AN ORDINANCE OF T~LE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 2-21 OF ARTICLE III, q~TER 2, OF
THE CODIFIED ORDINANCES OF SAID CITY, ~LiMINATING
THE REQUIREMENT THAT THE CITY MANAGERRESIDE WITHIN
SAID CITY DURING HIS TENURE OF OFFICE; PROVIDING FOR
AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING
PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, Section 2-21 of Article III, Chapter 2, of the
Codified Ordinances of the City of Boynton Beach, Florida,
includes the requirement %hat the City Manager reside within
said City during his tenure of office; and
~EREAS, the City Council of said City deems such
residence requirements to be unnecessary for the efficient
operation of the municipal government, and the City Council
recognizes that such restrictions not only impose financial
hardships but also limit the availability of qualified personnel.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That Section 2-21 of Article III, Chapter 2, of
the C6dified Ordinances of the City of Boynton Beach, Florida,
be and is hereby amended by striking the last sentence of said
section and by amending said section to read as follows:
"Sec. 2-21. Appointment and qualifications.
Pursuant to the provisions of section 49 of the
codified charter of the City of Boynton Beach,
Florida, the city council may appoint a city manager
who shall be the administratiue head of the city
government under the supervision and direction of
the city council and who shall hold office at the
pleasure of the city council. He shall be chosen
solely on the basis of his executive and admini-
strative qualifications without regard to his
political belief or persuasion."
Section 2. Authority to Codify: Specific authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 3. Separability: Each of the provisions of this
Ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4. Repealing Provisions: All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
Section 5. An Effective Dante: This Ordinance shall
become effective in the manner and at the time provided in the
Charter and Ordinances of the City of Boynton Beach, Florida.
