R16-094RESOLUTION R16 -094 A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, GRANTING A UTILITY EASEMENT TO FLORIDA POWER & LIGHT FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF UNDERGROUND ELECTRIC UTILITY FACILITIES LOCATED IN TRACT C — CORTINA PUD REPLAT TWO; AUTHORIZING THE MAYOR TO SIGN THE UTILITY EASEMENT; AND PROVIDING AN EFFECTIVE DATE. 1� 1 T 1 1 1 1 1 1 1 2 2 2 2 WHEREAS, on November 17, 2015, the City Commission, via Resolution R15- 141, approved the Boynton Village Park Conveyance Agreement with BR Cortina Acquisitions, LLC.; and WHEREAS, it is necessary for the City to provide FPL with a ten (10) foot wide easement on the City owned property; and WHEREAS, the easement will allow FPL to construct, operate and maintain underground electric utility facilities to be installed from time to time. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof. Section 2. The City Commission of the City of Boynton Beach, Florida does hereby approve the granting of a Utility Easement from the City of Boynton Beach to the Florida Power & Light for the construction, operation and maintenance of underground electric utility facilities to be installed from time to time at Tract C — CORTINA PUD REPLAT TWO and authorizes the Mayor to sign the Utility Easement, a copy of which is attached hereto as Exhibit "A ".
