but shall remain in full force and effect. Section 9. Repealing Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. -3- Section :t0. ~tho'~ityto Codify: Specific authority is hereby granted to codify and incorporate th~s! Ordinance in the City's existing Code. Section 11. An' Effective Date: This Ordinance shall become effective in the manner a~d at the time provided in the Charter and Ordinances of the City of Boyn~on Beach, Florida.
