R01-281RESOLUTION NO. R01- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, ACCEPTING A PROPOSAL BY REAPPORTIONMENT 2000, L.L.C. TO PROVDE TECHNICAL AND LEGAL SUPPORIT TO IMPLEMENT LEGALLY ENFORCEABLE REDISTRICING PLANS. BASED ON THE 2000 CENSUS; AND PROVIDING AN EFFECTIVE DATE. WIIEREAS, pursuant to Article II of the City Charter, Section 17(0, Geographic boundaries for each voting district shall be designated, prepared and identified not later than January {2002}; and WItEREAS, upon recommendation of staff, the City Commission deems it appropriate to accept the proposal of Reapportionment Group 2000. L.L.C., as outlined in the Scope of Work, attached hereto as Exhibit "A", to provide technical and legal support needed to implement legally enforceable redistricting plans, based on the 200¢ Census. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF TIlE CITY OF BOYNTON BEACII, FLORIDA, TItAT: Section 1. The City Commission of the City of Boymon Beach, Florida does hereby accept the Proposal of Reapportionment Group 2000, L.L.C., m an hourly rate of $150.00 per hoar, to provide technical and legal support needec~ to implement legally enforceable redistricting plans, based on the 2000 Census. The Commission also approves travel and expenses associated with this project in an amount not to ~xceed $3,000. Geographic boundaries for each voting district shall be designated, prepared and identified not later than the first day of January. 2002. and every four (4) year thereafter by contract to the City of Boynton Beach with a four (4) year college or university or educational research institution located within the State of Florida to be selected by the City Commission of the City of Boynton Beach, Florida...." Professor Lance deHaven-Smith, Ph.D., Florida State University, and Reapportionment Group 2000, L.L.C., propose to assist the City Of Boynton Beach Department of Development in preparing redSstricting options for the City of Boynton Beach City Commission. Narrative Description of TaSks The scope of work involves a series of tasks set to begin in October 2001 and end in January 2002. Each task is described below. 1. Establishing the Redistricting Criteria It is understood that the City of Boynton Beach Commission has agreed to use the follo~wing criteria to gide the redistricting process: To the extent pl'actical with existing precinct boundaries, achieve population equ,Ility among the districts. ~' Adhere to Sectipn 2 of the Voting Rights Act of 1965, as amended and interpreted through~ case law. ~' Follow major natural and manmade boundaries. } Maintain integrity of communities of interest, including municipal boundaries. } Insure compactness and contiguous districts. ~' Preserve the core of the existing voter districts. 2. Data Collection Will acquire both the geographic and attribute information to support the redistricting analysis. The required redistricting data have three (3) mmn elements: geographic, demographic, and voting registration/election data. (1) Demographic Profiling Information ~' 2000 U.S. Census Population Data (Public Law 94-171 Redistricting Data. Universe: Total Population). Soume: U.S. Census Bureau 2000 U.S. Census Population Data for Racial/Ethnic Background (Public Law 94-171 Redistricting Data. Universe: Population of two or more races). Source: U.S. Census Bureau (2) Voter Registration and Election Information - In cooperation with the Palm Beach County Supervisor of Elections, the City of Boynton Beach Department of Development and Professor Lance deHaven-Smith and ReapportiOnment Group 2000, L.L.C. will obtain the most current Voter Registration information (gender, party affiliation, and racial composition) as well as election information from two previous elections as identified by City of Boynton Beach Department of Development for the purpose of analyzing voter turnout. It is imperative that the voter registration and election information be provided at the precinct level (requiting that the dataset include the individual precinct number as well as the demographic information). ~' Current voter Registration Data at the Precinct-Level: InfOrmation would include total registered voters, gender, racial and/or ethnic composition, and party affiliation. Source: Florida Legislature, Florida Redistricting Election Data Set (FREDS). Format: dBase. } Previous election information would include total number Of registered voters by precinct who turned out for two elections as well as demographic information about the voter such as gender, racial composition, and party affiliation. Source: FREDS. Format: dBase. Estimated Timeframe: October 1, 2001 -October 5, 2001 e Data Integration to Generate Existing District Map and Support Maps Professor Lance deHaven-Smith, PhD will integrate both the' demographic and voting information with GIS maps of the City of Boymon Beach. The map layers will include precinct boundaries, census block query boundaries, roads and streets, and other geographic information. At a minimum, the following maps will be developed using this information: P Map depicting Total Population Totals and Percentages by Existing Districts. P Map depicting Racial Ethnic Composition Totals and Percentages by Existing Districts. P Map depicting Racial/Ethnic Composition Totals and Percentages at Census Block Group Level. ~ Map depicting Number of Registered Voters in each Existing District ~ Map depicting Party Affiliation by Voting Precinct ~ Map depicting Voting Turnout for past elections. 3 Professor deHaven-Smith is free to develop any additional maps that in his judgment are pertinent to the redistrict Estimated Timeframe: October 5. 2001 - October 19, 2001 Meet With City Commissioners In cooperation with Reapportionment Group 2000, L.L.C., Dr. deHaven-Smith will meet with each Comrmssioner to identify and discuss concerns regarding the redistricting process. The format and schedule of the meetings will be based upon the following: Pre-Planning Meeting: · Draft Review of Options Meeting: · Final Review of Options Meeting: Prepare and Present the Redistricting Option Maps to the City Commission Dr. deHaven-Smith will prepare and present several redistricting c~ptions to thc Boynton Beach City Commission for review and comments. Eacl~/Commissioner will be provided with a redistricting packet containing the following/items: ~' Map overlay of Proposed District Boundaries, Major Road~vays.