AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SEBSECTIONS 31-16.1 (3) (a) and 31-16.1
(8) (e~ OF CHAPTER 31 OF THE CODIFIED ORDINANCES
OF SAID CITY, PROVIDING FOR CONSIDERATION BY THE
TECHNICAL COMMITTEE FOR SITE PLAN P~EVIEW OF
PROVISIONS FOR 'CURB CUTS IN PROPOSED SITE PLA/~S;
PROVIDING FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE,
REPEkLING PROVISIONS, AN EFFECTIVEDATE AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BE~CH, FLORIDA:
Section 1: That Subsection 31-16~t (3) (a) of
Chapher 31 of t~he Codified Ordinances of the City of Boynton
Beach, Florida,.be and is hereby amended by adding the words
"curb cuts" whereby the said Subsection 31-16.1 (3) (a) shall
read as follows:
Types, dimensions, character, locations and
patterns of streets and roadways and other
facilities for ingress and egress to the
prQperty and the proposed structures thereon,
if any, including such considerations as auto-
motive and pedestrian safety and convenience,
traffic flow and control, curb cuts, refuse
co~llection and other maintenance services,
off-street parking and loading areas, access
for police and fire protectzon and for emergency
rescue service, access in case of catastrophe,
and al.1 other considerations related thereto,
including consideration as to economic effects,
noise, glare, fumes, odors, vibration and
other effects of the proposed site plan on
adjacent and nehrby properties and properties
generally in the district."
Section 2: That Subsection 31-16.1 (8) (e) of
Chapter 31 of the Codified Ordinances of the City of Boynton
Beach, Florida, be and is hereby amended to read as follows:
"(e)
Location of points of entry and exit for motor
vehicles and internal c!rculation pattern,
together with location of all curb cuts."
Section 3. Authority to Codify: Specific authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 4. Separability: Each of the provisions of
this Ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
emaining portion shall no~ be affected but shall remain
in full force and effsct.
Section 5. RepeaLing Provisions: AL1 ordinances or
parts of ordinances in conflict herewith are hereby repealed.
Sec%ion ~6. An Effective Date: This Ordinance shall
0ecome effective in the manner and at the time provided in the
Charter and Ordinances of the City of Boynton Beach, Florida.
