O75-14ORDINANCE NO. AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDIEG SECTION 52 OF ARTICLE IV OF THE I~JNICIPAL CHARTER OF SAID CITY, PROVIDING FOR DELETION OF THE REQUIREMENT OF OWNERSHIP OF IMP~tOVED REAL ESTATE AS A QUALIFICATION OF ELECTIVE OFFICIALS; PROVIDII~G FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PUR- POSES. WHEREAS, Section 52~ of Article IV of the Municipal Charter )f the City of Boynton Beach, Florida, requires that elective officials shall own improved real estate within the limits of the City of Boynton Beach for one year prior to announcing candidacy for such offices, and that the instrument by which title to such improved real estate is held must have been recorded in the office of the Clerk of the Circuit Court of Palm Beach County, Florida; for one year prior to announcing candidacy for s~h offices; and WHEREAS, such qualification requirements are prohibited by law; and WHEREAS, the City Council of said City deems~ it proper and appropriate that such qualification requirements be deleted from said Section 52. NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Section 52 of Article IV of the Municipal Charter of the City of Boynton Beach, Florida, is hereby amended to read as follows: "Sec. 52. Qualifications of elsctive officers, qenerally; duties~ oath of office. Persons entitled to hold the elective offices enumerated in the foregoing sections shall be qu&l- ified electors within the meaning of this Act, and they shall have such other qualifications as may be hereinafter prescribed. Each of the said officers shall perform the duties of their respective offices as elsewhere provided in this Act, or as may be pro- vided by ordinance or laws of said City, and before entering upon the duties of their respective offices, they shall each take and subscribe to the following oath: "I do solemnly swear (or affirm) that I will support, protect and defend the Constitution and Government of the United States, the State of Florida, and of the City of Boynton Beach, and that I will welI and faithfully perform the d~ties of City Council Mem- be~ of the City upon which I am about to enter, so help me God." Section 2. Authority to Codify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. S_~ection~3. Separability: Each of t~e~visions of this Ordinance a~e separablm~ including, w~r~ sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected b~3 shall remain in full force and effect. Section 4. Repealinq Provisions: All ordinances or parts ~f ordinances in conflict herewith are hereby repealed.
