O75-13ORDINANCE NO. 75- /~ AN ORDINANCE OF THE. CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 16 OF ARTICLE II OF THE MUNICIPAL CHARTER OF SAID CITY, PRO- VIBING FOR THE DELETION OF THE~ REQUIREMENT OF DWI~ERSHIP OF IMPROVED REAL ESTATE AND PAY- MENT OF TAXES THEREON AS A QUALIFICATION OF COUNCIL MEMBERS; P~ROVIDING FOR AUTHORITY TO CCOIF~, SAVINGS CLAUSE, REPEALIb~G PROVISIONS , AN EFFECTIVE DATE AND FOR OTHER PURPOSES. ~FiEREAS, Section 16 of Article II of the Municipal Charter of the City of Boynton Beach, Florida, provides that members of the City Council shall be qualified electors of the City of Boynton Beach and shall have owned and paid City taxes on im- oroved Teal estate within the limits of the municipality for one year prior to filing candidacy for such office, and the instru- ment by which the title to such improved real estate is held must have been on record in the office of the Clerk of the Circuit court, Palm Beach County, Florida, for a period of one year prior to filing candidacy for such office; and WPIEREAS, such qualification requirements are prohibited by law; and WHEREAS, appropriate 16. the City Council of said City deems it proper and that such requirements be deleted from said Section NOW, THEREFORE, BE CITY OF BOYNTON ~ection 1. IT ORDAINED BEACH, FLORIDA: That Section Charter of the City of Boynton BY THE CITY COUNCIL DF THE 16 of Article II of the Municipal Beach, Florida, is hereby amended to read as follows: "Sec. 16. Qualifications of ~ouncil~.~aemb~ms; forfeiture of office. Members of the City Council shall be qualified electors of the City of Boynton Beach and shall have such other qualifications as may be herein otherwise prescribed. Any member of the City Council who ceases to possess the qualifications which are required by this charter~or shall be convicted of ~ felony~ shall forfeit his office, and it shall be the duty of the remaining mem- bers of the City Council to declare the.office vacant and proceed to fill the vacanc~as herein otherwise provided." Section 2. Authority to Codify: Specific authority hereby grantsd to codify and incorporate this Ordinance in the City's existing Code. Section 3. Separability: Each of the provisions of this OrdinanCe are separable, including word, clause, phrase or sentence, and if any portion thereof shall he declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 4. Repealinq Provisions. Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. An Effective Date: This Ordinance shall become effective in the manner and at the time provided hy law. First reading this 1st day of ~ A.D., 1975.
