CI'T'Y OF BOYNTON BEACH, FLORA CASE N0, I4-2369 LIEN MODIFICATION ORDER THIS CAUSE came before the City of Boynton Beach Code Compliance Magistrate on the Respondent's application for lien reduction on April 20.2016. pursuant to Chapter Two, Article Five of the City Code of Ordinances. The Magistrate having considered the application, all the facts regarding the specific code or codes the appealing party was in violation of, the date of the original Magistrate hearing, the date the affidavit of compliance was issued, the current lien amount and all pertinent information relating to the specific case and being otherwise duly advised in the premises, it is hereupon, ORDERED AND ADJUDGED that; I . The City shall prepare a release and satisfaction consistent with this Order. 5. The release and satisfaction shall be recorded in the public records of Palm Beach County at the Respondent's expense. 6. This Order is not final until the time period for appeal under the Code has elapsed and if appealed is properly disposed by the City Commission. 7. In the event that the property owner does not comply with the Magistrate's order, as approved or modified by the City Commission, within ninety (90) days of Commission's action, the Lien Reduction Order shall be of no further force or effect, and the original lien shall remain on the property. Violation date was October 17, 2014. The'Code hearing was on April 15, 2015, and no one appeared. Compliance date and fine set was 1 or 11 a day. Case came Into compliance on July 30, 2015; there were 95 daysofnon-compliance 0 dfor total of$47,500 plus administrative fees of $634.12. There was an outstanding water bill of $23.04, that was paid. There were outstanding taxes of $3,431.26 that were paid. All permits have been finaled, and It is now in compliance. Nick Zagarolo, attorney for Frederic Fortier, said Mr. Fortier is a Canadian citizen who travels a lot. When he got notice of the violation, he gave it to a licensed contractor to address the concerns. He thought the work was finished, but then found the lien when they put the property up for sale in May or June of 2015. He subsequently cleared up the necessary items for lien reduction. .:. = Based on the testimony, Ms. Ellis reduced the lien to $2,000 plus administrative costs of $634.12.
