O75-32ORDINANCE NO. 75- 3;% AN ORDINANCE OF THE CIT~ OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 19 OF THE CODIFIED ORDINANCES OF SAID CITY BY AMENDING THE RULES AND REGULATIONS AS TO THE ISSUANCE OF PARKING PERMITS, THE FEE FOR PARKING PERMITS, THE RE- ISSUANCE OF PARKING ~PER~ITS , THE ISSUANCE OF TEMPORARY PARKING PERMITS, ~ PLACEMENT OF PARKING PERMITS, BY PItOVIDI~NG FOR SPECIFIC PARKING AREAS FOR CERTAIN VEMICLES.~ AND BY PROVIDING A PENALTY FOR NONCOMPLIANCE WITH THE fRUL~S AND ~REOLrLATIONS; PROVIDING FOR AUTHORITY TO CODI~5~, SAVINGS CI~AUSE~ REPEAL- ING PROVISION~S., AN EFFECTIV]E~ DATE AND. F°R 0 mR p P0S s W-r!ERE~S, the City Council of the City of Boynton Beach, Florida, deems it necessary and advisable to provide for addi- tional regulations ~as to the issuance of parking permits, the fee for parking pe~mits~ the reissuance of parking permits, the is- suance of temporary parking permits, the placement of parking permits, by providing for specific parking areas for certain vehicles, and by providing a penalty for noncompliance with the rules and regulations therein; NOW, THEREFORE, BE IT ORDAINED BY T~RE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: Section 19-38.1 of Chapter 19 of the Codi- fied ordinances of the City of Boynton Beach, Florida, be and is hereby amended by amending Policy No. 1 entitled, "PARKING PER- MITS", to read as follows: "Parking permits will be issued to residents (see '~efinitions") of the City of Boynton Beach, for a charge of $1.00 for the first decal issued to a resident vehicle, upon satisfactory comple- tion of appropriate application forms. Appli- cants will be required to establish proof of residency in the City of Boynton Beach (see '~efinitions") and to present his cfficial state motor vehicle tag registration certificate. When application iS made for more than one permit, each separate individual vehicle registration must be presented. Residents having out-of-state reg- istered vehicles or whose Florida registration shows an out-of-city addr~ess, may establish proof of their residency by suitable means, including the presentation of city tax bills, utility bills, rent rseeipts, driver's license, voter's regis- tration card Or other appropriate proof cf resi- dency. In the event that a dec&l, which has been issued to a resident vehicle, is lost or destroyed, a new decal shall be reissued to the said resident vehicle for a charge of $1.00 provided that re- mains of the original decal bearing the number are turned in at the time of reissuanCeo How- ever, if remains of the original decal bearing the number thereof are not turned in, a charge ef $5.00 shall be required for the reissuance of a new decal. Definitions. "Resident: Anyone ow~ing, leasing or occupy- ing zeal estate or living accommodations in the City of Boynton Beach, and the members of their family residing with them, including visitors staying in Boynton Beach with residents thereof and paying guests at hotels and motels located within the corporate limits of the City of Boynton Beach. Provided, however, for purposes of this Section, the term "City of Boynton Beach" shall include all property within the corporate limits of the To~¢~ of Ocean Ridge. ~'City Employees: Ail city employees, clas- sified and nonclassified, ~egardless of residency shall be eligible to receive a parking permit. °°ProOf of employment shall be established through the personnel department of the city. "Persons who terminate their employment with the city and who are not city residents shall be required to scr.aps off their stickers and return remains to ~ssuing office.~ ~- ~ - ~ ~ Sectlon z. Section 19-38.1 of Chapter 19 of the Codi- fied Ordinances of the City of Boynton Beach, Florida, be and is hereby further amended by amending Subparagraphs (7) and (8) of Policy No. 2 entitled, "PROCEDURE FOR ISSUANCE OF PARKING PERMITS read as follows: '~(7) Ail parking permits shall be permanently affixed upon the lower, r~ghthand side (passen- ger side) of the ~nside of the front windshield of such vehicle. "(8) Parking permits issued to motor-cycles, motorbikes, and motor scooters shall be displayed on the right front fork of such vehicle." Section 3: S~ction 19-38.1 of Chapter 19 of the Codified Ordinances of the City of Boynton Beach, Pt~rida, be and is hereby ifurther amended by amending Policy No. 3 entitled, ~-CA~. "TEMPORARY PARKING PEi~MITS", to read as follows: "Temporary parking permits will be issued by the City of Boynton Beach in accordance with Policy Nos. 1 and 2. "The purpose of temporary permits will be to meet the requirements of the 'Resident' definition as it pertains to guests residing with residents for a short period of time~ and paying guests at hotels and mo%els. There shall be a charge for the issuance of temporary permits to hotel and motel patrons and guests in the amount of 25~ per day. For persons other than hotel and motel patrons and guests, there shall be a charge for the issuance of temporary permits in the amount of $1.00 per week. TempQrary permits shall be ~alid for a maximu~ tim~ period of four (4) consecutive weeks. "The ~original copy of the permit will be given ~o the iapplicant while the duplicate copy will be filed with~the ~pplication form." Sec~tion ,6: Authority to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 7: Separability: Each of the provisions of this Ordinance are separables including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected by shall remain in full force and effect.
