Summers~ Vice Mayor Gilbert H. Collins, Councilman Leonard E. Ny!und~ Councilman A.C!yde Worrel!, Jr., Councilman Mr. Grady W. Courtney, City Manager imm. Ronald Fruda, City Attorney Mrs. Tereesa Padge~t~ City Clerk Mayor Mic~hael called the meet/rig to order at 7:30 P.M. The invocation was given by Councilman Worrell and the flag salute was led by Councilman Nylund. Recognition of members of Chamber of Commerce and Civic Organizations: There was no one in the audience from any civic organization. MIbrdTES Mm. Summers moved that the Minutes of the Regular Meeting of July 10th, 1967, be accepted as w~itten. Seconded by Mr. Nylund. Unanimously carried. OLD BUSINESS Consider request of Libvary Board - (On the table) Mr. Worrell moved that Item A., Request of the Library Board be moved from the table. Seconded by Mr. Summers. ~nan/mously carried. Discussion was held. Mr. Worre!l moved that we turn down the Library Board ~equest at this t/me. Seconded by Mr. Summers. Vote was 4-1, Mm. ColiLns opposing. Motion carried. Diso/ssion held. (Mrs. Sullivan advised that $102.00 was turned in over the past year for outside use of library members. If %~ were with the County we would get more money annually and we would have an opportunity to purchase books for less money.) (Mrs. White f~om the Library Board, who has been on the board sLnce the library was taken over by the City, spoke regarding the way there is no difference between the way City and County residents tmeat books. Palm Beach County is one of the few counties that does not have a County Library System.) Mayor Michael read a portion of the letter from the City of Lake Worth regarding this matter. ReQuest to reconsider decision on Zonin~ request (Church of Jesus Christ. Mrs. Padgett, City ~Clerk, read letter regarding this ~atter requesting the City to reconsiaer the rezoning of this property. O~iginat request was from R-t to C-1. The request to reconsider rezon~r~j at this time is from R-1 to R-3A. Considerable discussion was held at this time. -1- MIN~JTES REC~dLAR CITY CO~/NCIL MEETING JULY 17~ 1967 Mr. Fruda~ City Attorney~ advised the Council that legally the City must readvertise this change in zoning and it has to go through the Planning and Zoning Board first~ then come before the Council. Mr. Summers moved that we deny the recor~ideration and advise the pamties asking for this zoning change to go through the regular procedure of changing to another classification. Seconded by Mr. Collins. Unani- mously carried. ,Consider _application for permit To remove muck (On the table) ~. Summers moved that we move from the table the request for permit for memoving muck of Eugene viekemy. Seconded by Mr. Nylund. Unanimously carried. Mr. Courtney~ City Manager, gave report on the discussion he had with Mr. Viekery~ and advised that Mr. Vickery would not t~anspomt anything over roads that are not in condition to accept the load. He guarantees he will make sure that nothing is done to upset the Lift Station and he will furnish bond to satisfy the City that he is meeting legal require- ments. Further discussion held. Mr. Summers moved that a permit be granted to allow M~. Vickery.to de- mu~k one quarter of the area at a time and that he refill it before memoving any further muck and that he post a $2:000. bond each time. Seconded by Mm. Worrell. Unanimously carried. Appoi~..t me~be~s ~o Road Planning Committee Mayor Michael suggested that we do go ahead and appoint this committee at this t~e and suggested the following names as possible members; Mr. Henry E. Thompson~ Chairman ~r. Harvey Oyer Mr. George Wilde M~. Stanley Weave~ Mr, John Rogers M~. Joseph Brull: Technical Consultant Mayor Michael~ City M~. George Grosch~ Industrial Mr. Nylund moved that we accept the above mentioned meg for the Road Planning Committee. Seconded by M~. Summers. Unanimously cam~ied. BIDS A. Awarding 1. Repairs to City Hall Building Mrs. Padgett, City Clerk, read letter from Lyndon Lanes Corporation re- questing an additional thirty-days (30) be added to the forty-five (45) days set out in his bid, makin9 a' total of 75 days to complete the job. Dis cuss ion held. -2- MINUTES REGULAR CITY COUNCIL MEETING JULY 17~ 1967 Mr. Summers moved that we accept the low bid of Alter~..ate ~2 for $12~82C. of Lyndon Lanes Corporation for repairs on City Hall, Sec- onded by Mr, Collins. Unanimously carried. Mr. Nylund moved that the awarding of this bid be subject to negotiation of contract. Seconded by Mr. Summers. Unanimously carried. Eradicat.ion of A~uatic Weed~ lit, Courtney~ City Manager, advised that they went over and tried to figure out how they could do it on the $4~000. in