A~NDING ORDINANCE NO~ 162~9 OF SAID CITY BY GRANTING
CONDITIONAL USE FOR.CONSTRUCTION OF ADDITIONTO
OFFICE SPACE TO CONDUCTDR~FT FISHING BUSINESS ON
PORTEON OF LOT SIX, SAM BROWN, JR.'S HYPOLUXO SUB-
DIVISION~ RECORDED IN PLAT BOOK ONE, PAGE 81;
PROVIDING FOR SAVINGS CLAUSE, REPEALING PROVISIONS,
AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, the owner of the property more particularly
described hereinafter has heretofore filed an application with
the City of Boynton Beach, Florida, requesting conditional
use of subject property for the construction of an addition to
the office space to conduct a drift fishing business located
thereon and has filed plans appurtenant thereto with the
Planning and Zoning Board of said City, and the said Board has
unanimously recommended the granting of said conditional use
application; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, after having conducted a properly advertised public
hearing relative the granting of subject application, deems it
in the best interest of the public~ and in accordance with the
general master plan of the City, that said conditional use be
permitted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That a conditional use for the construction and
operation of an addition to the office space to conduct drift
business on the following described property is hereby
fishing
granted:
That portion of Lot Six (6), SAM BROWN JR.'S
SUBDIVISION, as recorded in Plat Book One (1),
Page Eighty-One (81), Public Records of Palm
Beach County, Florida, which is presently
zoned ZONE R~3.
Subject property is to be completed in accordance with the plans
therefor now on file in the office of the City Building Official.
The official Zoning Map of the City of Boynton Beach, Florida
shall be amended accordingly~,
S~ct~on ~ ~eparablllty_: Each of the provisions of this
Ordinance are separable~ including word, clause, phrase, or
sentence and if any portion hereof shall be declared invalid,
the rema!ning portion shall not be affected, hut shall remain
in full force and effect.
