17 WHEREAS, Shawn 'Lago, Applicant and Homeowner is requesting the City
18 abandon a portion of a ten (10) foot wide utility easement located to the rear of the
19 residence located at 2731 SW 23 Cranbrook Drive, to allow construction of a private
20 swimming pool, subject to staff comments; and

22 WHEREAS, comments have been solicited from the appropriate City
23 Departments, and public hearings have been previously held before the City's Planning &
24 Development Board, and the City Commission on the proposed abandonments; and

26 WHEREAS, staff finds that a portion of the ten (10) foot wide utility easement no
27 longer serves a public purpose, and the City Commission adopts that finding.

29 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
