O75-15ORDINANCE NO. 75-/~' AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AFLENDING SECTION 23A-30~i~CHAPTER 23A OF THE CODIFIED ORDINA~CES OF SAID CITY TO AMEND THE RATES, FEES AND CHARGES FOR SERVICES OF THE SE$'¢AGE DISPOSAL SYSTEM; PROVIDING FURTHER FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, PdEPEALING PROVISIONS, AN EFFECTIVE DATE A-ND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach, Florida, deems it necessary and essential for the efficient daily operation of the municipal government to provide for an amendment of the rates, fees and charges for services of the sewage disposal system. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Sect'ion 1: That Section 23A-3 of Chapter 23A of the Codified Ordinances oi the City of Boynton Beach, Florida, is hereby amended to read as follows: "Sec. 23A-3. Service charges prescribed. The rates, fees and charges (herein sometimes called the 'sewer service charge') for the use of, and for the services and facilities furnished or to be furnished by, the sewage disposal system, to be paid by the owner, tenant, or occupant of each lot or parcel of land, or of any unit, apartment, or any other type of improv~ent located thereon, which may be connected with or may use the sewage disposal system by or through any part of the city, shall be based or computed upon the number and kind of plumbing fixtures connected with the sewer system or upon the quantity of the water supplied therein, as indicated in the following rate schedule: (a) Single fam/ly residential, duplex apartments, multi-unit residential apartments, cooperative apart- ments, condominium apartments, rental apartments, trailer park units, hotels and motels (two rooms to be the equivalent to one dwelling unit), and laundries (three washing machines or fraction thereof to be the equivalent to one dwelling unit): 5 fixtures or less Over 5 fixtures $5.00 per month minir~um 1.00 per fixture per month (b) Commercial, industrial and manufacturing customers (including restaurants~ hospitals, nursing homes, and institutional type buildings): 0 6,000 gallons of water supplied - $6.00 per month minimum Over 6,000 gallons - 1.00 per thousand gallons per month In addition to the rates set forth herein, the City Council reserves the right to require pre-treatment, special rates or other measures necessary to cope with and protect the City sewer system." Section 2. Authority to Codify: Specific authority is hereby qranted to codify and incorporate this Ordinance in the City's existing Code. Section 3. Separability: Each of the provisions of this Ordinance are separable, including word· clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 4. Repealing Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed~ Section 5. An Effective Date: This Ordinance shall become effective on the 1st day of June, A.D.· 1975. First reading and passage this ./~ day of April· A.D., 1975.