the budget at this t/me. After checking it out thoroughly~ wP~t they intend doing would come to approx/mateiy $4~O00, Discussion held, Mm. Worrell moved to partially accept this proposal f~om Pennsalt Chemi- cal Company with provision that proper agreements be ~rawn up by this company and allow the City to enter a contract with Pennsalt for the amount of $4~000. provided in the budget. Seconded by Mr. Summers. Unanimously carried, Mayor Michael asked if anyone wished to come before the Council to please come forward. No one came forward. NEW BUSINESS There was no new bus~es$. LEGAL A, Ordinance 67-8 (lst Reading) ~ ' re~onmng Lots 157 th~u !60~ Arden Park from R-1 to R-2A - Thomas H. Dean request, The City Attorney read Ordinance 67-8 on first reading. Mr. Ny!und moved that Ordinance 67-8 be passed on first reading. Seconded by Mr. Summers. Unanimously carried. B. Resolution 67-Q approving agreement between Seaboard Air Line Pmilroad and City. The City Attorney read Resolution 67-Q. Mr. Summers moved that Resolution 67-Q be approved. Seconded by Mr. Worrelt. Unanimously carried. %DMINISTRAT!VE A. Receipt of corrected Tax Roll figures Mr. Summers moved that this corrected tax roll figure be tabled until -3- MINUTES REGULAR CITY COUNCIL MEETING JULY t7~ 3.967 Mr. Allah's return from his vacation. Seconded by ~, Nylund. Unani- mously carried. B. Report by City Managgr on Delinquent Sgwer accounts Mr. Courtney~ City Manager, read the list of amounts due on the follow- lng accounts: ~ae on Water $117.16 Due on Garbage 265.00 Due on Sewer 5~246.63 and suggested we get authority to take whatever steps we can to collect these sewer accounts that are getting higher and higher. Discussion held. Mr. Nylund moved that we give the City Attorney and City Manager the authority to take whatever steps are necessary to collect these bills. Seconded by Mr. Summers. Unanimously carried. Mr. Armstrong came forward to advise the Council that he was not on City Sewer and was not ever going to be on it~ etc. C. Estgblish po~i~v.gn Lot Mro Courtney requested opinion from the City AttOrney on this matter. Fm. Summers requested the Mayor to appoint committee to %~rk with the City Manager and the City Attorney and come up with a solution on this problem. Considerable discussion was held. Mr. Worrell moved that we table this until City Manager brings recommenda tion rom the procedure for us to follow. Motion failed for lack of a second. Mr. Collins moved that Mm. Court-ney advise the property owners when pro- perty needs clearing and that if the City has to do it then property owlaers will have to pay the City for the work done. Seconded by Mr. Summers. Unanimously carried. D. ~onsider rates for Garbage collections The Committee, cons~stmnq of Mr. Nylund~ Mr. Courtney and ~lr. Collins, recommended to the Council that a 25% increase be made mn these rates, Each member of this committee gave a report of their findings. Mr. Dittes of 312 S.W. 9th Avenue came forward to discuss the possibilit%, of an additional charge for people who had two and three cans for pickup, Discussion held, Mr. Summers moved that we prepare an Amendment to the Ordinance making -4- MINUTES REGU!AR CITY COUNCIL M~ETING JULY 17~ 1967 the rate changes on the garbage pickup as per the Committee's recommenda~ tions of $1.25 for home owners and .80 for each apartment and accept it for about three months and ~eck with the City Manager as to how it is working out at that time. Seconded by Above motion was withdra%~n. Ny!und moved we table this matter ~o the next meeting. Seconded by Summers. Unanimously carmied. E. Discuss Sewer deposits Discussion was held. Mm. Summers moved that we amend the present O~dinance charging for sewer to include only new customers and thc deposit be equal to two month's billing. Seconded by Mm. 9~'rell. Ur~nimously carmied. F. Establish da. te for first meeting in SeptembeR Mr. Nylund moved that the finest meeting in September be held September llth instead of Septembem 4th due to Labor Day Weekend. Seconded by Mr. Worrell. Unanimously carried. G. List of payments made in June, 1967 Mr. Worrell moved that we accept the payments made. Seconded by Fro. Collins. Unanimously carried. H. Allen Lnsu~ance Agency - $25,504.00 City Clerk advised that the bill for Allen Insurance Agency in the amount of $25:504.00 for Annual Insurance premiums~ as pep bid~ is due, Mr. Summers moved that we pay Allen Insurance Agency their bill of $25~504.00. Seconded by Mr. Nylund. Unanimously carried. I. Departmental Reports Mr. Summers moved we accept the Departmental reports as presented. Seconded by Mr. Nyl~nd. ~nanimously carried, OTHER None.