~ and voting Precincts within the Districts. ~' Racial/Ethnic Composition totals and Percentages by Proposed Districts. ~ Table depicting voter-related information, such as number ~f registered voters per district, racial/ethnic composition of registered uoters total registered voters, and party affiliation assigned to in each proposed option will be provided only for redistricting options. Estimated Timeframe: October 17, 2001 - November 7, 2001 6. Estimated Timeframe: November 7, 2001 - November 21, ~001 Presentation of the Final Version of the Redistricting Option Map(s) Based upon the comments and recommendations received from th~ Boymon Beach City Commissioners, Dr. deHaven-Smith will present the final version of the Redistricting Options for final approval by thc Commission. Reapportionment Group 2000, L.L.C. will be in attendance to provide legal counsel. PDF format for dissemination to public and other interested partie~. Dr. deHaven- Snnth will provide the ArcVtew GIS files to Boynton Beach GIS for its use in disseminating information to the public Estimated Timeframe: November 21, 2001 -December 7, 2001 Submittal of Redistricting Map Approved by the City and Narrative Information Regarding District Boundaries ~' Dr, deHavin-Smith will provide approved redistricting option to Reapportionment Group 2000, L.L.C. and Reapportionment Group 2000, L.L.C. will develop the legal narratives of each district boundaries. ~' In the event that an outside party's map is approved, Dr. deHaven-Smith will develop the map in ArcView GIS format. } It is the responsibility of the outside party to provide the boundary narratives to the City, Of Boynton Beach Department of Development. Estimated Timeframe: No later than January 1, 2002 but preferably by December 25, 2001. Invoicing All materials and data files developed for the City under this agreement shall become the sole property of the City and shall be available to the City. Invoice for initial payment shall be sent to the Finance Director at City Hall for service rendered through the point of submission of boundary configurations to the appropriate city office or staff. Invoice for final payment shall be sent to the Finance Director at City Hall upon completion of the project. Completion shall be defined to mean the time when a Final Report has been made to the City Commission. Supplemental Scope of Work for Reapportionment Group 2000, L.L.C. Provide ail the technical and legal support needed to implement legally enforceable redistricting plans after the 2000 census data i~ released. ~ All work is done in strict conformity with the generally accepted/standards set forth in the U.S. constitution, the Voting Rights Act, applicable state law, and the controlling federal and state court opinions. ~ Will attempt to identify and divert potential problems and controversies that may surface during the redistricting of the City Of Bo~nton Beach. P The City will have to comply with applicable state and federalf laws as well as traditional redistricting criteria. ~ The 2000 census projections indicate that there has been a~ increase in the overall population of the City Of Boynton Beach since the ~t990 census that is not reflected in the current district election plan. The impact of the post-2000 plan on minority voting strength should be an issue of prominent concern for those involved in this process. P The statutory requirements for enactment of redistricting plans by the City Commission include formal public hearings. ~ Will develop the legal description of the boundaries of each district of the plan that is adopted by the Commission in suitable format. ~ For services provided, the City Of Boynton Beach will be ¢ barged $150.00 per hour with travel and expenses not to exceed $2 000.00. I am indeed available for the project and would look forward to developing a contract between the City and Flodda State University for this purpose. Although it usually takes a couple of weeks to process a research proposal through the University, I am prepared to go ahead and begin work while the paperwork is going through channels, which would allow {he redistricting to be completed in aabout two months. The services I would suggest for your consideration include: [1) Qbtaining the state's redistricting software and data for use in Boynton beach; (2) Preparing a Geographic Information System (GIS) map of Boynton's existing eiection districts to be incorporated as a map layer into the state's redistricting software package; (3) Determining the range of population variation across these districts, plus the demographic and political characteristics of each district; (4) Attending and participating in a City Commission workshop to discuss the Comn lission's concerns and priorities for the redistricting, and to consider possi[ ,le alternative redistrict ng strateg es; (5) Deve op nga draft proposed redistdctil ~g plan, to include detai~ed demographic and political profiles of each distdct (6) Attending and participating in a Commission workshop to solicit feedback al ~d direction on the draft redistricting plan; and (7) Developing a final proposed re Jistricting plan, to again include detailed demographic and political profiles of each district. Court rulings and state and federal legislation require that redistricting be based on total population, not on voting age population, registered voters, or other categories of residents,( However, in addition to balancing districts by population redistricting can and should a so be sensitive to what are referred to as "communities of interest," which, depending on local cimumstances, might include racial and ethnic factors, neighborhood boundaries, partisan affiliation, and other considerations.~)Therefore, when judging alternative redistricting plans. Commissioners need to know how districts with comparable numbers of residents compare in terms of various communities of interest. T( the profiles mentioned in (1) and (2) above would be distdct totals percentages on at least the following variables for the years 2000 Total population; single-race white population; non-Hispanic black non-black Hispanic population;registered Republicans; registered registered Independents; total registered voters; male population; population; and population by age group. Also included would be each district for the presidential elections of 2000, 1996, and 1992 gubernatorial elections of 1998 and 1994. ward this end, and and 1990: population; Democrats; female voting data on and the 1 (~ould provide these services for a fixed fee of $9,800. A fixed fee means that we would not separately budget for travel expenses, materials pe~'sonne overhead, etc., but would sit'ply set this as a fiat fee for the products, payable upon project completion. Th s Would m n mize red tape and allow us to proceed quickly; while also protecting the interests of the City by making payment contingent on product delivery. As I am sure you kno~, state law ~;llows state agencies and local governments to enter into sole-source contracts with state universities. If this framework for a contract meets your basic expectations, I can go ahead and start working while we finalize the details and process the necessary paperwork.
