O75-12ORDINANCE NO. 75-12 ~= H AN ORDiINANCE OF THE CITY OF BOYNTON B~AC , FLORIDA, AMENDING SECTION 26-11.1 OF CHAPTER 26 OF THE CODIFIED ORDINANCES OF SAID CITY, PROVIDING. FOR AN AMENDED BASIS OF COMPUTATION FOR AND ENFORCEMENT OF THE ". PROVIDIN~ FOR "INTERIM SERVICES ~qD ~ACILITIES FEE , AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. W~EREAS~ the City Council of the City of Boynton Beach, Florida, has heretofore adopted Ordinance No. 73-36, establishing the "Interim Services an~ Facilities Fee", and Ordinance No. 74-19, amending the said Ordinance No. 73-36; and WHEREAS, the City Council deems it to be more equitable to amend the basis of computing the fee as hereinafter provided, which is in conformity with the computation of similar fees in neighboring municipalities, except that the ~e~centa~e'-basis shall be one-half (1/~2) 0f ~n~p~r_~ent~ as compared to the percentage of one per cent (1%) mn neighboring municipalities; and WHEREAS, it is recognized that the cost ol providing municipal services is constantly increasing; and WHEREAS, the meteoric growth being expermenced in the City of Boynton Beach is causmng and will continue to cause an undue financial burden on the existing taxpaying property owners because of those improved properties that are receiving the many municipal services, but are not yet placed on the tax ro~l; and WHEREAS, the City has determined that the burden for paying for municipal services should be borne by all properties receiving such municipal services as soon as such services are rendered; and WHEREAS, other services such as water, sewer and other utilities are charged for upon occupancy. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH~ FLORIDA: Section 1. (a) That real property taxes as presently billed and levied are to provide future, not past services. (b) That a fee to be known as the 'Interim Services and Facilities Fee' is hereby established. (e) That the Interim Services and Facilities Fee shall then be pro~ated for those full months following the issuance of the certificate of occupancy and con- tinuihg un~il the beginning of the administrative tax year beginning. January 1st of the succeeding calendar year. (f) That ~he administrative procedure shall be as follows: As soon as a pe.rmanent, temporary or partial certificate of occupancy is issued, the building depart- ment will notify the director of finance. Beginning with the next full month after the establishment of the occupants' water meter account, the director of finance will prorate, based on one-half (1/2) of one per cent per annum of the non tax-exempt building permit ~alue of the improvement, and this a~ount to be billed separately with the water bill until January 1st of the following calendar year, OR beginning with the next full month after the establish- ment of the occupants' water meter account the director of finance will prorate, based on $350 per annum for a ~'~ or less water meter unit charge, to be billed separately with the wa%er bill until January 1st of the following calendar year. Said charge shall be increased on a per annum basis, according to the following multiples or sums thereof in the case of more than one meter: "Meter Size Capacity Multiple 1" or less 1 1-1/2" 2.25 2" 4 3" 9 4" 16 6" 36 8" 64 10" 100 (g) That in the event the Interim Services and Faciiities Fee is not paid within the thirty (30) day period following the d~te of the billing, a lien will be established against the property. (h) That the income from the Interim Services and Facilities Fee shall be a General Fund Revenue." Section 2; Authority to Co__dify: Specific authority is hereby granted to codify and incorporate this Ordinance in the City's existing Code. Section 3. Separability:_ Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 4. Repealing Provisions: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5.
