Director of Public Safety, Tallahassee, which was in answer

Mr~ Collins presented a report on the study he had made con-
cerning revenue from the Sanitation Department for the month
of December 1967, stating the department actually lost
$800.00 during the month°

Mr. Walter Madsen, 214 N. E. 14th'Avenue advi~e~ the City
Council that the members of the Shuffleboard Club would be
willing to contribute $300.00 of their funds, fbr the in-
stallation of lights at the Shuffleboard Court, and Mr.
Summers would donate his time toward the labor costs.

Discussion followed.
Mr. Summers questioned the legality of donating the labor
inasmuch as he is a member of the Council. The City Attor-
ney assured him this was in order.
Mr°Summers made a motion that Mr. Court_ney loca~e the
$200.0~ for these lights~ to be used by the Shuffleboard
Court so they may complete the work proposed. Mro Gallo
seconded. Unanimously carried°

LEGAL:
Ordinance 68-2 - Creating Position of City Prosecutor
(2nd Reading):
The Citp Attorney read Ordinance 68-2 by caption only,
Mr. Gallo moved we accept this Ordinance on 2nd reading.
Mr° Nylund seconded.
Mr. Collins stated that he had been checking the court
records and he did not believe the court takes in enough
revenue at this time, to warrant the hiring of a Prosecuting
Attorney.

The City Attorney read Ordinance 68-3, which was to be
effective immediately on passage.

Mayor Michael questioned why a penalty clause was necessary
in this Ordinance when other ordinances in the Code did
not have them.
The City Attorney explained that the Code had a catch all
penalty section, but the original ordinance had a penalty
clause.
~Lr. Gallo moved that Ordinance 68-3 be approved. Seconded
by Mri Nylund. Unanimously carried.
Select Attorney to Represent the City in Palm Beach Memorial
Park Litigation:
The firm of Humphrey and Fruda, Attorneys at Law, had been
approached to handle this matter for the City. ~ayor Michael
read a letter received from Mr. Fruda in which he declined
the offer "due to the work load of his office" and suggested
the City Council contact Mro Irwin Langbein of West Palm
Beach.
Mayor Michael questioned the Council ~s to whet~er ~r not
they were willing to follow Mr° Fruda s recommendatmon.
Discussion followed.
Mr. Summers made a motion that Mr. Courtney contact Mr. Lang-
being and discuss this matter with him, and it be tabled for
the next Workshop at which time Mr. Courtney will have his
report ready. Mr. Collins seconded. Motion carried 4 to 1,
Mr. Gallo dissenting.
Consider Ame,ndinq Ordinance 67-6 -
Sewer Connection Charges:
Mr. Courtney explained the Ordinance we now hav~
some difficulty in the Building Department as w~
able to establish a uniform charge for sewer co~

should consider amending this Ordinance so the ~

Mayor Michael asked the City Manager if the pre~ent Ordi-

City Manager stated that he dmd not know since he was not
with the City at that time, and had not checked the records.

Mr. Summers que.stioned whether or not the bonding company
would be satisfied if the ordinance was now changed.
Mr. Moore advised that the City has a broad discretion as
to the type of charge they-'{~ould like to make, and Bache and
Co., would not have a say'in-the matter.
Mr. Galt=' pointed out that this w?.uld be the third change
in the Ordinance and wondered why it was changed from a
flat fee, as originally presented. Due to the irregularity
in the size of lots in the'City, in his opinion, the front
footage charge is unfair and d~es present a financial hard-
ship to many citizens, to tie into the sewer, under the pre-
sent lawo
Mr. Summers moved that a study be made by Fir. CoUrtney~ and
Mr. ~opkins and after they present their recomme~dations~
some changes should be made in the present Ordinance.
Seconded by Mr. Gatlo. Motion carried 4~1, Mayor Michael
being the dissentinq vote.
ADMINISTRATIVE:
~onsider Request of Palm Beach county Welfare Department:
~lr. Courtney explained that space was needed in the City by
this organization to carry on their work. ~is s~ace would
be needed for 2 hours every other Friday with a phone avail-
able.
Mr. Nylund moved that we allow them to use the ~
Room of the Civic Center every other Friday, be~
hours of 9:30 A.M. to 11:30 A.M. and provide a t,
this purpose. Mr. Collins seconded.

Consider Request of Chamber of Commerce - Use of
Mayor Michael read the letter received from the ~amber of
Commerce in which they requestedpermission to use the
Civic Center and outside areas, on February 28-29 and March
1-2, 1968~ for Festival '68, am~ to have the rental fees
waived, worthwhile endeavor.

Use of Civic Center:
Mayor Michael read the letter received from the Boynton
Beach Junior Woman's Club in which they request ~ermission
to use the Civic Center for a Pepsi Party to be held on Sun-
day, February llth at 2:00 P.M. in order to officially pre-
sent the entrants in the Miss B0!rnton Beach Pageant. It was
alos requested the usual rental fees be waived,
F~r. Gallo made a motion to grant this request and walve the
usual rental fee. Mr. Summers seconded. Unanimously carried.

Mayor Michael read the letter received from Mr. John Morey
requesting the extension of closing hours for the local bars.
Mr. Summers thought it would be best to first hear the opin-
ions from the audience.
Mayor Michael asked those who were in favor of this issue to
come forward.
Paul H. Jones of 121 S. W. 4th Avenue felt the bars should
be able to extend their hours as most places an Palm Beach
County do have a 5 A. M. closing.
Paul Johnson, owner of the Town Tavern at 512 N.Federal Hwy.
felt this issue should be postponed, since he was of the
opinion the bar owners in the City were not aware of this
action, and they should be so advised.
Mayor Michael asked those in the audience who were against
this issue to come forward.
Rev. Douglas Smith, 625 Hillcrest came forward, and remarked
that this was not an easy issue on which to make a decision
but he did feel there is a morale and social issue involved.
He considered the hours from 12 Noon to 3 A.M. as adequate.
Mayor F~chael expressed the opinion that first of all, he
believes that when a man is in business, if he f~els his
business should remain open 24 hours a day, it should be his
right to do so, and secondly, will not go along With the con-
tention that the two hours involved here, will make such a
tremendous difference an a man's morales or ethics.

Mr. Collins stated that he wondered why the Cit~ Council
must be faced with this "hot potato" every year whereas
the Beverage Department could set uniform hours for the
entire County, and questioned h~ this could be done.
Mr. Summers thought that perhaps the City should pursue this
area, and have the County "show the way"
Fir. Summers made a motion to table this issue until such time
as all facets could be studied and recommendations could be
made atthe next Regular Council Meeting. Mr. Nylund second-
ed. Motion carried 4-1, Mayor Michael opposed.
,Consider Request of American Cancer Society to Solicit:
Mayor Michael explained the receipt of Application to Soli-
cit, for the week of March 11-23, 1968.
Mr. Gallo moved that we grant this request. Mr. Nylund
seconded. Unanimously carried.

Annexation:
Mr. Nylund stated that he wondered if there was any progress
being made on Annexation.
Mayor Michael explained this issue had been presented to the
Palm Beach County Delegation Clinic, and the Legislature
would be considering local bills this week while in Session.
Mr. Courtney stated that he had contacted Rep. Robert
De Young's Secretary, and left a message for bk. De Young,
who is Chairman, to take our Annexation problem before the
Palm Beach Delegation if at all possible.
There being no further business, Mr. Summers moved the
meeting be adjourned. Mr. Gallo seconded. Unanimously carried.
