The Mayor called the meeting to order. The invocation by Re~, Paul H. Huyett~
St. John's Methodist ChUrch~ rne flag salute was led by Bill Allan, Tax
Assessor.
The Vice-President of the Boynton Beach Chamber of Commerce was welcomed by
the Council.
MINUTES
Mr. Nylund moved to accept the minutes of the regular meeting held August 7th
as written. Seconded by ~r. Collins, Unanimously .~arried.
~. Summers was on vacation aud was not present for the meeting.

as written. Seconded by~. Worrell. Unanimously carried.
OLD BUSINESS
Discuss ~%nexation
~yor Michael stated that this Council had inherited this from the previous
council and gave a complete list of events leading up to ~ne present time.
He presented what he feels are the facts J~ this case. ~s far as a~u~xation
and constant harrassmen~ of the Cmty Attorney ms concerned, thms proposed
annexation is illegal and we are very fortunate to have had ~. Fruda as
our attorney in this matter.
He further advised he had checked with various departments of the City
regarding cost to service subject area. Mr. Hughes, Sanitation Department
advised it would cost the City approximately $9,713.O0 per year. Fire
Department reported that there is insufficient supply of water even for
single dwelling homes to say no~hi~gabout high rise apartments, There are
no fire hydrants servicing this area; we ~ould need more men and equipment
and fire hydrants. City Manager advised for water and sewer we wo~ld need
an additional line connecting 15th Avenue bridge crossing at an estimated
cost of $15,0OO.OO; a lift station would have to be installs8 at an
estimated cost of $18,O00.00. Water and Sewer: $103,000.00 for a total of
$12&,013.OO for first year. Police Department advised they feel that normal
patrol in the area should be a~ least six cheeks l½ hours~ total 25 miles per
2&.he,ar period ~ud would coe~ approxL~t~ty $1,?OO~00 per year for such a
patrol.

Mayor I~iichael read s letter from ~o Summers advising it was his plat-~ at the
moment to be on vacavion and wanted it on record not to consider any annexation
program until necessa~y steps have been taken on sound legal basis. It is
his further recom~endaticn we follow the advice of our legal counsel.
Col. l~ehrell~ mamber of the Planning & Zoning Board, came forward in defense
of the Board s~d advised the vote was for annexation only if economically
feasible ~
M~yor ~fichael advised that no plans or prints have been submitted to the
Council to date on this annexation request.
~. Collins advised that he asked ~.~. Hank Thompson if the mock plans could
be brought do-~u~.
Mayor ~ichael s~zised that no plans or prints were ever brought to Council,
but Council was adv%sed they could make a trip to Palm Beach and look at them
there. He said he did not feel that they should have to go all tlne way to
Palm Beach to look at plans when it was the practice for years that plans
and prints be submitted to the City Council for their study,
Mr.Nyiund moved to see whether this Council desires authority vo annex
property. Seconded by ~. Collins. Unanimously carried.

Mm. Fruds, City Attorney~ advised that no special bill can be passed until
it c~u be presented to the Legislature and they will not meet again for two
years. He then discussed tbs General Law in detail.
It was decided by' Council that if they were to write the Legislature that it
~s,~heir ~-d_sh in the future to be able to annex add when ~e next opportunity
arrives to present a Bill we would appreciate them giving us a chance to do
so. This letter to be signed by each Councilman.
Consider position of City Engineer (On the table)
Em. Nylund moved we take this from the table. Seconded by ~f~. l',Iorrell.
Unanimously carried.
1~. Courtney advised if we could get someone with utilities and sanitation
background it ~ouldbe a good thing for the City to have such a qualified
person on the payroll. We would have a very limited amount of engineering
and his primary responsibilities would be in a Superintendsnt capacity.

John Klink~ representative of Russell & Axon, came forward and discussed
the matter further with the Council, He advised that Russell & Axon would

like to see the City get a City Engineer of their own.
Mm. Wormell moved that we request that the City Manager advertise for
this position and that he bring back the names and recommended pay
scale to this Council and if it is deemed feasible that we hire an
Engineer. Seconded by Mr. Collins. Unanimously carried.

Mr, Worrell read Article 17~.07 of the Florida Statutes and discussed
it with the Council.
Mr. Walter Dutch came forward and he too quoted sectiqns of the Florida
statutes and advised that Section 176.07 stated in pa~t ~until the f~nal
report has been received from such commission~. He adMised the Co~uncil
that he absented himself from the Planning & Zoning Bqard when this was
being discussed~ and said there is actually no eonfli~,t of interest on
his part any further. En fact: he could have sat on the Board at the
last meeting. He discussed the statements made by Mr, Wen~elt at the
Special Meeting of the Planning $ Zoning Board.
Mr. Wehrell came forward to advise that he checked this area quite
thoroughly and both pieces of property are contiguous (Parcel 1 and
Parcel 2) and that was Mr. Weaver's motion. He gave tlae Council a
complete report of the situation and advised that considerable checking
has been done on his part and he feels that it would be a wrongful do-
ing on the part of the City of Boynton Beach to rezone this property as
requested to R-SA.
Mr. Worreil advised he ~s not in favor of bulking thgse two parcels and
that they should be acted upon as individual pieces of property.
Mr. Nylund moved that he would like to hear ~ese two parcels discussed
at this time. There was no second. Motion dmed for ~lack of a second.
Mm. Collins ~oved that we teble the decision on thesetwo parcel~ of
property untml such time as the Planning g Zoning Board can submmt their

decision and requested that the Planning & Zoning Board meet at the
