O75-42ORDINANCE NO. 75-42 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 64.1 OF KRTICLE IV OF THE MUNICIPAL CHARTER OF SAID CITY AND CREATING Ai~ EXCEPTION TO THE REQUIREMENTS OF SECTION 64 OF ARTICLE IV OF THE CHARTER OF SAID CITY WHEN REAL PROPERTY IS BEING PURCHASER FROM OR SOLD TO ANOTHER GOVERN~NTAL AGENCY? PRovIDING FURTHER FOR SAVINGS CLAUSE,' P~PEALING AND FOR OTHERPURPOSES. WHEREAS, ~he City Council of the City of Boynton Beach, Florida, deems it to be in the best interests and for the general welfare of the inhabitants of said City, to create an exception to the requirements of Section 64 of Article IV of the Municipal Charter of the City of Boynton Beach when real property is being purchased from or sold to another governmental agency. NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO~CIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section t: That Section 64.1 of Municipal Charter of the City of Boynton is hereby amended to read as follows: Article IV of the Beach, Florida, be and "Sec. 64.1. ~ame--Exceptions. (a) The purchase or sale of any real property by the City from or to another governmental agency shall be subject to approval of the City Council and shall conform to such regulations as the City Council may from time to time prescribe, but such purchase or sale shall be excepted'~!and exempt from the remaining provlsmons of Section 64 of Article IV of the Charmer of the City. (b) On any purchase of personal property involving amounts in excess of $1,000.00 and less than $5,000.00 and in the event that three or more prospective vendors have rejected invitations to bid, the City Manager is authorized to negotiate informally with other prospective vendors to secure, as his judgment may direct, the most advantageous and beneficial purchase, for the City and to execute a purchase order or contract to that vendor which shall best serve the interests of the City in price, quality or time of delivery." Section 2.: ~parability: Each of the provisions of this Ordinance are separable, including word, clause, phrase, or sentence, and if any portions thereof shall be declared invalid, the remamnlng portions ~sh&l~ not be affected, but shall remain in full force and effect. Section 3. Repealing Provisions: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. Authority ~ Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 5. Effective Date: This Qr. dinance shall become effective in the manner and at the time provided by law. First reading this ~day of December, 1975.
