~AN ORDINANCE OF THE CITY OF BOYETON ~EACH~
FRIDA~ AMEI~DING SECTION 29 OF ARTICLE II
THE MUNICIPAL c~TER oF SAID CITY TO
ELIMINATE THE REQUIREMENT OF A 'PUBLIC
REFERENDUM IN ~ORDER TO GRANT OR RENEW A
UTILITY-FRANCHISE IN SAID CITY; PROVIDING
FURTHER FOR SAVINGS CLAUSE~ REPEALING
PROVIStONS~ AUTHORITY TO CODIFY~ AN
BE IT ORDAINED BY THE, CITY COUNCIL OF ','~ CITY OF
BOYNTON BEACI~, FLORIDA:
.Section l: That Section 29 of Article II of the
Municipal Charter of the City of Boynton Beach,~ Florida~ be
and is hereby amended by striking and eliminating the fol-
lowing language in said Section 298 to-wit:
"...but no such grant or renewal of any such
grant~ shall be effective without referendum
to the people~ at an election to be called
for and held in accordance with the provisions
of this charter for the holding of bond
elections."
and thereby amending said Section 29 to read as follows:
"Sec, 29. Utility franchise--Grantinq.
The City Council may~ by ordinance~ grant
permission to any individual~ firm or corpora-
tion~ to construct~ operate and maintain any
public utility in~ upon~ or over the streets
and public spaces of the city.'~
Section 2.. Separability: Each of the provisions of
this Ordinance are separable~ including woz~,~ clause~ phrase,~
or sentence~ and if any portions thereof shall be declared
invalid,~ the remaining portions shall not be affected~ but
shall remain in full force and effect.
Section 3. ~epealinq Provisions: All ordinances or
parts of ordinances in conflict herewith are hereby repealed°
Section 4. Authority ~o Codi~3 S~%ecific authority is
granted to codify and incorporate this Ordinance in the City's
existing Code.
Sec~tion 5. Effective Da~e: This Ordinance shall
become effective~ in the manner and at the time provided by law.
