Minutes 10-02-67MINUTES OF REGULAR MEETING OF THE CITY COHNCIL~ CITY OF BOYNTON~ BEACH, HELD MONDAY~ OCTOBER 2, 1967 AT 7:30 P.M. PRESENT: Michael V. PLichael, Mayor Thomas A. Summers, Vice Mayor Leonard Nytund, Councilman Gilbert Coll~ns, Councilman A. Wi]lard Thrash the First Ba. ptist Church. Flag salute was led by ~. Grad. y.Courtney City Manager. The Council recognized representatives from Civic Organ- izations as follows: Cess Farmar, ChambeD of Commerce; Chester Penney~ representing Boating interests and Allen Nyquist f~om the Civit~ns, ~ir, Ny!und moved that the minutes of the Regular Meeting of September 18th be accepted. Seconded by Mr. Worreil. ~nanimously carried. Mr. Summers moved that the minutes of the Special Meetin~ of Septem- ber 27th be accepted~ SecOnded by ~. Nylund. Rnanimously carried. OLD BHSINESS Mr. Grady Courtney, City Manager read letter regarding the resignation of Robert J. Richardson, Supt. of Public Works Department. ~ir. Nylund moved that we accept the resignation of Mr. Richardson. Seconded by Mr. Collins. Llnanimously carried. Mr. Summers advised that he received a petition from the neighboring residents opposing the Rifle Range and that he was turning it over to the City Clerk. BIDS - OPENING 1. Traffic Control Signals The City Clerk opened and read the following bids: a. Count Down Traffic Control, Inc., Dayton, Ohio - 84,755.00 b. Control Specialists, Orlando, Fla., $2:678.00 Pit. Nylund moved that these bids be ~urned over to the tabulating Committee. Seconded by Mr. Worrell. Hnanimously carried. Spec/al Insurance The Mayor advised that Nationwide Insurance Company was low bidder, and the Tabulating Committee recommended the bid be agmrded to them. Mr. Summers moved that Nationwide Insurance Company of Boca Raton: D, L. Wi!k/nson~ Agent~ be,awarded the bid for 'che $1Q.O0 per person per year accidental death special insurance for policemen and fire- m~n.~ Seconded by ~r. Wo~elt. ~nan/mousty carried. P__~LIC AUDIENCE Dr. Tech, 330 W. Ocean Avenue came forward wanttrg to know if the Council b~d any additional information regarding the POst Office matter at this time. Mayor k~ichaet asked Mr. Cess Farrar to come forvk~rd and advise the audi- enee of the outcome of the meeting held this date. Mr. Cess Farter came forward and advised the general results were that they did not reach a meeting of the minds per se. Mr. Gilman made suggestion for wh~t he thought was his price and the State Road Depart- ment presented an appraisal but there.was a difference of about $5,000. in what was wanted and what the appraisal stated. No mention was made of any other streets other than Second Avenue by the Post Office at this meeting. Mr. Forbes of 425 N.W. 4th Avenue came forward to advise he wrote letter to ~4r. Court-ney dated July il, 1967 regarding tax reduction on his property and had not received a reply to date. Mrk Court-ney ad- vised that he had explained the matter to Mr. Forbas at the t/me he was in the office and did not see the need for a letter. Mayor Michael advised they made a ruling at the second meeting that they would not consider any piece of property at that m~eting other than those on the agenda of the first meeting. Mayor Michael advised that Mr. Court-ney would send ~. Forbes a letter explaining the reason his property was not heard at the Equalization MeetS. Col~ Wehretl came forward and directed his comments to Councilman Wor~etl stating that many people in the City were very sorry to hear that he will not be on the Council any more. He further stated that he thinks a council should be represented by all facets of the community necessary~ and that we are sorry to see him leave the council. The City Attozcley was ~equested to check the Ordinance on Code of Ethics already J_n effect in Boynton Beach s~d compare it with the one just passed by the Legislatare and give the CoUncil a me- commendation on LEGAL O~dinanc9 67-___1:5 (2nd Reading) ~ezoning acreage parcel from R-1 to R-SA. City Attorney read Ordinance 67-13 on second reading. Mr. Nyiund moved that Ordinance 67-13 be passed and adopted on second reading. Seconded by Mm. Collins. Unanimously carried. City Attomney advised he had prepared Ordinance 67-15 ~mending one sentence of the Zoning Code regarding height of hedges~ Mr. Worrell moved that this Amendment Ordinance be tabled Luntil the nex~ workshop meeting. Seconded by Mr. Summers. Unanimously carried~ City Attorney advised he had prepamed Ordimance 67-16 pertaining to Fire Amms ~o include "lime or discharge~ in the pmesent ~dinance- Mr. S,ummers moved that %~ table this and study it at the next work- shop meeting. Seconded by Mr. Nylund. Unanimously earried. ADMINISTRATIVE Request for__Refund on Cemetery lots. (a) Gerald R. SkLnner (On the table) Lot 207~ Block E. (b) A. J. Weiqman~ Lot 27~ Block F~ B.B. Memorial Park The City Clerk advised that the Cemetery Board recommended that the Ci~ Council establish the policy of mefunding the purchase price less 20%. Mm. Nylund moved that the City set a policy that we retain 20% of the purchase price on cemetery lots. Seconded by Mr. Summers. Unani- mously carried. Mr. Worre!l moved that the Gerald R. Skinner and the A.J. Weigman money be refunded with 20% of the purchase price deducted. Seconded by Mr. Collins. Unanimously carried. Request for Perm%t to Solicit. (a) Lions Club, Saturday, October 21 - White Cane Day. APP~O%~L OF BILLS (a) The bill from Lyndon Lanes Corp. for partial payment in the amount of $6:~10.00 was presented for payment. Mr. Nylund moved that v~ pay Lyndon Lanes Corp. partial payment of $6,410.00. Seconded by Mr. Worrell. Unanimously carried. (b) City Clerk advised that a bill from Atlantic National Bank for $825.88 for annual fee due the bank on bond issue contracts is due. ~r. Summers moved that this bill be paid. Seconded hymn. Nylund. Unanimously carried. (c) City Clerk advised a bill from Jack Sharp, /_ne., for Water Tank ~,[aintenance Service in the amount of g6~000, has been received and that it has been approved by I~. Courtney. Mr. Womrell moved that this bill be paid. Seconded by Mr. Summers. Unanimously carried. O~HER The City Attorney discussed the boundary case of the City.
